and the Memorandum of Agreement between North Carolina and the US Environmental Protection agency
dated October 15, 2007 [or as subsequently amended].
I£ any parts, measurement frequencies or sampling requirements contained in this General Permit
are unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, the certificate of coverage shall be final and binding.
Please take notice that this Certificate of Coverage is not transferable except after notice to the
Division. The Division may require modification or revocation and reissuance of the certificate of coverage.

1.0 INTRODUCTION
The Siemens Energy Turbine Generator Service Center facility, located at 5101
Westinghouse Boulevard in Charlotte, North Carolina, withdraws cooling water from Lake
(New
Wylie at an average rate of approximately 7.5 million gallons per day. Two components of
the cooling water operations will be covered under general permits enforced by the State of
North Carolina Department of Environment and Natural Resources (NCDENR) Division of
Water Quality (DWQ). The first component is for Non -Contact Cooling Water Discharge
under an existing National Pollutant Discharge Elimination System (NPDES) General
Permit. The second component is for the Cooling Water Intake Structure which will also be
covered under a General Permit. However, the DWQ has not completed the permitting
procedures for the Cooling Water Intake Structure. It is assumed both components will be
covered under the existing General Permit for Non -Contact Cooling Water Discharge.
The cooling water withdrawal intake tower is located in Lake Wylie at Withers Cove, on the
Catawba River (see Drawing 1 in the Figures section of this document). The non -contact
cooling waters discharge from the facility to a 14-acre Spray Pond located southeast of the
facility. From the Spray Pond, the cooling waters discharge through a riser to a stream that
flows approximately 1,200 feet to Lake Wylie.
1.1 Cooling Water Intake Structure Permit
The Cooling Water Intake Structure (CWIS) Permit is a new requirement from the federal

Clean Water Act's Section 316(b). The intent of the permit is to regulate the CWIS of each
facility that withdraws more than 2 million gallons per day of water of which at least 25
percent is used for cooling water. The regulations are designed to protect fish and other
aquatic life from impingement (being pinned against cooling water intake structures) and
entrainment (being drawn into cooling water systems and affected by heat, chemicals or
physical stress).
For impingement mortality control, EPA proposes two potential compliance approaches:
(1) Install modified traveling screens equipped with fish buckets, a low-pressure wash
and a fish handling and return system, or
(2) Reduce through -screen velocity to 0.5 feet per second or less.
„■, For entrainment control, EPA proposes maintaining screen openings of 0.56 inches or less.
1.2 Non -Contact Cooling Water Discharge Permit
The Siemens facility presently operates under the General Permit No. NCG500000 to
"Discharge Non -Contact Cooling Water, Cooling Tower and Boiler Blowdown,
Condensate, Exempt Stormwater, Cooling Waters Associated with Hydroelectric
Operations, and Similar Wastewater Under the National Pollution Discharge Elimination
System. " The specific permit number is NCG500175, issued 8/1/2012 and scheduled to
expire 7/31/2015. According to NCDENR web page for Wastewater NPDES permits the
renewal application is due by February 1, 2015. The previous renewal application form
identified three discharge points for the non -contact cooling water; OF-001, OF-002 and
OF-003.

3.1 Source Water Physical Data
40 CFR 122.21(r) (2) specifies the following information:
A description and scaled drawings showing the physical configuration of the water
body, including areal dimensions, depths, and temperature regimes, identification
F•, and characterization of the source hydrological and geomorphological features,
estimate the intake's area of influence within the waterbody and locational maps.
1014 The water source is Lake Wylie. According to Duke Energy's web pager, the lake's dam,
first created in 1904 near Fort Mill, South Carolina, was rebuilt in 1924 and the lake's
surface expanded to approximately 13,443 acres and 325 miles of shoreline. In addition to
CA supporting Wylie Hydroelectric Station, Lake Wylie also supports Allen Steam Station and
Catawba Nuclear Station with cooling water and provides water supply for Belmont and
Rock Hill. Full pond elevation at Lake Wylie is approximately 569.4 feet. Full pond is the
0k, level of the reservoir that corresponds to the point at which water would first begin to spill
from the reservoir's dam; the crest of the spillway. The Annual Normal Operating Range
for the lake in 2014 has a minimum elevation of 563.4 and a maximum of 569.4. The
MR average water level for Lake Wylie, based on daily readings over the last 12 months, was
567.0.
Water temperatures in the lake at the Cooling Water Intake Structure vary seasonally as
shown in the chart below for 2014.

3.2 Cooling Water Intake Structure Data
40 CFR 122.21(r) (3) specifies the following information:
The design of the intake structure and its location in the water column, design
.� intake flows, daily hours of operation, number of days of the year in operation, and
seasonal changes, if applicable; a flow distribution and water balance diagram that
includes each source of water to the facility, recirculating flows, and discharges,
.r. and engineering drawings of the cooling water intake structure.
3.2.1 Pump House Design
.r, According to design drawings by Kidde Constructors for the CWIS, dated February 6, 1968
(construction happened soon thereafter); the structure (see Photo 1 in Attachment I) is a cast
in place concrete structure 50 feet long by 30 feet wide and has two levels for a total height
.. of 43.5 feet. The bottom floor level is located at elevation 545.0 (see Figure 3) or 22.0 feet
below the average water level of Lake Wylie in 2014.
r 3.2.2 Traveling Screens
The intake structure is fitted with two Link -Belt Model 45A traveling screens to remove
debris from the lake water. They are each 4 feet wide and 40 feet high (see Photo 3 for a
., view of the tops of traveling screens and design drawing in Figure 3), and have screen mesh
openings of approximately %: inch (Photo 4). The traveling screens have two spray pumps,
(P-5 and P-6 on Figure 3 and see Photo 3) for back washing the screens to remove debris.
The debris is washed into a concrete trough to exit the pump house building and spill back
into the cove (Photo 5).

^ Presently, only one of the two screens (the nearer screen shown in Photo 3) is routinely
operated and for only 1.0 hour per day, typically at 10:30 a.m.

.. Originally, Siemens tested their turbines with steam. Now they test the turbines using a
vacuum system. As a consequence, the amount of water withdrawal required was
significantly reduced. Pump 3 was taken out of commission and removed from the pump
.. house.
3.3 Source Water Baseline Biological Characterization Data
40 CFR 122.21(r) (4) specifies the following information:
A description of the biological community in the vicinity of the cooling water intake
structure.
Lake Wylie is the third largest reservoir in the Catawba-Wateree system and is located
southwest of Charlotte in Gaston and Mecklenburg Counties, North Carolina and York
.. County, South Carolinaz.
A review of rare, threatened, and endangered species known to occur within the three
., surrounding counties of Lake Wylie (Gaston, Mecklenburg and York), revealed two
vertebrate species; the American eel (Anguilla rostrata) and Carolina darter (Etheostoma
collis collis). Both species are listed as federal species of concern (FSC). FSC is an
informal term. It is not defined in the federal Endangered Species Act. In North Carolina,
the Asheville and Raleigh Field Offices of the US Fish and Wildlife Service (Service)
define Federal Species of Concern as those species that appear to be in decline or otherwise
.. in need of conservation and are under consideration for listing or for which there is
insufficient information to support listing at this time. Subsumed under the term "FSC" are
all species petitioned by outside parties and other selected focal species identified in Service
.. strategic plans, State Wildlife Action Plans, or Natural Heritage Program Lists 3.
The Carolina Darter inhabits small- to moderate -sized streams in areas of low current

velocity. Habitat substrates preferred by this species are usually characterized by mud,
.. sand, and sometimes bedrock. This darter seems to be tolerant of fine sediments covering
the substrate it inhabits. The Carolina Darter exists only in the Piedmont region from south-
central Virginia through North Carolina into north -central South Carolina. The range in
., South Carolina is restricted to the Santee River Basin4.
The American eel is a catadromous species that spawns in the Atlantic Ocean. This species
.. is more common near the sea rather than inland streams and lakes. The American eel lives
in freshwater as adults, usually in larger rivers or lakes, primarily swimming near the
bottom in search of food. The species prefers to hunt at night and resides in crevices or
,., other shelter from the light during the day, often times burying themselves in the substrate,
whether mud, sand or gravels.
am A list of common sports fish that inhabit Lake Wylie can be obtained by visiting the South
Carolina Department of Natural Resources website6. A request for additional wildlife, fish
and habitat information collected by Duke Energy was requested on January 9, 2015. A
,N response from Duke Energy was received on January 16, 2015 that the Water Resources
group within Duke Energy would be able to provide additional information. However, as of
this date, the additional data has not been received.
.. 3.4 Cooling Water System Data
40 CFR 122.21(r) (5) specifies the following information:
OR The operation of the cooling water system including descriptions of reductions in
water withdrawals, recycled water, proportion of the source water body withdrawn.
.R The Non -Contact Cooling Water is screened and pumped from the Pump House to the
Powerhouse and passes through the condensers of Chiller #2 and #3, then discharges to the
Spray Pond. Pumping records for cooling water withdrawal and return to Lake Wylie for
2013 is summarized in Table 2. With the reported average water withdrawal of 7,547,066
gallons per day and the pumps operating 24/7, the pumping rate is 5,241 gallons/minute

Comparing the withdrawal to the return, approximately 50,000 gallons or 0.66% of the
volume withdrawn is lost during the cooling process and evaporation from the Spray Pond.

With the reported Lake Wylie surface area of 13,443 acres and an average depth? of 20 feet
the daily withdrawal calculates to be roughly 0.01 percent of the lake volume.
~ 3.5 Proposed Impingement Mortality (IM) Reduction Plan
40 CFR 122.21(r) (6) specifies the following information:
A description of how the impingement mortality will be addressed, such as intake
screen modifications or flow reductions.
EPA specifies that impingement mortality can be addressed by installing modified traveling
screens equipped with fish buckets or reducing through -screen velocities to 0.5 feet per
second or less. Based on the design drawings (Figure 3), the Lake Levels, and the pumping

per second for the average lake water level, and 0.16 feet per second for the minimum lake
water level. Since these velocities are less than the EPA recommendation of 0.5 feet per

3.6 Performance Studies
40 CFR 122.21(r) (7) specifies the following information:
A summary of biological survival studies conducted at the facility and a summary
of any conclusions or results, including; site -specific studies addressing technology
efflcacy, entrainment survival, and other impingement and entrainment mortality
studies.
No biological survival studies are warranted for the facility.
.. 3.7 Operational Status
40 CFR 122.21(r) (8) specifies the following information:
A description of the age of the unit, capacity utilization for the previous 5 years, and
any major upgrades completed within the last 15 years.
The CWIS was constructed in 1968 making the system 47 years old this year. The capacity
.. utilization for the past five years is the same as used today. Pump #3 was removed in 2007
reducing the flow rate of the system to the present level of approximately 5,000 gpm.
3.8 Entrainment Characterization Study
40 CFR 122.21(r) (9) specifies the following information:
Required for facilities withdrawing greater than 125 million gallons per day.
The screen openings are approximately %: inch; complying to the EPA proposed
recommendation of maintaining screen openings of 0.56 inches or less for entrainment

The temperature limit for fresh water is 2.8°C above natural water temperature. However,
�► the receiving water temperature in no case should exceed 32°C at the downstream
monitoring location for lower piedmont waters.
Since no chlorine is present in the discharge, TRC monitoring is not required. Oil and
Grease monitoring is not required because the cooling water does not contain any air
compressor condensate. Likewise, no water treatment or chemical additives are added so
the COD monitoring is not required. Monitoring requirements for the Non -Contact Water
Discharge permit consists of Flow, Temperature, and pH.

4.2 Sampling Locations
Figure 1 shows the seven cooling water sampling locations. The water is sampled at the
pump house (1) when taken from Lake Wylie [Photo 1]. After it is used for cooling in the
plant, it is sampled just before discharging into the Spray Pond (2) [Photo 6]. As the water
flows from the Spray Pond principal spillway conduit (3) [Photo9] it is sampled before
entering the surface stream which flows back to Lake Wylie. When the water re-enters
Lake Wylie it is sampled at the dock at Cove Center (4) [Photo 10]. Some HVAC runoff is

discharged from the plant at two locations identified as Outfalls OF-002 (5) [Photo I l ] and
.. OF-003 (6) [Photo 121 which are also sampling points. Finally, when the runoff ditches
from OF-002 and OF-003 combine and flow through a culvert under the pump house road
to re-enter Lake Wylie, the flows are sampled (7) [Photo 121. Table 5 summarizes the
locations.

4.3 Non -Contact Water Discharge Monitoring Form
The Non -Contact Water Discharge Monitoring Form is included as Appendix IV.
Submission of monitoring forms or other monitoring reports to the Division is not required.
Monitoring information and copies of any reports required by this permit must be retained
on site for a period of at least 3 years from the date of the sample, measurement, report or
application.
4.4 Availability of Reports
Except for data determined to be confidentials, reports shall be made available for public
inspection at the offices of DWQ or at the site of the discharge within a reasonable time
period, not to exceed five (5) days. As required by the Act, effluent data shall not be
considered confidential.
4.5 Duty to Report Noncompliance
The permittee shall report to the central office or the appropriate regional office of DWQ
any noncompliance which may endanger health or the environment. Any information shall
be provided orally within 24 hours from the time the permittee became aware of the

circumstances. A written submission shall also be provided within 5 days of the time the

5.0 CERTIFICATION
This permit submittal must be signed and certified by a principal executive officer of at least
the level of vice-president, or his duly authorized representative, if such representative is
responsible for the overall operation of the facility from which the discharge described in
the permit originates. The signer certifies that they are familiar with the information

Carolina and the US Environmental Protection agency dated May 9, 1994 [or as subsequently amended].
If any parts, measurement frequencies or sampling requirements contained in this General Permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, the certificate of coverage shall be final and binding.
Please take notice that this Certificate of Coverage is not transferable except after notice to the
Division. The Division may require modification or revocation and reissuance of the certificate of coverage.
Contact the Mooresville Re¢ional Office prior to any sale or transfer of the permitted facility.

Westinghouse Electric Corporation submitted an October 15, 1997 letter (see attached) that described
a planned corporate restructuring that was to involve separation of its industrial operations from its
media -related operations. This letter serves as notification that the separation will not be occurring.
However, Westinghouse has instituted a name change that became effective December 1, 1997. The
Westinghouse Electric Corporation has formally changed its name to `CBS Corporation'. CBS
Corporation has retained Westinghouse's 1872 Pennsylvania charter of incorporation.
Also, please be advised that CBS Corporation will be divesting the Westinghouse Power Generation
business unit, the operator of the subject facility, in 1998. The new owner of Power Generation will be
Siemens AG. Prior to the transfer of ownership to Siemens, the Power Generation business unit will
continue to be operated under the Westinghouse name as a `Discontinued Operation' of CBS
Corporation. There will be no immediate change in the day-to-day operation of the facility and the
referenced certificate will be held by CBS Corporation doing business as Westinghouse Electric
Corporation.
In a subsequent letter we will inform you of the completion of the divestiture to Siemens and request a

Bradley, Westinghouse submitted a very detailed renewal application as well as a
letter asking for future consideration from the Division in regard to this
discharge. The collection pond for the non -contact cooling water at this facility
has stormwater discharges emptying into it. Westinghouse is understandably
concerned that pollutants which might enter the pond via the stormwater outfalls
could cause the discharge to violate the effluent limits in General Permit
NCG500000.
I sent the permit renewal out and spoke with Robert Carpenter (the facility
contact). I told him a response letter addressing his concerns would be
forwarded by the Division after the reorganization had been completed. Dave
and I talked this one over and we agreed that your Unit would be better
equipped to respond to the stormwater concerns.
I've attached the cover letter from the renewal application to this memo. The
rest of the application fills 3 file folders - it's in my office with the rest of the
NCG500 tiles. Have a look at this and proceed as you see fit.

the enclosed General Permit. This renewal is valid until July 31, 2002. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated December 6,1983. If any parts, measurement
frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to request
an individual permit by submitting an individual permit application. Unless such demand is made, this certificate
of coverage shall be final and binding.
The Certificate of Coverage for your facility is not transferable except after notice to the Division. Use the enclosed
Permit Name/Ownership Change form to notify the Division if you sell or otherwise transfer ownership of the
subject facility. The Division may require modification or revocation and reissuance of the Certificate of Coverage.
If your facility ceases discharge of wastewater before the expiration date of this permit, contact the Regional
Office listed below at (704) 663-1699. Once discharge from your facility has ceased, this permit may be rescinded.
This permit does not affect the legal requirements to obtain other permits which may be required by the Division of
Water Quality, the Division of Land Resources, Coastal Area Management Act or any other Federal or Local
governmental permit that may be required.

Westinghouse Electric Corporation, Charlotte Turbine/Generator Plant, hereby requests
renewal of its existing National Pollutant Discharge Elimination System (NPDES) Permit
to discharge its non -contact cooling water to the receiving waters of Lake Wylie, of the
Catawba River Basin.
Enclosed is the permit application completed and signed by an authorized officer of the
corporation along with our corporate draft in the amount of four hundred dollars
($400.00) the required processing fee.

As outlined in our current permit, the effluent waters discharged by Westinghouse to lake
Wylie are exclusively non -contact cooling and receive no chemical treatment, therefore,
as instructed by your office, Westinghouse is exempted from the priority pollutant
analysis as part of this permit renewal application.
Westinghouse had previously notified your office that additional discharges not
emanating from or controlled by the Westinghouse Turbine Generator Plant appeared to
be entering the Westinghouse spray pond upstream of outfall 001. Drawing MS 2000
indicates the locations of these discharges in relation to the Westinghouse spray pond.
Earlier communications with your office, we pointed out that these other discharge
sources may have the potential to influence Westinghouse's permitted outfall 001.
The discharges appear to be from storm water runoff from new construction and
industrial activities in the area. We understand that your office has issued permits for
these discharges, with outfalls into the Westinghouse spray pond.
As part of our Renewal Application, Westinghouse below outlines its concern regarding

the additional discharges entering our spray pond from off -site sources. =>>
As our permit indicated, the Westinghouse discharge to the spray pond, consisting of only
non -contact cooling water, has not been problematic and Westinghouse has at its own
expense sampled the non -Westinghouse discharges at their point of entry into the spray
pond.
These analyses of the Westinghouse outfall confirm that, consistent with results of
present and past sampling, Westinghouse's discharges conform to regulatory
requirements. Obviously, we are concerned that this situation may change over time, as
the new discharges over which we have no control continue into our pond. Although
these discharges may not present a problem now, at some point these may negatively
impact the water at outfall 001, which to this point has consistently tested to be well
within applicable standards. Westinghouse does not believe it should be responsible for
such a situation.
Westinghouse thus requests some reassurance from your office, which we understand has
issued permits for these new discharges, that we will not be prejudiced under our renewed
permit because of these sources, and the potential that these sources may contain
regulated pollutants which Westinghouse does not discharge. Westinghouse should not

be held responsible for, not should it be penalized, if, for example, additional testing or
monitoring is required because of these new discharges or if the new discharges cause
exceedance of Westinghouse's permit.
Please make note that Mr. George Dann is no longer the plant manager for the Charlotte
Plant. Mr. Anthony R. Giof xedi has now assumed the position of plant manager. Please
direct all future correspondence to either his attention, or to Mr. Robert Carpenter,
Facility contact.

The Permittee, Westinghouse Electric Corporation, has applied
for permit renewal. The subject NPDES Permit serves the Charlotte
Turbine/Generator Plant.
There are three discharges, all of which are non -contact
cooling water. Water is pumped from Lake Wylie and discharged
through the three discharges. All three discharge locations are
above the facilities water intake. All domestic and industrial
process wastewater is pumped to the CMUD collection system.
