On Tuesday, May 26, 2015, this office received a call from Ms. Sallie Gaillard of your company to
report there was an unauthorized discharge from the non -contact cooling water tank inside the grounds of your
gated facility on Friday, May 22, 2015. (Ms. Gaillard sent copies of the MSDS sheets to this office that
afternoon.)
Ms. Gaillard stated that 500-700 gallons of treated non -contact cooling water (containing cooling tower
treatment and biocide) had been released on Friday, May 22, 2015, onto the ground, and traveled 1,400 feet to a
UT to King's Creek. No one called to report this incident within the required 24-hour reporting period per your
permit NCG500130 nor were actions taken to contain this spill.
Violations: per G.S. 143-215.1 and permit # NCG500130:
• Discharge without a valid permit.
• Failure to report within 24 hours of a spill.
A Notice of Violation/ Notice of Intent to Enforce (NOV/ NOI) is being issued for the noted violation of
North Carolina General Statute (G.S.) 143-215.1 and NPDES Permit No. NCG500130. Pursuant to G.S. 143-
215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any

person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit
issued pursuant to G.S. 143-215.1. If you wish to provide additional information regarding the noted violation,
request technical assistance, or discuss overall compliance please respond in writing within ten (10) days after
receipt of this Notice. A review of your response will be considered along with any information provided on
the 5-Day Spill Reporting Form. You will then be notified of any civil penalties that may be assessed regarding
the violations. If no response is received in this Office within the 10-day period, a civil penalty assessment
may be prepared.
Remedial actions, if not already implemented, should be taken to correct any problems. The Division of
Water Resources may pursue enforcement actions for this and any additional violations. You may contact this
office for additional information.

This letter transmits notice of a civil penalty assessed against Selee Corporation in the amount of
$2,000 plus $159.26 in enforcement costs for a total of $2,159.26. The violation is summarized
in Attachment A to this letter per G.S. 143-215.1 and Permit # NCG500130.
This action was taken under the authority vested in me by delegation provided by the Secretary
of the Department of Environment and Natural Resources and the Director of the Division of
Water Resources. Any continuing violation(s) may be the subject of a new enforcement action,
including an additional penalty.
Within thirty days of receipt of this notice, you must do one of the following three items:
1. Submit payment of the penalty:
Payment should be made directly to the order of the Department of Environment and Natural
Resources (do not include waiver form). Payment of the penalty will not foreclose finther

2. Submit a written request for remission including a detailed justification for such
request:
Please be aware that a request for remission is limited to consideration of the five factors listed
below as they may relate to the reasonableness of the amount of the civil penalty assessed.
Requesting remission is not the proper procedure for contesting whether the violation(s) occurred
or the accuracy of any of the factual statements contained in the civil penalty assessment
document. Because a remission request forecloses the option of an administrative hearing, such a
request must be accompanied by a waiver of your right to an administrative hearing and a
stipulation and agreement that no factual or legal issues are in dispute. Please prepare a detailed
statement that establishes why you believe the civil penalty should be remitted, and submit it to
the Division of Water Resources at the address listed below. In determining whether a remission
request will be approved, the following factors shall be considered:
(1) Whether one or more of the civil penalty assessment factors in NCGS 143B-282.1(b)
were wrongfully applied to the detriment of the violator;
(2) Whether the violator promptly abated continuing environmental damage resulting from
the violation;
(3) Whether the violation was inadvertent or a result of an accident;
(4) Whether the violator has been assessed civil penalties for any previous violations; or
(5) Whether payment of the civil penalty will prevent payment for the remaining necessary
remedial actions.
Please note that all evidence presented in support of your request for remission must be
submitted in writing. The Director of the Division of Water Resources will review your evidence
and inform you of his decision in the matter of your remission request. The response will provide
details regarding the case status, directions for payment, and provision for further appeal of the
penalty to the Environmental Management Commission's Committee on Civil Penalty
Remissions (Committee). Please be advised that the Committee cannot consider information that
was not part of the original remission request considered by the Director. Therefore, it is very
important that you prepare a complete and thorough statement in support of your request for
remission.
In order to request remission, you must complete and submit the enclosed "Waiver of Right to an
Administrative Hearing and Stipulation of Facts" form within thirty (30) days of receipt of this
notice. The Division of Water Resources also request that you complete and submit the enclosed
"Justification for Remission Request." Both forms should be submitted to the following address:

If you wish to contest any statement in the attached assessment document, you must file a
petition for an administrative he You may obtain the petition from the Office of
Administrative Hearings. You must file the petition with Office of Administrative Hearings
within thirty (30) days of receipt of this notice. A petition is considered filed when it is received
in the Office of Administrative Hearings during normal office hours. The Office of
Administrative Hearings accepts filings Monday through Friday between the hours of 8:00 a.m.
and 5 :00 p.m., except for official state holidays. The original and one (1) copy of the petition
must be filed with the Office of Administrative Hearings. The petition may be faxed provided the

In accordance with your renewal application [received on January 25, 20071, the Division is renewing
Certificate of Coverage (CoC) NCG500130 to discharge under NCG500000. This CoC is issued pursuant to the
requirements of North Carolina General Statue 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection agency dated May 9, 1994 [or as subsequently amended].
If any parts, measurement frequencies or sampling requirements contained in this General Permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, the certificate of coverage shall be final and binding.
Please take notice that this Certificate of Coverage is not transferable except after notice to the
Division. The Division may require modification or revocation and reissuance of the certificate of coverage.
Contact the Asheville Regional Office prior to any sale or transfer of the permitted facility.
Regional Office staff will assist you in documenting the transfer of this CoC.
This permit does not affect the legal requirements to obtain other permits which may be required by

SELEE has 2 non -contact cooling water discharge outfalls to a UT to King Creek. The plant appears to be
well maintained, clean and operating properly. The Plant was not discharging, from either outfail, at the time
of the inspection. Plant records are In good condition with at least 3 years available. The inspectors
recommend that the Plant establish, by written policy, the Upstream, 2 Effluent and Downstream sampling
sites, this will be helpful during future inspections. The Inspectors do recommend that the Plant use a
Downstream site across Shephard Street from the Plant, that is safe and accessible.

THERE SHALL BE NO CHROMIUM, ZINC, OR COPPER ADDED TO THE COOLING WATER.
** The temperature of the effluent shall be such as not to cause an increase in the temperature of the receiving stream of more than 2.8*C and in
no case cause the ambient water temperature to exceed 29°C.
The permittee shall obtain authorization from the Division of Environmental Management prior to utilizing any biocide in the cooling water (See
Part III of this Permit).
The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units.
There shall be no discharge of floating solids or visible foam in other than trace amounts.
