Dear Ms. Karoly and Mr. McMillan:
This letter is in response to your letter dated October 25, 2007 which requested additional information for
the proposed Arbor Chase Subdivision. The following restates your questions/comments and is then
followed by our response.
Additional Information Requested
1. 145 linear feet of compensatory stream mitigation is required for this project.
Please provide a compensatory mitigation plan. The plan must conform to the
requirements of 1 SA NCAC 2H .0500 and must be appropriate to the type of impacts
proposed.
As you are aware, the NC Ecosystem Enhancement Program (EEP) has been denying mitigation requests in
certain River Basin Hydrologic Units, specifically Neuse O 1. The proposed Tree Farm Subdivision- Phase
III is within the Neuse O1 Basin, and therefore, the NC EEP has since denied the applicants request to
assume the stream mitigation responsibility. We are currently working with the EEP to locate an
acceptable form of mitigation to satisfy 15A NCAC 2H .0500. In the meantime, we respectfully request
that our project not be withdrawn from the NC DWQ 401 program while we work to come to a fair and
reasonable resolution for the mitigation concerns.
