Dear Mr. Sylvester,
This letter is in response to the permit major modification request received on April 1, 2024.
During the pre -review process, the Division noted that the following items were missing from the
submitted application package:
On March 27, 2024, the Division received a check in the amount of $395 for the proposed
major modification. Effective October 3, 2023, the major modification application fee for a
major Class A Residuals Distribution Program (i.e., greater than 3,000 dry tons) is $528.
Accordingly, the Division will return the $395 check (No. 009098). Please submit the
appropriate application fee in the amount of $528 made payable to the North Carolina
Department of Environmental Quality to my attention at: 1617 Mail Service Center, Raleigh,
NC 27699-1617.
Accordingly, the Division is returning your permit major modification request as incomplete
pursuant to 15A NCAC 02T .0107(b).
The success of the Non -Discharge Branch's permitting process depends upon the receipt of
complete and accurate applications and supporting documentation. Please amend the application package
to include omitted items noted above and resubmit with the appropriate permit processing fee. When
resubmitting, please submit the application electronically as a single PDF via the Non -Discharge
online portal.
Please be advised that construction and/or operation of the subject facilities without a valid
permit is a violation of G.S. 143-215.1, and may subject you to appropriate enforcement actions
pursuant to G.S. 143-215.6A.9 6B., and 6C. The Division may assess civil penalties of up to $25,000
per day per violation for failure to secure a valid permit.
