Hi George,
Thank you for providing photographs from after the rain events this past week (attached above). I have combined
everything into this email reply so that we can keep the restoration efforts for this impacted stream channel under one
email thread.
After review of the provided photographs, DWR has determined the stream restoration and clean-up of any
accumulated sediments must occur immediately, instead of waiting for the sewer line installation, to prevent further
degradation and sediment loss from occurring.
Please be aware that all restoration activities must occur "in the dry', meaning that a proper pump around system must
be kept in place while the impacted section of channel is restored to natural pattern, profile, and dimension. In addition,
all accumulated sediments that have coursed downstream of the impacted section should also be removed down to the
natural substrate and deposited in uplands away from surface waters. Any additional comments or requirements
requested by the USACE must also be complied with.
Please send photographs (via reply to this email) once restoration efforts are complete.

On January 8, 2024 a pre -construction meeting was held between representatives for construction of the Vinfast
Manufacturing Site, NCDOT Road Improvements, Sanford Utility Improvements, and staff from NCDWR and the US Army
Corps of Engineers as required by USACE 404 permit SAW-XXXXXXX and 401 Individual Water Quality Certification
#20221576.
During the preconstruction meeting NCDWR staff conducted a location specific pre -construction discussion at Sta 4+00
within the Phase 1 Gravity Sewer Line as required by Condition #8 of the 401 Individual Water Quality Certification
issued on December 1, 2023. Staff made the following observations:
1. Clearing activities had occurred for the Phase 1 sewer line from the East Lift Station to Sta 6+00. This area
includes Impact S-05 / S-85 at approximately Sta 3+00
2. Erosion Control Measures (wattles) had been installed within the stream channel at this location. Staff observed
that high flow activity was circumventing the wattles.
3. Evidence of equipment crossing through the channel was observed.
4. Vehicular activity across the upper portion of the stream had caused the stream to lose pattern form.
These activities are not in compliance with the conditions of the 401. Instream erosion control measures may not create
instability within streams or otherwise cause water quality violations. Equipment crossings are to be conducted in a
manner that protects stream pattern, profile and dimensions.
DWR staff discussed that the area should be re-evaluated after storms expected on Jan 9. As of today, DWR has not
received these photos. Please send photos to DWR by Tuesday, Jan 16t". Upon review of the photos, DWR will
determine whether the stream must be restored immediately or upon completion of the sewer line installation.
In addition, it is essential that staff working on the project are aware of all permit conditions and expectations on
protection of streams and wetlands during utility line construction.
