ORDER AMENDING LICENSE
(Issued May 30, 2013)
1. On December 3, 2012, Alcoa Power Generating Inc. (licensee and transferor), and
Brookfield Smoky Mountain Hydropower LLC (transferee), for the Tapoco Hydroelectric
Project, FERC Project No. 2169, requested that the project name be changed to
"Brookfield Smoky Mountain Hydro Project". The project is located on the Little
Tennessee and Cheoah Rivers in Graham and Swain counties in North Carolina, and
Blount and Monroe counties in Tennessee.
The Director orders:
(A) The license issued January 25, 2005 for P-2169, is amended, as of the date
of issuance of this order, to delete references to "Tapoco Hydroelectric Project" and
substitute in place thereof "Brookfield Smoky Mountain Hydro Project".
(B) This order constitutes final agency action. Any party may file a request for
rehearing of this order within 30 days from the date of its issuance, as provided in
section 313(a) of the FPA, 16 U.S.C. § 8251 (2006), and the Commission's regulations
18 C.F.R. § 385.713 (2012). The filing of a request for rehearing does not operate as a
stay of the effective date of this order, or of any other date specified in this order. The
licensee's failure to file a request for rehearing shall constitute acceptance of this order.

Alcoa Power Generating Inc. - Santeetlah and Chcoah Powerhouses
To Whom It May Concern:
Alcoa Power Generating Inc. ("APGI") has agreed to sell its Tapoco operations, including the
above -referenced powerhouses. to BAIT U.S. Renewable Power Holdings, LLC ("BAIF"), an
affiliate of Brookfield Renewable Energy Partners. As of now, the sale is scheduled to close on
or around September 30, 2012 (the "Closing Date"). We will keep DWQ apprised if there are
any changes to that Closing Date.
As part of the sale, the parties are submitting completed "Permit Name/Ownership Change
Forms" seeking to have APGI's Certificates of Coverage NCG500049 and NCG500050 under
General Permit No. NCG500000 ("Permit") be transferred to BAIF, efTective on the Closing
Date. In support of this request, please be advised that APGI will continue to be responsible for
Permit compliance up to the Closing Date, and BAIF will be responsible for Permit compliance
thereafter.

The alternatives to discharge analysis should include boring logs and/or other information indicating
a subsurface system is neither feasible nor practical as well as written confirmation indicating that
connection to a POTW is not an option. It should also include a present value of costs analysis as
outlined in the Division's "Guidance For the Evaluation of Wastewater Disposal Alternatives".

For new or proposed discharges, the following information must be included in triplicate with this

cooled systems. After completion of construction (est. 2013), Units 1-4 will operate as water-cooled
systems.
The Cheoah facility discharges oil -heat exchanger cooling water from Generator Nos. 1-5 into sumps.
Non -contact cooling water from the generator turbine heat exchangers (Units 1-5) are directly
discharged to the lake.
Generator No. 5 transfer cooling waters are collected in a sump. The sump pump is operated on an
automatic level control system. Treatment prior to discharge consists of oil and grease removal by
floatation and skimming. The non -contact cooling water from the transformers and the generator
turbine heat exchangers requires no treatment before it is discharged directly to the river.
Stormwater and reservoir water seepage into the Powerhouse is directed to a sump located in the
Powerhouse Basement. Treatment prior to discharge consists of oil and grease removal by floatation
and skimming.
All drains within the Cheoah Facility (with the exception of the Oil Room) are routed to a 3,560 gallon
sump located in the basement of the Powerhouse. A transfer pump removes storm water that collects in
the sump to the river. An automatic level control system operates the pump. Any floating oils collected
in the sump are removed by skimming and placed in a drum.
Transformer banks Nos. 1-4 and associated equipment will drain to a tank with an oil water separator
prior to discharge. Discharge from the tank/OWS will be to the Cheoah River.
Transformer bank No. 5, OCB and Station Service Transformers Nos. 5 are diked. The dikes are equipped
with drainage systems that are normally closed. Prior to discharging any rain water, a visual inspection
for oil is performed.

The reason for this inspection was to observe the internal cleaning of the drains in Cheoah Dam. The last
cleaning occurred in 2005 and the objective was to clean silt and calcium build up from within the dam. The
material in the drains was pumped into a vac truck and the clear water was then decanted and run through
sand filters before being discharged. Both upstream and downstream pH was monitored during the
cleaning; there was no significant change in pH between the two monitoring points. The powerhouse was
not inspected during this visit.
No violations of permit requirements or applicable regulations were observed during this inspection.

Enclosed is the completed Modification Application for General Pen -nit coverage in the
NPDES program for the Cheoah Powerhouse. This application is being submitted as part
of the Cheoah Modernization Project scheduled to begin in late 2010 early 2011. For
process water outfalls 001 — 005 the only change is an increase in the amount of cooling
water used during generation. Please note that the source of process cooling waters is
Cheoah lake. Transformer cooling water discharged through outfalls 006 and 007 will be
eliminated as part of the Modernization project as air cooled transformers will be
installed, outfall 007 will become a stormwater only outfall. As per instructions received
from the Asheville Regional Office, stormwater only outfalls are not included in this
permit except for outfall 006. Outfall 006 collects stormwater from the transformer deck
and per the attached drawings will be rerouted to discharge into the Cheoah River
through an oil water separator. Currently this outfall discharges process water into the

Certificate of Coverage (CoC) NCG500049 to discharge under NCG500000. This CoC is issued pursuant to the
requirements of North Carolina General Statue 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection agency dated May 9, 1994 [or as subsequently amended].
If any parts, measurement frequencies or sampling requirements contained in this General Permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, the certificate of coverage shall be final and binding.
Please take notice that this Certificate of Coverage is not transferable except after notice to the
Division. The Division may require modification or revocation and reissuance of the certificate of coverage.
Contact the Asheville Regional Office prior to any sale or transfer of the Permitted facility.
Regional Office staff will assist you in documenting the transfer of this CoC.
This permit does not affect the legal requirements to obtain other permits which may be required by
the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

All drains within the Cheoah Facility (with the exception of the Oil Room) are routed to a
3560 gallon sump located in the basement of the Powerhouse. A transfer pump removes storm
water that collects in the sump to the river through Outfall 006. An automatic level control system
operates the pump. Any floating oils collected in the sump are removed by an oil skimmer and
placed in a drum for disposal.

i.) Noncontact cooling water discharges only occurs when generators are
running. Storm water discharges occur during rain events and Transformer
cooling water is discharged continuously.
b.) Generator cooling water discharge depends on Power Generation Schedule.
Transformer cooling water is continuous so there is a discharge 7 days a week.

Site map. If the discharge is not directly to a stream, the pathway to the receiving stream must
be clearly indicated. This includes tracing the pathway of a storm. sewer to its discharge point.
Authorization for representatives. If this application will be submitted by a consulting
engineer (or engineering firm), include documentation from the Permittee showing that the
consultant submitting the application has been designated an Authorized Representative of the
applicant.

Article 21 or regulations of the Environmental Management Commission implementing that Article, shall be guilty of a misdemeanor punishable by
a fine not to exceed $25,000, or by imprisonment not to exceed six months, or by both. (18 U.S.C. Section 1001 provides a punishment by a fine

Tapoco, Inc.
is hereby authorized to discharge
cooling water and other waters associated with hydroelectric operations
from a facility located at
Cheoah Powerhouse
U.S. Highway 129
Tapoco
Graham County
to receiving waters designated as subbasin 40402 in the Little Tennessee River Basin
in accordance with the effluent limitations, monitoring requirements, and other conditions set forth
in Parts I, II, III and IV of General Permit No. NCG500000 as attached.
This certificate of coverage shall become effective August 1,1997.
This certificate of coverage shall remain in effect for the duration of the General Permit.

in accordance with your application for discharge permit received on May 12, 1992, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state -
NPDES general permit. Issuance of this certificate of coverage supersedes the individual NPDES
permit No. NC0078565. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the
US Environmental Protection agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and
binding.
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Environmental Management. The Divsion of Environmental Management may require
modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Environmental Management or permits required by the Division of
Land Resources, Coastal Area Management Act or any other Federal or Local governmental
permit that may be required.

In accordance with your application for discharge permit received on May 12, 1992, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state -
NPDES general permit. Issuance of this certificate of coverage supercedes the individual NPDES
permit No. NC0078565. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the
US Environmental Protection agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and
binding.
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Environmental Management. The Divsion of Environmental Management may require
modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Environmental Management or permits required by the Division of
Land Resources, Coastal Area Management Act or any other Federal or Local governmental
permit that may be required.
