Sorry for the delay in my response.... Yes, I think the design provided should work. Do you think that the dissipator
would occupy the approximate area of the approved rock (as permitted)? I see that the detail does indicate that the
dissipator size is dictated by the channel width, so hopefully the proposed dissipator would fit into the area approved for
rock. Now I know that reality is complicated and messy, but what I am looking for is something that is a close fit and not
something that would result in a larger footprint in the waters.
So, the bottom line is, if it is a close fit to what was approved, then please proceed. If not and/or there is concern, let
me know. Thanks.

Please see the attached markup plan sheet. We plan to construct it by this detail utilizing Class 2 rip rap mixed
with the native material we excavate from the scour hole. The apron elevation will be +/- 9" above the pipe flowline
and constructed with some of the larger Class 2 so it doesn't blow out. If you have any other directions or
preferences with the construction, please advise. We are waiting on your ok to proceed.

Thanks for the photographs, they were helpful. The project plans don't capture the downstream rock "falls" and that is
important for the discussion of connectivity. I would agree that this culvert provides a hydrologic connection for what is
shown on the project plans as wetlands on the south side of the railroad and its function is to equalize surface water
flow from the wetland area to the tributary below the culvert.
As for what to do with the outlet of your culvert, I would say that installation of a dropbox/outlet would likely be
considered additional impacts, require a permit/modification, and will place more of the stream into a structure. As an
alternative, you indicated that NCDOT could create a rock dissipator/plunge pool below this culvert. NCDOT is
authorized to place rock at the outlet of this structure (approx. 10 If) to protect the banks. If a rock energy
dissipator/rock/native material -rock can be placed within this location, into the stream bed within the existing scour
area to prevent further erosion/sedimentation (not just rock dumped into the scour up to Ordinary High -Water Mark), I
believe that would not constitute a loss of waters and would be a minor alteration and would not require permit

Steve and Ryan,
On R-5768-permit site 2 we have a perched pipe. (See attached pictures). It is a 42" pipe that should have been
buried 20% but it was laid at grade, which was an oversight. However, even if the pipe had been buried at the 20%
requirement, it would have perched. The pipe is currently 1' above the water, and the plunge pool is about 1' deep.
The area has scoured 2' since installation and the 20% burial would have been around 9". If the pipe had been
installed correctly, we would have at least 15" of scour. We can correct the perch using an energy dissipator or we
can drop the pipe with a junction box and pipe extension. If anything is recommended, we would like to combine
rip rap with native material, hoping to be able to proceed without a permit modification? I'm suggesting native
material because we are hoping to keep the impact from being deemed a `loss of water'. We will do whatever you
recommend. Although, after reading through the Regional General Permit 50 Special Conditions, specifically (5) it
states:
Culverts/pipes placed across wetland fills purely for the purposes of equalizing surface water do not
have to be buried but must be of adequate size and/or number to ensure unrestricted transmission of water.
The pipe is solely for equalizing surface water because the flow is wetland4pipe4stream. Aquatic passage in the
pipe system should not be a concern either. And, as you can see from the attached pictures, there are a lot of
sheer rock drop-offs, most of which are beyond our construction limits. We would like to consider this pipe purely
for the purpose of equalizing surface water and hope you would agree.
