1992 Staff Report indicated that a suit was filed due to proximity of discharge gto nearby dwelling.... whatever
happened?
Response: The case was BICKFORD V. BUNCOMBE COUNTY BOARD OF EDUCATION and was settled out of
court on February 8, 1993 (terms of settlement unknown). The suit was based on damage to residential property
across road from WWTP which was constructed 122.8 ft from dwelling (.0200 WQ Regs require minimum separation
of too ft). Noise and TV reception problems caused by WWTP operation upset owner. School Board tried to satisfy
owner by providing visual barrier and muffling noise from blowers. Problems reported still noticeable in quiet of night.
Home owner moved to Wyoming prior to 1993. Thanks for the opportunity to comment.
