Accordingly, we are forwarding the attached NPDES discharge permit. this permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the a Memorandum_ of Agreement between North Carolina and the U.S Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). 2008: This final permit includes two major changes from the draft permit send to you on April 9, 1) A Total Monthly Flow (TMF) calculation and A. (2) Section are no longer necessary. The TMF value and A. (2) Section were needed to calculate the TN Load which is no longer required. 2) A TN Load calculation, Monthly and Annually, has been removed from this permit. The Division has determined that the TN Load impact from this facility does not warrant further evaluation at this time. As nutrient conditions or other factors change in the Neuse River Basin the Division will re-evaluate this permit requirements. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. Current Date: April 2, 2008 Prepared by: Ron Berry Previous Renewal Permit Effective Issue Date: November 1, 2003 Existing Permit Expiration Date: April 30, 2008 Renewal Permit Expiration Date: April 30, 2013 Discharge: UT to Middle Creek Basin: Neuse Classification: C, NSW General: Upon review the initial renewal application was returned 12/27/07 with a letter (return #2272) to the owner's consultant requesting submittal of the correct form and the required flow schematic. The consultant was also contacted by phone to make him aware of the return plus answer any questions. A follow up letter was also send to Aqua 1/2/08 alerting the owner of the status of the renewal. On 1/16/08 the correct application with all the requested information and copies was received and accepted. In 2007 ownership name change occurred, Aqua North Carolina, Inc. Tablet dechlorination system was added via AtC in March 2005. Facility is Class H, SIC 4941 with an average monthly permitted flow of 0.002 MGD. Will apply Greensand filter water plant treatment strategy.. Effluent Limited criteria are: - Flow, monthly average max, monitor to determine TN Load - TSS, daily max, monthly average max - Iron, monitor only - TN, calculate allocated N lbs - (NO2-N + NO3-N), monitor to determine TN - TKN, monitor to determine TN - TN Load, monitor only - TP, monitor only Water Quality Limited criteria is: pH, daily range limit. TRC, daily max. The 2008 renewal application included a copy of the Sludge Management Plan. Process: Well water is treated with sodium hypochlorite solution and sodium hyroxide prior to entering two parallel sand filters. As the filtered drinking water exits the sand filters it receives an additional chemical treatment with sodium phosphate. To regenerate the sand filters the same chemically treated well water is used to backwash and rinse the filters. This intermittent filter wastewater is passed through a tablet dechlorinator and then a sand bed filter before being finally discharged to the permitted outfall. Accumulated solids in the sand bed are removed by a contractor routinely. Discharge is into a UT to Middle Creek. Page 1 of 1 Multiple reporting violations. Concerns: Flow effluent monitoring/reporting, currently estimated. Based on data evaluation of DMR data the permitted flow should be set at 0.0025 MGD monthly average. TSS monitoring with Effluent Daily and Monthly Average Limits. Sample is grab. Will increase frequency to 2/month. DMR data review indicates no violations, daily value typically less than 5 mg/L. Settleable Solids monitoring with Effluent Limits, currently in active permit. Will remove to comply with strategy. No issues in DMR data. Turbidity monitoring with limits upstream and downstream, currently in active permit. Will remove to comply with strategy. No data, discharge is to zero flow stream. Iron monitoring only. Edit permit, owner name to reflect Aqua, update description in supplement. 5. Edit TRC existing footnote to show only definition for chlorine additive. 6. Increase TRC frequency to 2/month. 7. Increase Iron frequency to monthly. Rational For Changes: Per water treatment plant strategy monitored only measurement frequency is monthly and limited measurement frequency is 2/month. Therefore, TSS, TRC, Iron, and pH are set. For TN, Nitrite/Nitrate, TKN, and TP the previous permit semi-annual measurement frequency is deemed sufficient. TRC footnotes need to clearly define the additives. The limit is enforced and no longer requires compliance time line. There is no fluoride, zinc, or manganese chemical additives used in this facility. Bryant, Piedmont Region Coordinator Habitat Conservation Program DATE: 5 May 2008 SUBJECT: Proposed Permit Renewal for Aqua North Carolina, Inc, Oak Hollow WTP, Wake County, NPDES Permit No. NC0073679 Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject document. Our comments are provided in accordance with provisions of the Clean Water Act of 1977 (as amended), Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d), North Carolina General Statutes (G.S. 113-131 et seq.), and North Carolina Administrative Code 15A NCAC 10I.0102. Aqua North Carolina, Inc. has applied for a renewal of its NPDES permit to discharge filter wastewater into an unnamed tributary to Middle Creek. The Public Notice indicates that total residual chlorine and pH are water quality limited. There are records for the federal and state endangered dwarf wedgemussel (Alasmidonta heterodon); the federal species of concern and state endangered Atlantic pigtoe (Fusconaia mason); the federal species of concern and state significantly rare pinewoods shiner (Lythrurus matutinus); the state threatened creeper (Strophitus undulatus), Eastern lampmussel (Lampsilis radiata), triangle floater (Alasmidonta undulata) and least brook lamprey (Lampetra aepyptera) in Middle Creek. Chlorine is acutely toxic to aquatic organisms and can form secondary compounds that are detrimental to aquatic life. We are especially concerned about impacts to dwarf wedgemussel and other listed species in Middle Creek. Valenti (2006) concluded the impact of long term exposure to low doses of chlorine may impact juvenile mussels and reduce the chance of them being recruited to the reproducing population. We offer the following recommendations to reduce impacts to aquatic resources. 1. Use a non -discharge option for filter backwash wastewater.
