Dear Mr. Joyner:
The Division has reviewed your letter of April 10, 2008, which states the subject facility is not producing
any wastewater discharge. You indicated that your town wishes to retain the permit in case future
discharges are necessary.
After considering the recommendations of the staff in the Asheville Regional Office, I have agreed to waive
the requirement to submit monthly DMRs for the subject facility, effective May 1, 2008. The DMRs up
through (and including) April 2008 should be submitted as usual.
Be advised that if and when any wastewater discharge resumes, the discharge must be monitored as per
the terms of the NPDES permit and other applicable rules or statutes. Please keep the Asheville Regional
Office apprised of any pertinent developments that arise regarding this facility, especially if the discharge
is re -activated.
While requirements for operator visitation, monitoring and reporting are being waived, your company is
still required to pay the Annual Administering and Compliance Monitoring Fee that is associated with this
and all NPDES permits.

Sorry, I did not read the subject line. MY fault. I don't understand why submitting a NO FLOW on a
DMR is a problem, but if it is the waiver to suspend the monitoring is OK. Is this the same as placing
the permit on the inactive list in that they still pay the annual fee and keep the permit just in case a
discharge is needed in the future? They need to decide if they want to place the permit on inactive or
request recession. Totally their decision. I think they should keep the permit in case a discharge is
necessary in the future.

Your second question is a good one for the Town. It depends on if they want to pay the annual
fee or go through the permitting process again.
I'll have Bob Guerra ask them about NC0087084.

This letter is a request to discontinue submitting DMR's monthly per our phone
conversation on the 9* of April, 2008. We have had approximately 6 years without a
discharge and have submitted the required paperwork to concur. Due to the construction
upgrades to our facility we have no intentions of discharging in the near future unless an
emergency situation occurs, and at that time will resume the required testing and
documentation. Please feel free to contact me with any questions.
