Dear Mr. Thomson:
Dee Freeman
Secretary
Division personnel have reviewed and approved your application for renewal of the'subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
Please note that the receiving stream is listed as an impaired waterbody on the North Carolina 303(d)
Impaired Waters List. Addressing impaired waters is a high priority with the Division, and instream data will
continue to be evaluated. If there is noncompliance with permitted effluent limits and stream impairment can be
attributed to your facility, then mitigative measures may be required.
Additional requirements not previously included in the draft permit were incorporated into the final
permit where warranted.
Summary of Changes in Final Permit from October 12, 2011 Draft Permit
1) Monthly monitoring of pH with a limit range of 6.0 S. U to 9.0 S. U was added. The complex nature of the
effluent required compliance with the pH surface water standard.
2) Monthly monitoring of conductivity was added. The complex nature of the effluent required conductivity
monitoring to evaluate effluent variation.
3) Quarterly monitoring of turbidity was added. The receiving stream is impaired for turbidity, monitoring
is required.

Footnotes:
1. Flow shall be monitored with each discharge event. During periods of no flow, the Permittee
shall submit a signed, monthly Discharge Monitoring Report (DMR) indicating "No
discharge." Flow may be monitored using any one of four methods:
a) Measure flow continuously
b) Calculate flow (see Rational Equation below) based on total rainfall
per unit area draining to the outfall; exclude built -upon areas (best
method for facilities with large runoff -collection ponds)
The Rational Equation: Q = KuCIA, where:
Q = flow (peak flow rate (cfs or m3/sec)
Ku = units conversation factor =1.008 for U.S. standard units
(usually ignored because it is. so close to 1),. or 0.278 for- SI
units
C = dimensionless runoff coefficient for the watershed, loosely
defined as the ratio of runoff to rainfall
I = intensity of rainfall taken from the intensity -duration -frequency
curves for the specified design return period at the time of
concentration, tc (in/h or mm/h). tc = time of concentration
(time after the beginning of rainfall excess when all portions of
the drainage basin are contributing simultaneously to flow at
the outlet)
Permit NCO074241
(Continued A.(1) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS Footnotes)
A = area of tributary watershed (acres or km)
The rational equation is used to calculate the runoff from a region, given:
i) the runoff coefficient which accounts for infiltration and other
potential losses in.the region
ii) the rainfall intensity to the region
iii) the time it takes for runoff to travel from the region's upper
reaches to its outlet
iv) the region's drainage area
c) Estimate flow at 20-minute intervals during the entire discharge event
d) Report flow based on discharge pump logs
e) Approved method by Division
2. Oil and grease samples shall be skimmed from the surface of a quiescent (calm water) zone.
3. • Acute Toxicity (Fathead Minnow), 24-hour P/F at 90%, annually. See Special Condition A.
(2.). Toxicity test sample shall be collected concurrently with samples for monitoring
requirements.
There shall be no discharge of floating solids or foam visible in other than trace amounts.
There shall be no direct discharge of tank solids, tank bottom water, or the rag layer.
There shall be no direct discharge of tank (or pipe) contents following hydrostatic testing unless benzene
concentration is less than 1.19 µg/L and toluene concentration is less than 11 µg/L.
A. (2) ACUTE TOXICITY MONITORING (ANNUAL)
The permittee shall conduct annual toxicity tests using protocols defined as definitive in E.P.A.
Document EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to
Freshwater and Marine Organisms." The monitoring shall be performed as a Fathead Minnow
(Pimephales promelas) 24 hour static test. Effluent samples for self -monitoring purposes must be
obtained below all waste treatment. The permittee will conduct one test annually, with the annual period
beginning in January of the calendar year of the effective date of the permit.
The annual toxicity test must be performed by June 30. Should there be no discharge of flow from the
facility during the six month period January 1-June 30, the permittee will complete the information
located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe
number, county and in the comments section indicate "No Flow for January 1-June 30, {calendar
yearb" The report must be signed and submitted to the Environmental Sciences Section at the address
noted below.
If no discharge event occurs from January 1-June 30, vet a discharge event occurs from July 1-
December 31, then the facility must perform toxicity monitoring and report the data as noted below.
Permit NCO074241 ,
(Continued A. (2) ACUTE TOXICITY MONITORING (ANNUAL))
The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit
condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was
performed, using the appropriate parameter code. Additionally, DWQ Form AT-1 (original) is to be sent
to the following address:
North Carolina Division of Water Quality
Environmental Sciences Section
1621 Mail Service Center
Raleigh, N.C. 27699-1621
Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-:
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following the
month of the initial monitoring.

BACKGROUND
Associated Asphalt Greensboro, LLC owns and operates a bulk liquid storage facility for liquid
asphalt, gasoline, and #2 fuel oil. The storage area and loading area stormwater, water softener
wastewater, and boiler blowdown and condensate are collected in a 1,000,000 gallon retention
pond. The outfall discharges into an unnamed tributary into the East Fork Deep River, a class
WS IV* stream, in the Cape Fear River Basin. The * classification designate this stream as part
of the Randleman Lake Critical Supply Watershed and requires rules 15A NCAC 2B .0248,.
.0249, .0250, and .0251 be applied. The receiving stream is impaired for fecal coliform and
turbidity.
There is no treatment process associated with the retention pond operation or other pond influent.
A manual valve is used to control the release from the pond to the permitted outfall. Based on an
established value setting with a defined flow rate and known discharge time, the total volume for
each discharge event is calculate and reported. The facility uses an internal SOP to manage pond
level and pond sampling.
The existing 1,000,000 gallon retention pond was expanded in 2006 from 400,000 gallons.
While expanding the pond, the pond's outfall piping configuration was revamped. Associated
Asphalt LLC took ownership in April 2004. Prior to 2004 there had been several ownership
changes. This facility had previously stored ammonium sulfate and aviation fuel.
A distillation operation was initially part of the original facility and was shut down prior to 2000.
The original facility included two designated outfalls. Earlier permits included limits and

monitoring as a result of the distillation process. A waste load allocation was performed in 1991.
The prior and existing permit conditions and limits were modified to reflect the 2005 SOP for
Bulk Storage Terminals and the Cape Fear Basin strategies for Deep River.
As part of the last renewal in 2006, the ethylbenzene and MTBE monitoring were reduced to
quarterly. Also, the EPA Method 623 monitoring requirement was removed.
COMPLIANCE
Since 2007 there were 13 monitoring frequency violations and one TSS limit violations. No fines
have been assessed to date.
PERMITTING STRATEGY
Reasonable Potential Analysis (RPA)
The Division conducted EPA -recommended analyses to determine the reasonable potential for
total phenols, based on DMR data from March 2009 to May 2011. Results suggest no reasonable
potential.
Data Review
DMRs were reviewed for the period of March 2009 to May 2011. Where DMR data showed
detection, it is summarized in Table I below:

Whole Effluent Toxicity
The permit requires annual acute toxicity testing using pimephales promelas, at 90% effluent
concentration. The facility passed the 4 toxicity tests conducted during the current permit cycle
began in 2007. Will continue annual acute toxicity testing.
Other Evaluations
The estimated portion of water softener wastewater in the discharge, on an event bases is less
than 5%, on a monthly average bases is less than 1%. There are other process wastewater streams
associated with this discharge. The 2005 Petroleum Bulk Storage Permitting Strategy will
continue to be applied. Monthly monitoring for conductivity and pH with a limit range of 6.0
S.0 to 9.0 S.0 will be added to better define the effluent characteristics and meet expected
surface water quality standards
The available methods stated in A.(1) footnote for calculating the reported discharge flow was
amended to include the method historically accepted by the Division for this facility.
Quarterly turbidity monitoring was added to collect data for future evaluation and address the
receiving stream impairment for turbidity. The Division statement about stream impairment was
included in both the draft and final permit cover letters.
SUMMARY OF PROPOSED CHANGES
In keeping with Division policies the following will be incorporated into the permit:
• Added monthly pH monitoring with limit range.
• Added monthly conductivity.
• Added quarterly turbidity monitoring.

Table 2.2: MonitednLrReauirements forlon Exchahze WTPs
The monitoring requirements included below identify various pollutants of concern including conventional parameters,
nutrients, and toxicants. A brief rationale for the inclusion of these contaminants can be found in Appendix A. Other toxicants
were not included because they were either not detected or rarely detected in the effluent data surveyed. However, if a pollutant
specific problem is detected in the receiving stream, effluent or source water then a mcautoring requirement may be added for
that parameter. Likewise, if data indicate that a pollutant is not present in the facility's discharge, that parameter may be
dropped from the requirements. Limits should be added if the facility shows reasonable potential to exceed water quality
standards for toxicants. New facilities should monitor for pollutants of concerns regardless of whether ornot there is a water
quality slamlarl. montoring nquirements can be re-evaluated during cubse uent renewals.

RE: Draft Renewal NPDES Permit NC0074241; Associated Asphalt Greensboro, LLC
Dear Mr. Berry:
We have reviewed the draft renewal of this permit for our facility located at 100 South
Chimney Rock Road, Greensboro, Guilford County, NC. We agree to abide by the
conditions and permit limits set forth in the draft.
Per our phone conversation confirming and updating information for this facility, we
discussed the boiler blow down. It is released to the storm water system on site,
collected in and eventually discharged from the retention pond with the rest of the
accumulated wastewater outlined in the 'Supplement To Permit Cover Sheet', item 1.
Does the boiler blow down need to be specifically mentioned as an authorized
discharge?
Should you have questions or need further information in order to finalize this permit,
please contact our Greensboro Terminal Manager, Mr. Scott Mathews or myself. His
phone is 336-294-0025.
Sin erely,
A.

Ron - The permit looks fine. Please note the following minor corrections; 1) the
fact sheet incorrectly
lists the street location as chimney Road instead of chimney Rock Road, and 2) the
topo map
incorrectly identifies W. Market street as Hwy Us 421. Hwy US 421 is the large road
just south of the
facility that runs somewhat parallel to W. Market.
will the attached scanned signature page suffice or do you need the original for the
file? Thanks,
Mike.
