Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are
forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agencv
dated %lay 9, 1994 (or as subsequently amended).
This final permit includes the following major changes from the draft permit sent to you on July 16, 2003:
> The monitoring frequencies for Total Nitrogen (TN), TN components and Total Phosphorus have been reduced to
semi-annually, based on the minimal flow (<5000 gallons/dap) from your facility.
• This reduction in sampling frequency makes it imperative that representative samples are collected. Collect the
TIN and TP samples on days when flow is monitored.
• Data from the semi-annual samples will be used to calculate the TN load for the facilim The Permitree should
maintain accurate estimates of the total discharge each month (total monthly flow, or' -Nln. The TJIF values
will be multiplied by the TN values for the semi-annual samples to calculate a TN load for the facility.
This permit includes a TRC limit that xvill take effect on May 1. 2005, If you wish to install dechlorinatiun equipment,
the Division has promulgated a simplified approval process for such projects. Guidance for approval of dcchiorination projects
is attached.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to You, You
have the right to an adjudicatun, hearing upon written request within thirty (30) days following receipt of this letter. This request
must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and Filed with the
Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is
made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division man require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other
permits which ntav be required by the Division of \Cater Quality or permits required by the Division of Land Resources, the
Coastal Area Management Act or any other Federal or Local governmental permit that may be required.

NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM
In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards
and regulations promulgated and adopted by the North Carolina Environmental Management
Commission, and the Federal Water Pollution Control Act, as amended,
Heater Utilities, Inc.
is hereby authorized to discharge wastewater from a facility located at the
Oak Hollow Subdivision WTP
Off NC Highway 42 near Mount Pleasant
Wake County
to receiving waters designated as an unnamed tributary to Middle Creek in the Neuse River Basin in
accordance with effluent limitations, monitoring requirements, and other conditions set forth in Parts I,
II, III and IV hereof.
The permit shall become effective November 1, 2003.
This permit and the authorization to discharge shall expire at midnight on April 30, 2008.

3. The discharge from this facility shall not cause turbidity in the receiving stream to exceed 50 NTU. If the
instream turbidity exceeds 50 NTU due to natural background conditions, the discharge cannot cause turbidity to
increase in the receiving stream.

A. (2) CALCULATION OF TOTAL NITROGEN LOADS
a. The Permittee shall calculate monthly and annual TN Loads as follows:
1. Monthly TN Load (pounds/month) = TN x TMF x 8.34
where:
TN = TN concentration (mg/L) of the sample collected during the semi-annual monitoring event. Use the
TN value for the month in which the sample was taken and successive months until another TN
sample is collected.
TMF = Total Monthly Flow of wastewater discharged during the month (MG/month). If all discharges are not
recorded at the facility, document the calculation(s) used to determine total monthly flow.
8.34 = conversion factor, from (mg/L x MG) to pounds
H. Annual TN Load (pounds/year) = Sum of the 12 Monthly (calculated) TN Loads
for the calendar year
b. The Permittee shall report the semi-annual Total Nitrogen results in the discharge
monitoring report (DMR) for that month. The calculated pounds of TN load per month
will be reported on each month's DMR. The Permittee shall report each year's annual
results (pounds per year) on the December DMR.

Charles:
Heater has 5 pending renewals of discharge permits for the backwash water form
canister type iron filters on community drinking water wells. These are very small
intermittent discharges which have little to no impact on the environment and when
time permits, we would like to investigate the possibility of covering these type
permits under a general permit. They are not at all like water treatment plant
discharge from a typical surface water treatment plant such as those operated by
cities.
Each of these permits requires a chlorine limit to be implemented within 18 months
which would require installation of chlorine removal equipment on each of these
systems. This seems extreme for these small intermittent discharges. Please consider
exempting these systems form the chlorine policy due to the insignificance of the
discharge.
The five permits that Heater has pending are as follows along with my comments:
(1) Waterfall Plantation - Permit NCO085863
This draft permit issued on 7/16/03 requires monthly monitoring for
everything but TSS which is 2/month and residual chlorine which is required weekly.
All of the other draft permits (except Nottingham Forest as discussed below) and
existing permits generally require quarterly monitoring for everything including
residual chlorine. The Waterfall Plantation draft also includes a monitoring
requirement for Aluminum which seems inappropriate since this is not a surface water
treatment plant and would not have any aluminum.
Please consider changing the monitoring frequency for Waterfall Plantation
to quarterly for all parameters, eliminating the Aluminum monitoring requirement,
and eliminating the chlorine limit as discussed above.
(2) Nottingham Forest - Permit NCO055701
This draft permit issued on 7/23/03 requires quarterly monitoring on
everything except TSS and Iron which are required monthly.
Please consider changing the monitoring frequency for TSS and Iron to
quarterly and eliminating the chlorine limit as discussed above.
(3) Oak Hollow - Permit NCO073679
This draft permit issued on 7/23/03 requires quarterly monitoring on all
parameters which Heater believes is appropriate for this type facility. Please
consider eliminating the chlorine limit as discussed above. /Vo

The above -referenced facility involves the backwash from iron and
manganese filters on a community well located in Oak Hollow subdivision. The
iron and manganese residue in the backwash water is captured on a sand filter.
There is no sludge production. The iron and manganese residue is periodically
raked from the top of the sand filter and disposed of in a landfill.
Heater Utilities (Heater), at this and other similar facilities is
required to perform quarterly monitoring on most parameters. Heater requests
renewal of this permit with a continued quarterly monitoring frequency.

Commission implementing that Article, or who falsifies, tampers with, or knowingly renders inaccurate any recording or monitoring device or method
required to be operated or maintained under Article 21 or regulations of the Environmental Management Commission implementing that Article, shall be
guilty of a misdemeanor punishable by a fine not to exceed $10,000, or by imprisonment not to exceed six months, or by both.
