Director Certified Mail#7021-0950-0001-9372 Return Receipt Requested Mr. Stan Bowles, Jr. 607 Curtis Road Road Warsaw, NC 28398 Subject: Notice of Violation Bowles and Son Farm #1 ADS310023 Duplin County NOV-2024-PC-0236 Dear Mr. Bowles, NORTH CAROLINA Environmental Quality April 10, 2024 On March 8, 2024, staff of the NC Division of Water Resources (DWR), Water Quality Regional Operations Section (WQROS), inspected your facility in response to a public complaint received on March 7th. As a result of the findings of that inspection, you are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste management system pursuant to 15A NCAC 2T .1300, you have been found to be in violation of your Certified Animal Waste Management Plan (CAWMP) and the Swine Waste System General Permit No. AWG100000 as follows: Violation 1: Failure to prevent excessive ponding of waste in accordance with Condition II.5. of the Swine Waste System General Permit No. AWG100000. "In no case shall land application result in excessive ponding or any runoff during any given application event. — [15A NCAC 02T .1304(b)]" A large ponded area was observed within the irrigation field directly south of Goshen Swamp. Samples of the liquid were taken by DWR and the results were indicative of ponded waste. Required Corrective Action for Violation 1: The irrigation field topography appears to cause ponding within the field. Take all necessary steps to ensure excessive ponding does not occur any longer including the possible installation of gates/valves at each drainage pipe location. This is in violation of Condition II.1. of the Swine Waste System General Permit No. AWG100000. "The collection, treatment, and storage facilities, and the land application equipment and fields shall be properly operated and maintained at all times. — [I 5A NCAC 02T .1304(b)]" Required corrective action for Violation 2: The irrigation field topography appears to cause ponding within the field. Take all necessary steps to ensure excessive ponding does not occur any longer including the possible installation of gates/valves at each drainage pipe location. Please provide a written plan to our office within 30 days after receipt of this Notice, which includes a description of the corrective action(s) you will take or have taken to resolve these issues and to prevent them from occurring again. Please include in your response a schedule for completion of any corrective actions not yet addressed. You may wish to contact your County Soil & Water Conservation District Office, County Extension office, a qualified technical specialist, and/or a professional engineer for any assistance they may be able to provide you in order to prevent violations from occurring. Failure to comply with conditions in the permit may result in a recommendation of enforcement action, to the Director of the Division of Water Resources who may issue a civil penalty assessment of not more than twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A If you have any questions concerning this Notice, please contact Chad Coburn at (910) 796-7379 or at Chad.
