Thank you for reaching out in regards to the permit application for the Jack Smith Creek Drainage Basin. We
are following the NCDWR Guidelines for Hurricane / Tornado Cleanup in Riparian Buffers dated August 5, 2020
and a conversation with Robert Tankard on November 1, 2023. It is our understanding that the removal of
dangerous, dead and damaged trees is an exempt activity, applicable to several sites.
I have commented on your questions below in blue.
• The site plans appear to not include a final revegetation plan for impacts. It appears that some of the
temporary road access points will lay over trees and vegetation in the buffered areas. DWR is concerned about
the removal of those trees in the buffered areas. Please provide a revegetation plan.
Within the "General Construction and Geotechnical Notes" section on page 2 of the Repair Plans is a
section titled PERMANENT SEEDING SCHEDULE FOR AREAS OTHER THAN CHANNELS, describing the
general sequence and herb species to be used for revegetating areas impacted by construction,
however, this does not include tree species.
On sheet C4.2 of the Repair Plans, ESC Details notes that revegetation will occur after removal of the
temporary access road: When the contributing drainage area has been stabilized, fill depression, and
establish final grading elevation, compact area properly, and stabilize with ground cover.
Specific site comments:
■ Site 1-16A
• This site has no existing trees. The Site is a residential lawn and will be revegetated
immediately after construction.
■ Site 1-16B
This site has no existing trees. The Site is a residential lawn and will be revegetated
immediately after construction.

• A majority of the access road for this site occurs on an existing residential driveway
and while the entire access road is >2500 square feet, this site is a maintained yard
and includes a few individual trees. Permanent impacts to the buffer fall well short
of 2500 square feet. Minimal impacts from access will occur within the vegetated
area of the buffer and one tree at the upper end of the project area (a 16" sweetgum)
may be removed in order to perform the proposed outlet protection
replacement. However, after speaking with the project engineer, there is potentially
ample space for construction equipment to maneuver and it is anticipated that this
tree will be avoided. Project plans state all mature trees will be avoided at the best
necessary. However, in the case that it cannot be avoided, any general guidance on
the size, species, and planting density requirements for the replacement of trees (in
this case, tree) in the buffer would be appreciated, and we will update the impact
drawing for this site appropriately.
■ Site1-20
• The only impact to trees as part of this work is the removal of two uprooted and
dead trees from Hurricane Florence. We do not propose to remove any healthy trees
within Zone 1. The Site will be revegetated immediately after construction.
■ Site 1-42B
• No trees present at this location. The Site will be revegetated immediately after
construction.
■ Site 1-43B
• The only impact to trees as part of this work is the removal of undermined and
uprooted trees damaged by Hurricane Florence. We do not propose to remove any
healthy trees within Zone 1. The Site will be revegetated immediately after
construction.
• DWR appreciates being provided most of the stream and wetland forms for the impact areas. For
documentation in our permanent records, could you provide the stream forms for JSC-NWW-10i, JSC-NWW-3p,
JSC-NWW-19i, and JSC-NWW-8i?
