Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant
to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
This final permit includes the following changes from the draft permit sent to you on January 6, 2010
(misdated as January 6, 2009).
• The facility description has been changed to more accurately reflect the wastewater treatment system
as it exists on site. Communications between this office, the Mooresville Regional Office and you
have determined that the condition of the smaller package plant at the site of the Diamond Head
WWTP is such that it no longer exists as a viable wastewater treatment system. Therefore, its
components have been removed from the facility description.
• A term has been added to the Supplement page requiring the permittee to obtain an Authorization to
Construct permit from the Division of Water Quality prior to any expansion of the existing
wastewater treatment facility. The permit retains an ultimate hydraulic capacity and flow discharge
limit of 0.1 MGD.
• New limits pages have been established with flow limits of 0.0731 MGD for the existing treatment
system and 0.1 MGD for an expanded facility (should it be built).

If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Centers Raleigh, North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or
Local governmental permit that may be required.

I, II, III and IV hereof.
This permit shall become effective April 1, 2010.
This permit and authorization to discharge shall expire at midnight on March 31, 2015.

components to upgrade the wastewater treatment system to a total hydraulic capacity of 0.100
MGD (see Part I. A. (2.)).
3. Discharge from said treatment works at the location specified on the attached map into Lake
Norman (Reeds Creek Arm), classified WS-IV & B CA waters in the Catawba River Basin.

A. (3.) TOXICITY REOPENER CONDITION
In the event that toxicity testing or other studies (conducted on the effluent or receiving stream)
indicate that detrimental effects may be expected as a result of this discharge, the Division may modify
or revoke and reissue this permit with toxicity limits and monitoring requirements.
A. (4.) SPECIAL CONDITION-- Operations 1
Pursuant to the terms of the Settlement Agreement established between Heater Utilities, Inc. and the
Division of Water Quality, signed on June 26, 2006, Aqua North Carolina, Inc. shall:
(a) Continue to operate a turbidimeter-at the plant to measure turbidity in the plant effluent, and set
the turbidimeter to notify the plant operator automatically in the event that the turbidimeter
records a reading of 10 nephelometric turbidity units or greater;
(b) Inspect the performance of the plant's disinfection system every weekday and maintain a log of
such inspections; and
(c) Operate a Supervisory Control and Data Acquisition (SCADA) system at the plant.
A. (5.) SPECIAL CONDITION — Spill Notification
(a) Contacting Public Health Directors
The facility must notify the Iredell and Mecklenburg County Public Health Directors within 12 hours
of first knowledge by the owner/operator of any discharge of untreated wastewater to waters of the
State or a discharge from the wastewater treatment plant that has not received adequate disinfection
due to a malfunctioning treatment unit.

The facility must notify the public of untreated wastewater spills. Wastewater facility owners or
operators must issue a press release after a discharge to surface waters of 1,000 gallons within 48 hours
of first knowledge of the spill by the owner/operator. The press release must be issued to "all electronic
and print news media outlets that provide general coverage in the county where the discharge
occurred." A copy of the press release must be maintained for one year by the owner/operator. This
press release is required in addition to the permit requirement of contacting the North Carolina
Division of Water Quality (DWQ).

A. (5.) SPECIAL CONDITION — Spill Notification, continued
If a discharge of 15,000 gallons or more reaches surface water, a public notice is required in addition to
the press release. The public notice must be placed in a newspaper having general circulation in the
County in which the discharge occurred and the county immediately downstream. At a minimum the
notice should'be published in a newspaper of'general circulation in Iredell and Mecklenburg Countieg.
If a discharge of 1,000,000 gallons of wastewater or more reaches surface waters, the DWQ regional
office must be contacted to determine in what additional counties, if any, a public notice must be
published. A copy of these public notices and proof of publication must be sent to the DWQ within 30
days of publication. The copy should be sent to the following address:

The minimum content of the notice is the location of the discharge, estimated volume; water body
affected and steps taken to prevent future discharges.

Significant changes were made to the final permit relative to the draft and previous versions of
the NPDES permit.
The system has existed for many years as two package plants (0.0731 MGD & 0.033 MGD)
working in tandem, with shared disinfection, dechlorination and discharge. At the time of the
previous permit renewal (2005/2006) the smaller of the two was described as being shut down
for repairs. This was not seen as a problem since flows to the treatment facility did not approach
the capacity of the larger package plant alone.
Samar Bou-Ghazale of MMO performed the site inspection and prepared the staff report for the
facility's permit renewal. The permit writer didn't recognize the implication of Samar's write-up
of the facility description. The smaller package plant has not been operated for the past 5 years.
Some of its component parts have been removed to be used in other WWTPs. It is a shell of
what it formerly was and no longer can be deemed a WWTP. Its condition is well beyond that of
a "mothballed" plant. Its operation would require reconstruction as opposed to repair. Aqua NC
representatives confirmed this assessment of the situation.
Therefore, reference to the smaller package plant has been removed from the permit. A new
limit page has been prepared that has all the same constituent limits as were found in the
previous permit (because they were established per BPJ because the discharge is into an arm of
Lake Norman), but the flow limit has been set at the design capacity of the existing treatment
system. The permit provides for the facility to expand to the ultimate capacity of 0.1 MGD, but
an AtoC permit will be required before expansion could occur. A second limits page has been
prepared for an expanded facility, with only the flow limit changed.

It will be a good idea. I was thinking to do the same. Also, I looked at the DMR to see the maximum discharge from the
facility and found out that the maximum discharge for the past two years was at half the permitted discharge. However,
in order to play it right we need to go exactly by your suggestion.

I'll make the fixes to the permits as you have directed. I'm sorry I missed them the first time around. Regarding
Diamond Head, since the smaller of the two treatment systems is not in use (and it appears its been out of service for a
while), should they be given some form of tiered limits that allows flow only to the capacity of the working system until
they bring the other one on-line? Just a thought ...

reflect the changes mentioned in the Staff Report. There are major changes that needs to be noted.

power generator (if it is not too much trouble)?.

enters Lake Norman in the Reeds Creek area adjacent to the SR 1109 bridge. There
are no other known dischargers in the immediate area. The lake receives
considerable bodily contact as a result of primary recreational activities.
PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS

the two WWTPs have a total hydraulic capacity of 0.106 MGD.

previous two years: There have been no ATCs issued in the past two years
e. Description*of existing or substantially constructed WWT facilities: The existing
WWT facilities consist of two separate treatment facilities with one having a 0.033
MGD capacity (which is off line at this time) and the other having a 0.0731 MGD
capacity. The 0.0731 MGD WWTP that is in use consists of the following
components: an influent bar screen followed by a V-notch weir, flow equalization
tank, aeration basin, dual clarifiers, an aerated sludge holding tank, and a
multi -media tertiary filter, a chlorine contact tank with tablet disinfection,
de -chlorination, post aeration, a sonic flow meter, an effluent pump station and
stand-by power.
f. Description of proposed WWT facilities: There are no proposed facilities at this
time.
g. Possible toxic impacts to surface waters: Chlorine is added to the waste stream,
however, dechlorination is provided.

by disposal into the City of Newton WWTP via Robert's Septic Tank Service.

The.permittee, Aqua North Carolina, is applying for renewal of its NPDES permit to
discharge treated wastewater from the wastewater treatment system serving approximately 201
homes as well as a shopping center, office building and fast food restaurants. The wastewater
treatment plant appeared to be in good operational condition during the time of the investigation.
Pending review and approval by the Western NPDES Program Unit, it is recommended
that the permit. be renewed as requested.

basin, dual aeration basins, dual clarifiers, dual chlorination and de -chlorination, a clear well
and mud well, dual tertiary filters, an aerated sludge holding tank, a continuous flow meter,
a refrigerated composite sampler, post aeration, effluent pumps and standby power generator.
