Mr. Crosswhite, I received your faxed questions last Wednesday. I wanted to confer with the
NPDES Unit Supervisor before responding to them.
Construction Notice Requirements: The Division of Water Quality (DWQ) requires that
permits to discharge wastewater be sent to Public Notice at least 45 days prior to issuance of a
new permit (or renewal of an existing permit). The facility you mentioned (Knotts Landing /
Highway 150 WWTP, covered by permit NC0074900) was sent to Public Notice in Catawba
County on October 9, 1996 and in Iredell County on October 23, 1996. The renewed permit was
issued on December 12, 1996.
Once a permit has been issued, DWQ does not typically require a separate public notice for
construction of the treatment works; however, special conditions are imposed in coastal areas.
Coastal restrictions would not apply to the facility in question. Construction (or modification) of
permitted facilities must be approved in advance by DWQ. Constructed (or modified) facilities
must be inspected by staff from the appropriate Regional Office prior to activation. The subject
facility was issued an Authorization to Construct on November 24, 1997. If you have questions
about current activities at the site (or planned inspections), contact Mr. Mike Parker of the
Mooresville Regional Office at (704) 663-1699.
Financial Status of Permittees: Information of the financial status of permittees is not
maintained by DWQ. However, Mid -South Water Systems, Inc., is regulated by the North
Carolina Utilities Commission. Further information on the status of MSWS may be available
from the Utilities Commission. Contact Mr. Jack Floyd at (919) 715-5622.

Dear Mr. Weaver:
As I believe you are aware, we have exchanged telephone calls on several occasions
concerning the above -referenced package plant. I have been asked by the P.O. S. S.E, advisory
committee to contact you in hopes of obtaining information as to what notice requirements are
necessary prior to the time the go-ahead is given for the construction of a new package plant.
Additionally, X think there is some concern over the financial status of Md-South. Therefore, Y
would appreciate any cooperation you may have in providing us with financial information or
other information concerning Mid -South. I do not know if you maintain this information, but
would appreciate any comments or suggestions you have as to where we could look for this.
