Personnel in the NPDES Unit and the NC DENR Mooresville Regional Office have reviewed your request and do not object to it. This permit modification corrects the facility description and monitoring requirements in the existing permit, effective February 1, 2000. References to the previous system capacity of 0.033 MGD have been deleted, as have monitoring requirements for a Class III facility. Please find enclosed the revised permit pages. The revised pages should be inserted into your permit. The old pages may then be discarded. All other terms and conditions contained in the original permit remain unchanged and in full effect. This permit modification is issued under the requirements of North Carolina General Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental Protection Agency. If any parts, measurement frequencies or sampling requirements contained in this permit modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be a written petition conforming to Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Continue to operate an existing 0.01 MGD wastewater treatment system that includes the following components: ➢ Bar screen ➢ Flow splitter box ➢ Dual aeration basins ➢ Dual clarifiers ➢ Tertiary filters ➢ Tablet chlorination and dechlorination ➢ Flow recorder ➢ Standby power generator This wastewater treatment system is located at the Diamond Head WWTP on NCSR 1109 near Mooresville in Iredell County. 2. Discharge from said treatment works at the location specified on the attached map into Lake Norman (Reeds Creek Arm), classified WS-IV & B CA waters in the Catawba River Basin. Permit NCO074772 A. A. (2.) TOXICITY REOPENER CONDITION In the event that toxicity testing or other studies (conducted on the effluent or receiving stream) indicate that detrimental effects may be expected as a result of this discharge, the Division may modify or revoke and reissue this permit with toxicity limits and monitoring requirements. DIVISION OF WATER QUALITY December 16, 1999 MEMORANDUM C [' TO: Dave oodrich FROM: p Rex Gleason ' PREPARED BY: Richard Bridgeman SUBJECT: Permit Correction Request Heater Utilities Diamond Head WWTP Permit No. NCO074772 Iredell County Enclosed please find a copy of a permit correction request (monitoring frequencies) for the subject facility. A permit modification for ownership change was issued to Heater Utilities on August 10, 1999. The permit includes monitoring requirements for the existing WWTP which by regulation effective April 1, 1999 would be correct for a Grade III facility; however, since the design capacity of the activated sludge facility is only 0.100 MGD, and biological nutrient reduction is not required, then the facility should be classified Grade II. The NPDES permit for a Grade II facility would normally include weekly monitoring for most effluent pollutants, not 3/week monitoring. The subject permit is scheduled to expire on June 30, 2000. The requested modifications/ corrections would normally be made during the renewal process; however, the permittee is requesting immediate relief from the requirement to conduct 3/week monitoring. The request is reasonable, considering the time now required to process a renewal application. Should you have questions, contact the writer or me. Box 859 Denver, North Carolina 28037 phone: 704.489.9401 lax: 704.489.9409 I am writing to follow up to our phone conversation of December 9, 1999. At that time I indicated to you that our Permit, issued August 10, 1999 had limit based parameters reflecting monitoring requirements consistent with a grade III facility. It is my understanding that effective April 1. 1999 the rating scale was changed to reflect a scale based on flow design. When using a scale based on flow design if a plant has a flow limit less than 0.5 MGD and without nutrients or biological reduction the plant would be rated as a grade II facility. For this reason I believe that the grade III rating which we received for Diamond Head is incorrect. In view of this, Heater Utilities is respectfully requesting that the Diamond Head Permit be reissued with the monitoring requirements reflecting a measurement frequency of weekl for the limit based parameters. In addition to this request we would greatly appreciate relief from the three times per week monitoring until such time as a final decision is made and/or a new permit issued.
