Dear Mr. Myers:
Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
This final permit includes no major changes from the draft permit sent to you on March 10,
2005. This permit does include spill notification requirements and daily monitoring for fecal coliform. We
received and reviewed your letter dated March 31, 2005 regarding the draft permits. However, the addition of
the daily fecal coliform monitoring is the result of a policy decision, and is applied to all package plant discharges
to class B waters of Lake Norman upon permit renewal; therefore, this requirement can not be changed at this
time. After the collection of data over a period of at least two summers, you may submit the findings and
request a reevaluation of the daily fecal coliform monitoring requirement
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days
following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter
150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail
Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this derision shall be final
and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local
governmental permit that may be required. If you have any questions concerning this permit, please contact

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or
discharge are hereby revoked. As of this permit issuance, any previously issued
permit bearing this number is no longer effective. Therefore, the exclusive authority
to operate and discharge from this facility arises under the permit conditions,
requirements, terms, and provisions included herein.
Heater Utilities, Inc., is hereby authorized to:

I. The daily average dissolved oxygen effluent concentration shall not be less than 6.0 mg/L.
2. Daily is defined as seven (7) days per week including Saturday, Sunday, and Holidays during
the summer months and 5 days per week during the winter months.

There shall be no discharge of floating solids or visible foam in other than trace amounts.
A. (2.) TOXICITY REOPENER CONDITION
In the event that toxicity testing or other studies (conducted on the effluent or receiving
stream) indicate that detrimental effects may be expected as a result of this discharge, the
Division may modify or revoke and reissue this permit with toxicity limits and monitoring
requirements.

A. (3.) SPECIAL CONDITION — Spill Notification
(a) Contacting Public Health Directors
The facility must notify the Iredell, and Mecklenburg County Public Health Directors
within 12 hours of first knowledge by the owner/operator of any discharge of untreated
wastewater to waters of the State or a discharge from the wastewater treatment plant that
has not received adequate disinfection due to a malfunctioning treatment unit.

(b) Public Notification
The facility must notify the public of untreated wastewater spills. Wastewater
facility owners or operators must issue a press release after a discharge to surface waters
of 1,000 gallons within 48 hours of first knowledge of the spill by the owner/operator. The
press release must be issued to "all electronic and print news media outlets that provide
general coverage in the counties (Iredell, and Mecklenburg) where the discharge occurred.
A copy of the press release must be maintained for one year by the owner/operator. This
press release is required in addition to the permit requirement of contacting the North
Carolina Division of Water Quality (DWQ).
If a discharge of 15,000 gallons or more reaches surface water, a public notice is required
in addition to the press release. The public notice must be placed in a newspaper having
general circulation in the County in which the discharge occurred and the county
immediately downstream. At a minimum the notice should be published in the newspaper
of general circulation in Iredell, and Mecklenburg Counties. If a discharge of 1,000,000
gallons of wastewater or more reaches surface waters, the DWQ regional office must be
contacted to determine in what additional counties, if any, a public notice must be
published. A copy of these public notices and proof of publication must be sent to the
DWQ to the attention of "Pretreatment, Emergency Response, and Collection Systems Unit"
at 1617 Mail Service Center, Raleigh, North. Carolina 27699 within 30 days of publication.
The minimum content of the notice is the location of the discharge, estimated volume,
water body affected and steps taken to prevent future discharges.

Dear Ms. Rust:
I have received your letter dated March 10, 2005, and the changes to the draft
permit for the Bridgeport permit only. I did not receive modified permits for the
other three systems although they were mentioned in your letter.
It is my understanding pursuant to your letter
"that since the issuance of the permit for Highway 150 WWTP the Division
has received numerous requests from concerned citizens asking that these
same conditions apply to all discharges to Lake Norman where treatment
is performed using package plants."
Therefore, the Division is revising our previously issued draft permits to
include increased requirements including daily testing for fecal coliform.
Heater Utilities, Inc. (Heater) strongly objects to a requirement for daily
fecal coliform testing. This means that Heater will have to grab a sample from each
plant every day and deliver it to our contract laboratory for analysis. These fecal
samples have a six -hour holding time. This is very costly in operator time due to
having to transport these samples everyday.
These plants are discharging relatively small quantities of high quality
effluent into Lake Norman and have an excellent record of compliance with all
parameters, including fecal coliform. Performing daily tests for fecal coliform on
grab samples from each of these plants is a costly exercise providing no additional
protection to the environment. It would simply drive up the rates to our customers.

If the rates to Heater's customers are increased to cover this additional cost, there
will be other concerned citizens that may not want to pay for this non -beneficial
testing.
Please reconsider the requirement for daily fecal coliform testing in these
permits.

5. Directions to site: From the jct. of I-77 and SR 1109 (Williamson Road) south of the
Town of Mooresville, travel northwest on SR 1109 = 0.4 mile. The Diamond Head
WWTP site is located on the right (east) side of SR 1109 via a gravel access road.

7. Site size and expansion area consistent with application: Yes. There is little, if any area
available for future WWTP expansion unless additional acreage is purchased by the
permittee.
8. Topography (relationship to flood plain included): Rolling topography, slopes 5-15%.
The site is located well above the full pond elevation of Lake Norman.

C. Describe receiving stream features and pertinent downstream uses: The discharge
enters Lake Norman in the Reeds Creek area adjacent to the SR 1109 bridge.
There are no other known dischargers in the immediate area, however, there is a
non -potable industrial water intake (previously used by Burlington Industries)
located - 0.25 mile downstream (currently inactive). The lake receives
considerable bodily contact as a result of primary recreational activities.
PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS
1. a. Volume of wastewater: 0.106 MGD (Design Capacity)
b. What is the current permitted capacity: 0.100 MGD
C. Actual treatment capacity of current facility (current design capacity): Combined,
the two WWTPs have a total hydraulic capacity of 0.106 MGD.
d. Date(s) and construction activities allowed by previous ATCs issued in the
previous two years: There have been no ATCs issued in the past two years
e. Description of existing or substantially constructed WWT facilities: The existing
WWT facilities consist of two separate treatment facilities with one having a
0.033 MGD capacity and the other having a 0.0731 MGD capacity. Both WWTPs
have the following components: an influent bar screen followed by a V-notch
weir, dual flow equalization tanks, dual aeration basins, dual clarifiers, an aerated
sludge holding tank, and a multi -media tertiary filter. The two WWTPs share a
chlorine contact tank with tablet disinfection, dechlorination, post aeration, a
sonic flow meter, an effluent pump station and stand-by power. The 0.033 MGD
WWT facility was under repair at the time of the site visit.
f. Description of proposed WWT facilities: There are no proposed facilities at this
time.
g. Possible toxic impacts to surface waters: Chlorine is added to the waste stream,
however, dechlorination is provided.
2. Residual handling and utilization/disposal scheme: Residuals are removed when
necessary by Liquid Waste, Inc. and taken for disposal to either a CMU WWT facility or
by land application at a site in Anson County under the authority of DWQ permit no.
WQ0014843.

PART III - OTHER PERTINENT INFORMATION
Is this facility being constructed with Construction Grant Funds or are any public monies
involved (municipals only)? Public monies were not used in the construction of this
facility.
2. Special monitoring or limitations (including toxicity) requests: None at this time.
3. Important SOC/JOC or Compliance Schedule dates: This facility is not under an SOC at
this time nor is one being considered.
4. Alternative Analysis Evaluation
a. Spray Irrigation: Insufficient area.
b. Connect to regional sewer system: None currently available to the site.
C. Subsurface: Insufficient area.
PART IV - EVALUATION AND RECOMMENDATIONS
The permittee, Heater Utilities, requests reissuance of the subject Permit. There have been
no changes to the permit or WWT facility since the permit was last renewed. It should be noted,
however, that Heater has made a number of minor operational and safety improvements to the
plant since becoming the permittee. Noise reduction measures implemented by Heater during the
term of the previous permit have significantly reduced operational noise. Other improvements
include new safety railing and flooring, new piping and other appurtenances, and tankage repair.
In light of the litigation about the Highway 150 WWTP (NC0074900), effluent
limitations for this discharge into Lake Norman should be based on "modeling" rather than BPJ.
Pending receipt and approval of the draft permit, it is recommended that the Permit be
renewed as requested.

The -sludge management plan for this facility is the removal of liquid
sludge from an aerobic digester, as needed, by Liquid Waste, Inc. and disposed
of at CMUD or by land application in Anson County, under Permit No. WQ0014843.
