This letter transmits a notice of a stipulated penalty assessed against the Town of Siler City in the amount of
$39,000.00. This assessment is based upon the violation of condition(s) stated in the existing Special Order by
Consent (SOC) WQ S22-003.
Paragraph 2 (a) of the SOC requires the permittee to complete construction of WTP Pretreatment Improvements
by July 31, 2023. Upon request of the permittee, the due date was extended to October 29, 2023. The permittee
failed to meet the extended due date and the aforementioned SOC item was completed 23 days late.
You were notified of the violation and of your right to justify the failure to meet the interim date in Notice of
Violation (NOV) letter NOV-2024-SP-0001, dated January 9, 2024. The Division of Water Resources (DWR) did
not receive a response to the aforementioned NOV.
Pursuant to Paragraph 5 (c) of the SOC, the stipulated penalty for failure to complete a scheduled activity by the
date specified in Paragraph 2 is equal to $1,000.00 per day for the first seven (7) calendar days and $2,000.00
per day thereafter. The SOC item of complete construction of WTP Pretreatment Improvements was completed
23 days late, therefore the stipulated penalty of $39,000.00 is now due.

submitted.
