Division personnel have reviewed and approved your application for renewal of the subject permit
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
This final permit includes no major changes from the draft permit sent to you on January 9, 2002.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the Division of Land
Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be
required.

North Brunswick Sanitary District
is hereby authorized to discharge wastewater from a facility located at the
Belville WWTP
Chappell Loop Road
south of Leland
Brunswick County
to receiving waters designated as the Brunswick River in the Cape Fear River Basin in accordance with
effluent limitations, monitoring requirements, and other conditions set forth in Parts I, II, III and IV
hereof.
This permit shall become effective May 1, 2002.
This permit and authorization to discharge shall expire at midnight on November 30, 2006.

The North Brunswick Sanitary District entered into an Operation & Maintenance Agreement
with the Town of Belville for the Belville WWTP and Collection System on May 25, 2001. A
copy of that O&M Agreement is attached for your records.
At this time the District wishes to make application for renewal of the existing permit for this
system. A signed & completed original application form and two (2) copies are enclosed, as is
our plan for sludge management for this facility.

O & M AGREEMENT
COUNTY OF BRUNSWICK
AGREEMENT, made by and between the TOWN OF BELVILLE (the "Town"),
and the NORTH BRUNSWICK SANITARY DISTRICT (the "District");
WITNESSETH:
WHEREAS, the Town owns a sewer system, including a 400,000 gpd treatment
plant, to make sewer service available on reasonable demand to citizens of the Town
(the "Town System"); and
WHEREAS, the District currently provides treated water to citizens of the Town;
and
WHEREAS, the parties deem it in the best interest of the citizens of the Town if
the District operates and maintains the Town System, the Town having determined that
operation and maintenance by the District will .insure efficient operation and
maintenance of the Town System, will result in the Town being able to expand
development, will result in utility customers within the Town receiving only one bill for
water and sewer and will result in the realization of economies of scale which will
reduce the cost of operation and maintenance.
NOW, THEREFORE, in consideration of the mutual covenants and conditions
herein contained, the parties hereto agree as follows:
1. Operation and Maintenance. The District shall, at all times during the
term of this Agreement, keep and maintain, or cause to be kept and maintained, the
Town System in a good state of repair, ordinary wear and tear, obsolescence in spite of
repair and acts of God excepted. The District will at all times during the term of this
Agreement operate the Town System in a prudent, economical and efficient manner in
furtherance of the purposes for which the Town System was undertaken and in
accordance with (i) operation and maintenance manuals and preventive maintenance
manuals for the Town System and (ii) the policies, rules and regulations of the District.
The parties acknowledge that the District is an independent contractor and will be
responsible for selecting the means and methods of performing the work pursuant to
this Agreement.
2. Duties. The duties of the District in operating and maintaining the Town
System shall include, but shall not be limited to, the following, and pursuant to such
operation and maintenance, the District shall:
(a) provide trained competent operating personnel;
(b) visit the Town System on a routine basis to inspect and monitor
operations and perform routine maintenance of facilities and grounds;
(c) on an annual basis, physically inspect the Town System and
confirm the satisfactory operation of all facilities to the Town;
(d) maintain daily operation and maintenance records and file monthly
and yearly operation and maintenance reports;
(e) make all necessary and proper repairs, replacements and renewals
in a timely manner and consistent with good business and operating practices for
comparable facilities and in accordance with applicable standards of regulatory bodies;
(f) maintain the exterior of all facilities, including grounds, in a neat
and clean condition;
(g) perform scheduled preventive maintenance;
(h) read all meters of, send all bills to, and collect all payments from
customers of the Town System;
(i) provide, at its sole cost and expense, all labor, supervision,
supplies, equipment, repair and replacement parts and machinery, tools, and any other
items, things or services necessary for the operation and maintenance of the Town
System in accordance with the terms of this Agreement;
(j) assume the Town's obligations under the contract for operation and
maintenance of the Town System with Britt and Britt Environmental Services, a copy of
which is attached hereto as Exhibit A;
(k) administer the providing of sewer service to new customers and the
construction of infrastructure by developers who intend to connect to the Town System;
(1) the Town shall be the governing authority in committing to provide
sewer service to future customers of the Town System
(m) on or before April 1, 2002, extend sewer service to downtown
Belville in accordance with the Sewer Service Agreement between the parties which is
currently held in escrow by the Title Company of North Carolina. If the Town continues
to hold title to the Town System at the time of making such extension, the Town agrees
to sign in its name applications for all permits needed by the District for the work and to
let all contracts for the work.

3. Compensation. The District shall be entitled to retain all revenues from
customers of the Town System and from such revenues shall pay the cost of operating
and maintaining the Town System. The District shall not be required to account to the
Town for the application or use of such revenues.
4. Impact Fees. The Town has delivered to the District $ in impact
fees which from the date of this agreement shall, together with all future impact fees
due the Town, be the sole property of the District. All such future impact fees due the
Town are hereby assigned to the District and each person or firm owing impact fees to
the Town are directed to pay the same to the District. The District shall collect for its
own account all future impact fees due the Town for sewer service and the Town shall
have no obligation to collect the same.
5. Security Deposits. The Town has delivered to the District all security
deposits collected by the Town regarding sewer service. The District shall be
responsible for maintaining said deposits and refunding them to customers when
appropriate.
6. Obligations of the Town. Upon the execution of this agreement, the Town
shall (i) pay the outstanding debt regarding the Town System of about $70,744, (ii) let a
contract for the construction by the Town of sewer lines and facilities to serve Blackwell
Road, and (iii) segregate in a separate account from its general fund $150,000 of
impact and other fees retained by the town and designate such funds as a capital
reserve to pay the costs of constructing sewer facilities for Blackwell Road.
6. Permits and Approvals. The District and the Town agree to cooperate in
obtaining such permits, certificates or other approvals as may be required for the
operation and maintenance of the Town System as provided for herein.
7. System for Exclusive Use of Town Customers. So long as the Town
retains title to the Town System, the Town System shall only be utilized to provide
sewer service to present and future citizens and residents of the Town.
Notwithstanding the foregoing, the District may at anytime connect lines from the
District's proposed sewer system to the Town System at such places and in such
manner as the District deems appropriate.
8. Term. This Agreement shall terminate upon the termination of the Escrow
Agreement entered into between the District, the Town and The Title Company of North
Carolina, Inc. of even date herewith. Immediately upon termination of this Agreement,
the Sewer Service Agreement between the Town and the District dated April 30, 2001
shall become effective.

PART IV - EVALUATION AND RECOMMENDATIONS
The facility is well operated and maintained. The discharge is extremely clear
and free of suspended solids.
Previous permit was issued to the Town of Belville. On or about May 25, 2001,
the WWTP was conveyed to North Brunswick Sanitary District. DWQ was uninformed
of the change, and therefore continued sending correspondence to the Town of
Belville, which went unanswered. On October 31, 2001, after a NOV was sent to the
Town for failure to request renewal of the permit (expiration date 1 1 /30/01). WiRO
staff visited the Town and discovered that the facility was transferred to North
Brunswick Sanitary District 6 months ago. Applications were supplied to NBSD and
were completed with staff's assistance on 11 /1 /01. A copy of the application is not
attached, as it was forwarded to the Central Office.
It is recommended that a permit be drafted and placed at public notice. if no
significant adverse comments are received, it is recommended that NPDES permit
NCO075540 be reissued to the Sanitary District, in accordance with the basin -wide
permitting strategy.
