Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently
amended).
This permit contains no significant changes from the from the draft permit sent to you on August 31,
2005.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of
the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service
Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and
binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to
obtain other permits which may be required by the Division of Water Quality or permits required by the
Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental

to receiving waters designated as Pole Creek in the French Broad River Basin
in accordance with effluent limitations, monitoring requirements, and other
conditions set forth in Parts I. II, III and IV hereof.
This permit shall become effective December 1, 2005.
This permit and authorization to discharge shall expire at midnight on October 31,
2010.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or
discharge are hereby revoked. As of this permit issuance, any previously issued
permit bearing this number is no longer effective. Therefore, the exclusive authority
to operate and discharge from this facility arises under the permit conditions,
requirements, terms, and provisions included herein.
Havon, Inc., is hereby authorized to:
1. Continue to operate an existing 0.012 MGD extended aeration wastewater
treatment plant with the following components:
■ Aeration basin
■ Clarifier
■ Chlorine contact chamber with tablet chlorination
■ Lift station and force main outfall
This facility is located at the Pleasant Cove Rest Home on Robinson Cove Road
near Candler in Buncombe County.
2. After receiving an Authorization to Construct from the Division, construct and
operate facilities for a design capacity of 0.025 MGD, and
3. Discharge from said treatment works, through outfall 001, into Pole Creek, a
Class C water in the French Broad River Basin, at the location specified on the
attached map.

A. (3) Phased Construction Condition
If this facility is built in phases, plans and specifications for the next phase to be constructed
must be submitted when the flow to the existing equipment reaches 80% (0.0096 MGD) of
the existing permitted flow (0.012 MGD). At no time may the flow tributary to the treatment
system exceed the design capacity of the existing equipment.

Please find enclosed the application for permit renewal for Pleasant Cove Home WWTP.
The treatment facility operates in compliance and there have been no changes to the
facility since issuance of the last permit.
The sludge management plan also remains the same. Solids are wasted to a digester and
aerated. As the sludge thickens the operator notifies the facility owner. A pump truck
service maintains the grease trap, digester and collection baffles. The hauler is
responsible for the disposal of the solids to the local municipality where he is permitted
to discharge.

2005. Mr. Larry Frost and Mr. Kevin Barnett of the Asheville Regional Office conducted the
Compliance Evaluation Inspection. The treatment facility was found to be in violation of Permit
NCO075388 for the following:
