GROUNDWATER AND WASTE MANAGEMENT COMMITTEE
MEETING SUMMARY
March 13, 2024
3:15 p.m. – 4:15 p.m.
Joe Reardon, Chair Presiding
The Groundwater and Waste Management Committee (GWWMC) of the North
Carolina Environmental Management Commission (EMC) addressed the following
at its March 13, 2024, meeting:

I. Preliminary Matters:
1. In accordance with North Carolina General Statute § 138A-15, Chair
Reardon asked if any GWWMC member knew of any known conflict of
interest or appearance of conflict with respect to any item on the March
13, 2024, GWWMC agenda. None of the members stated there was a
conflict.
2. Commissioner Keen made a motion to approve the January 10, 2024,
GWWMC meeting minutes. Commissioner Yarborough seconded the
motion. The vote taken was unanimous and the minutes from the January
meeting were approved.

II. Action Items
1. Request Approval to Proceed to the Environmental Management
Commission with the 2024 Periodic Review of 15A NCAC 02T, Section
.1500 Soil Remediation
(DWM) Jessica Montie
Jessica Montie with the Division of Waste Management presented a
request to approve the periodic review report for 15A NCAC 02T Section
.1500 to proceed to the EMC for public notice. She explained that the
rules in this section govern the permitting of sites for the remediation of
petroleum-contaminated soil under the Underground Storage Tank
Section. She provided an overview of the rule review process and a list of
the rules administered by DWM that would be presented to the GWWMC
during this process in the future. She also indicated that all rules in this
Section were designated as necessary and provided the proposed
schedule for this report. Ms. Montie also explained that the rules in this
section would be combined into one report with the remaining rules in
Subchapter 02T that were concurrently being presented to the Water
Quality Committee as the report proceeds to the EMC and public notice.
Following Ms. Montie’s presentation Commissioner Bailey made a
motion to approve DWM’s request to proceed to the EMC with the Rules
Review Report Initial Determinations for 15A NCAC 02T Section .1500.
The motion was seconded by Vice-Chair Baumgartner. A vote was taken
and the motion passed unanimously.
III. Information Items
1. PFAS Groundwater Quality Standards Rulemaking Update
(DWM) Jessica Montie
Jessica Montie with the Division of Waste Management presented an
update on the stakeholder meetings for the PFAS groundwater quality
standard rulemaking. She provided an overview of how the standards are

required to be established under 15A NCAC 02L .0202(d) and the existing
requirements for using the practical quantitation limit as the standard
under Rule .0202(c) and (b)(1). She also provided some background on
the EMC’s previous efforts to propose a groundwater quality standard for
total PFOA and PFOS in 2020/2021. Ms. Montie then explained the draft
proposed standards and the Division’s timeline for addressing PFAS in
groundwater (under either the existing rule or the amended rule) that
had been shown at the stakeholder meetings. She also summarized the
list of invited stakeholders, some of the feedback they provided, and
proposed next steps.
There was some additional discussion, for the purpose of clarification,
during and immediately following the presentation.
