Good afternoon All,
DWR understands the USACE has opted to withdraw the permit application pending a response to
the request for additional information. As such, the application (DWR Project #20240382) remains
in complete in accordance with 15A NCAC 02H .0502. DWR is placing the project on -hold until a
response is received that includes details verifying the culvert invert and outlets elevations, and
review can continue.
Pursuant to 40 CFR Part 121.6., DWR is required to respond to a 401 application within the
established federal Reasonable Period of Time, 180 days from receipt of the application. The federal
reasonable period of time for DWR to review the application will end on August 21, 2024. Please feel

Thanks for your email. Ms. Winder contacted her surveyor to perform the additional
work, but they have not gotten back with her yet. We plan to reach out to another
surveyor to see if we can get someone out there quicker.

At this time, I am awaiting the updated plans for the proposed ditch that show the
elevations and how this ditch is to be constructed. On 4/11 /2024 we will be at the 45-
day window so we are withdrawing your application until you can produce the
necessary plans showing how you are going to meet the general condition 2 and 9 with
this ditch. When this information/plan is provided we will reopen this application and
issue the permit. If you have any questions, please feel free to contact me.

This is a follow up on our conversation earlier for request for additional information.
1. 1 would like to see how you are going to maintained flow through your site from
the wetland above to the below waters. If you plan to pipe I then we would need
to consider these impacts and if it is a ditch then that ditch will nee to be made
so that it has OHW throughout. ( Condition 9)
2. Also, we will need the FEMA approval before we can issue this permit to meet
condition 10 of the permit.
