Partial Response to Notice of Violation (dated March 28, 2024)
Dear Mr. Eplin:
On behalf of Galvan Industries, Inc. (Galvan), HDR Engineering, Inc. of the Carolinas is providing the
following response to the North Carolina Department of Environmental Quality (NCDEQ) Notice of
Violation (NOV) issued on March 28, 2024 and received on March 29, 2024. Galvan holds a National
Pollutant Discharge and Elimination System (NPDES) Individual Stormwater Permit (NCS000597)
issued by the NCDEQ Division of Energy, Mineral, and Land Resources (DEMLR) in May 2022. Mr.
Mathew Gigante, Environmental Specialist II from the Mooresville Regional Office, conducted a site
inspection on March 20, 2024. After the site inspection, DEMLR summarized findings of the site
inspection in a NOV issued on March 28, 2024. Please see the following responses to the items
identified in NOV-2023-PC-0525, which we have been able to complete to date.
Two permit condition violations were noted in the NOV:
1) Stormwater Pollution Prevention Plan (SPPP): The Galvan Stormwater Pollution Prevention
Plan (SPPP) has not been fully updated for the current individual permit the facility holds.
2) Tier 111 Action Plan Galvan Industries' zinc management plan was sent in reply to the
requirement in the NOV to submit a Tier 111 action plan for copper and zinc benchmark
exceedances. The difference between the two types of documents was discussed during the
meeting.A tier 111 action plan for copper and zinc is still required to be completed and sent to
the DEQ Mooresville Regional Office.

As noted during the March 20, 2024, inspection, Galvan Industries has maintained a SWPPP since
2008. After discussions and clarification by Mr. Gigante, Galvan understands the need to update the
document to comply with the individual permit. Based on required components of the SWPPP and
the Tier III Action Plan, Galvan is requesting a 30-day extension for completion, with submittal to
NCDEQ by May 28, 2024. Should you have questions or require additional information following your
