SFR Single -Family Residence Wastewater Irrigation System Orange County Dear Mr. and Mrs. Osborne, Division of Water Resources' Central and Regional staff has reviewed the application package received on October 3, 2023. However, the Division requires additional information before completing our review. Please address the items on the attached pages no later than the close of business on January 10, 2024. Please be aware that the Applicant is responsible for meeting all requirements set forth in North Carolina rules and regulations. The Applicant is also responsible for any oversights that occur during the review of the subject application package. The Division may return the application as incomplete pursuant to 15A NCAC 02T .0107(e)(2) if any omissions are made when responding to the outstanding items in Sections A through C, or the Applicant fails to provide the additional information on or before the above - requested date. Please reference the subject application number when providing the requested information. The Applicant shall sign, seal, and date (where applicable) all revised and/or additional documentation and submit an electronic response to my attention via the Non -Discharge online portal. Section IV — Operation and Maintenance Agreement: All single-family residence wastewater irrigation system renewal applications must include a properly executed Operation and Maintenance Agreement. We cannot verify that typed signatures are legitimate. Please resubmit the Operation and Maintenance agreement with either physical signatures (Le paper and pen) or digital signatures applied through a verifiable e-signature service. [15A NCAC 02T .0604(h)] B. Attachment H — Setback Waivers: 1. The GPS coordinates we have for your irrigation site indicates that it does not meet the setback rules which were in effect when it was originally permitted. Please obtain a setback waiver with the owner of the parcel to the north of your property (Parcel ID: 0807698585) which will allow your field to operate at a distance less than 400 feet from their habitable residence, and less than 150 feet from the property line. This setback waiver must be signed and executed by both parties and recorded in the Orange County Register of Deeds. Please see the next page for a list of all setback requirements and the rule references. C. Applicant's Certification: 1. All single-family residence wastewater irrigation system renewal applications must be signed. We cannot verify that typed signatures are legitimate. Please resubmit the final page of your renewal application with either physical signatures (Le paper and pen) or digital signatures applied through a verifiable e-signature service. The Division originally permitted the irrigation sites on April 28,1988, with an application received on October 3, 2023. The setbacks for spray irrigation sites originally permitted or modified with an application received from October 1, 1987, through January 31, 1993, are as follows (all distances in feet): I. Each habitable residence or place of assembly under separate ownership: 400 1 ii. Each private or public water supply source: 100 iii. Surface waters: 100 iv. Groundwater lowering ditches: 100 v. Surface water diversions (upslope): 100 vi. Surface water diversions (downslope): 100 vii. Each well with exception of monitoring wells: 100 viii. Each property line: 150 Z ix. Top of slope of embankments or cuts of two feet or more in vertical height: 100 x. Each water line: 10 xi. Each swimming pool: 100 xii. Public right of way: 50 xiii. Nitrification field: 20 xiv. Each building foundation or basement: 100 ' Habitable residences or places of assembly under separate ownership constructed after the Division originally permitted or subsequently modified the facilities are exempt from this setback. 2 Setbacks to property lines are not applicable when the Permittee, or the entity from which the Permittee is leasing, owns both parcels separated by the property line. [15A NCAC 02H .0219(i)(5)] b. The Division originally permitted the treatment and storage units on April 28, 1988, with an application received on October 3, 2023. The setbacks for treatment and storage units originally permitted or modified with an application received from October 1, 1987, through January 31, 1993, are as follows (all distances in feet): I. Each private or public water supply source: 100 ii. Each well with exception of monitoring wells: 100 iii. Each property line: 50 1 iv. Nitrification field: 20 ' Setbacks to property lines are not applicable when the Permittee, or the entity from which the Permittee is leasing, owns both parcels separated by the property line.
