The purpose of the proposed project is to repair existing outfalls and the implementation of streambank stabilization to
prevent stream bank failure and erosion.

The overall project includes the stabilization and repair and stabilization of stream banks and stormwater outfalls. Due
to damage caused by several previous large scale storm events, the structural integrity of the streambanks and the
conveyance performance of the outfall pipes and headwall structures are failing, which will result in further
infrastructure damage and environmental impacts, including excessive sediment load discharge to down -gradient
waters. Construction equipment will use excavators, dozers/loaders, haulers and other heavy machinery.

1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts through project design:
The applicant has designed the proposed stabilization to limit stream bank stabilization activities throughout the bottom
of the stream beds and wetland areas of the proposed project with the exception of repairing damaged and failing
stormwater outfall structures. The repair to outfalls and energy dissipator pads was initially designed with above grade
stream fills and below grade wetland disturbance. The applicant has updated their proposed plans that significantly
reduce the net loss impact to streams and wetlands and the temporary disturbance to streams and wetlands. The
applicant has incorporated the use of a natural bio-degradable fiber turf reinforced matting and vegetative stabilization
of restored stream banks to minimize permanent fill impacts to streams and wetlands. The proposed project will
significantly improve water quality on the site and immediate down -gradient areas.

The disturbance limits will be staked and surveyed in the field. Sediment and erosion control devices and other best
management practices will be utilized during site development activities to prevent down -gradient sedimentation into
waters. The applicant has designed a construction sequence that will use coffer dams pump arounds and other BMPs
to ensure work is completed in the dry. The sequence will use staged de -watering such that only portions of the
project areas with active work are being temporarily dewatered.

Dear Mr. Goodson:
The U.S. Fish and Wildlife Service (Service) has reviewed your July 11, 2022, letter and attachments
regarding the United States Air Force's (Air Force) proposed repair of stormwater systems at
Seymour Johnson Air Force Base (SJAFB). The proposed action is necessary to address degradation
and erosion that have taken place in recent years within the Burge Ditch and Hospital Creek (HQ
water courses on the installation. The Air Force is preparing an Environmental Assessment (EA) to
evaluate the potential environmental impacts associated with the proposed action. The Air Force's
effects determinations for federally listed species and designated critical habitat are based on the
information contained in your July 11, 2022 letter. Our comments are provided in accordance with
section 7 of the Endangered Species Act (Act) of 1973, as amended (16 USC 1531 et seq.).
The EA is being prepared for the evaluation of stream outfal I repair, maintenance and streambank
stabilization at the site. Section 404 permit authorization from the U.S. Army Corps of Engineers
(USACE) is anticipated. The proposed action involves the following repairs to the SJAFB
stormwater system:
Burge Ditch (approximately 22 acres):
• Redesign, replace outfall structures at two outfalls; add stilling basin and stabilize
streambanks
Repair/harden area around headwall of one outfall with riprap; stabilize swale with turf
reinforcement mats
• Selective regrading of banks and stabilize areas with turf reinforcement mats
Hospital Creek (HC North approximately 1.6 acres; HC South approximately 2.2 acres):
• Remove two separated culvert pipe pieces, install new headwall, install new concrete slough
from road and riprap
• Selective regrading of banks and stabilize areas with turf reinforcement mats
• Install riprap in roadside swale and in front of headwall
• Install riprap and turf reinforcement mats in selective areas
• Add topsoil and hydroseed areas of exposed soil
Based on the sparsity and low quality of suitable forested habitat within or near the project locations,
we concur with your determination that the proposed action will have no effect on the red -cockaded
woodpecker (Picoides [=Dryobates] borealis.
Three federally listed aquatic species are known to occur in Wayne County: Neuse River waterdog
(Necturus lewisi; amphibian), Carolina madtom (Noturus furiosus; fish) and Atlantic pigtoe
(Fusconaia masoni; mussel).
Neuse River waterdog is an aquatic salamander and its habitat includes low to moderate gradient
streams and low current velocity. It lacks lungs, getting oxygen from the water via external gills and
needs clean, flowing water with high dissolved oxygen concentrations. The species occurs in
streams wider than 15 meters but has been found in smaller creeks. The species thrives in cold water
and is much more active in colder seasons. In early spring the salamanders move into leaf beds over
mud banks on the low -energy sides of riffles and where leaves are intact or only slightly decomposed
with small vertebrates/invertebrates in the leaf litter.
Carolina madtom occurs in riffles, runs, and pools in medium to large streams and rivers. It prefers
fresh waters with continuous, year-round flow and moderate gradient in both the Piedmont and
Coastal Plain. Optimal substrate for the Carolina madtom is predominantly silt -free, stable, gravel
and cobble bottom habitat, and with cover for nest sites, including under rocks, bark, relic mussel
shells, and even cans and bottles.
The preferred habitat for the Atlantic pigtoe is coarse sand and gravel, and rarely silt and
detritus. Historically, the healthiest populations existed in small creeks to larger rivers with excellent
water quality, where flows were sufficient to maintain clean, silt -free substrates.
Due to the limited size and degraded conditions of the streams to be addressed through stormwater
repair, the Air Force has determined that the proposed repair of stormwater systems within the Burge
Ditch and Hospital Creek water courses would have no effect on these three aquatic species. Based
on a review of the information contained in your July 11, 2022 letter and enclosures the Service
concurs with your determination that the proposed action will have no effect on the red -cockaded
woodpecker, Neuse River waterdog, Carolina madtom or Atlantic pigtoe.
We believe that the requirements of section 7(a)(2) of the Act have been satisfied. We remind you
that obligations under section 7 consultation must be reconsidered if: (1) new information reveals
impacts of this identified action that may affect listed species or critical habitat in a manner not
previously considered; (2) this action is subsequently modified in a manner that was not considered
in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the
identified action.

Division to review and concur with the boundaries of an aquatic resource delineation.
We have reviewed the information provided by you concerning the aquatic resources, and by copy of this
e-mail, are confirming that the aquatic resources delineation has been verified by the Corps to be a
sufficiently accurate and reliable representation of the location and extent of aquatic resources within the
identified review area. The location and extent of these aquatic resources are shown on the delineation

Regulatory Guidance Letter (RGL) 16-01

Jurisdictional Determinations (JD) and states "The Corps generally does not issue a JD of any type where
no JD has been requested". At this time, we are only verifying the delineation. This delineation may be
relied upon for use in the permit evaluation process, including determining compensatory
mitigation. "This verification does not address nor include any consideration for geographic jurisdiction on
aquatic resources and shall not be interpreted as such. This delineation verification is not an Approved
Jurisdictional Determination (AJD) and is not an appealable action under the Regulatory Program
Administrative Appeal Process (33 CFR Part 331). However, you may request an AJD, which is an
appealable action.
If you wish to receive a Preliminary Jurisdictional Determination (PJD), or an Approved Jurisdictional
Determination (AJD) please respond accordingly, otherwise nothing further is required and we will not
provide any additional documentation.
The delineation included herein has been conducted to identify the location and extent of the aquatic

The Division of Water Resources has determined that the streams listed above and included on the attached map have
been located on pages 19, 20, 25, and 26 of the most recent published NRCS Soil Survey of Wayne County, North Carolina
and/or the most recent copy of the USGS Topographic map at a 1:24,000 scale and evaluated for applicability to the Neuse
Riparian Buffer Rule. Each stream that is checked "Not Subject" has been determined to not be at least intermittent or not
present on the property. Streams that are checked "Subject" have been located on the property and possess
characteristics that qualify them to be at least intermittent streams. There may be other streams or features located on
the property that do not appear on the maps referenced above but may be considered jurisdictional according to the US
Army Corps of Engineers and subject to the Clean Water Act.
This on -site determination shall expire five (5) years from the date of this letter. Landowners or affected parties
that dispute a determination made by the DWR may request a determination by the Director. An appeal request
must be made within sixty (60) calendar days of date of this letter to the Director in writing.
