Dear Mr. Ashbaugh:
This letter is in response to the Pre-Construction Notification (PCN) you submitted to
the Wilmington District, Raleigh on December 14, 2023 and resubmitted on March 15,
2024, for a Department of the Army Nationwide permit (NWP) verification. This project
has been assigned the file number SAW-2021-02522 and is known as Bellerose. This
file number should be referenced in all correspondence concerning this project.
A review of the information provided indicates that the proposed work would include
the permanent discharge of dredged/fill material in 0.099 acre of wetland waters to
facilitate the construction of roadways which would access a single-family residential
development. The project would also involve the temporary impacts of 0.141 acre of
wetland waters and the temporary impact of 79.4 linear feet (0.020 acre) of stream
channel to facilitate the installation of two sewer lines to service the Bellerose
subdivision. The project area for this determination includes a 75.21 acres area which is
illustrated on the enclosed site plans/maps. The project/review area is located in the
Michael Branch watershed (Hydrologic Unit Code: 0303000203), which is within the
Cape Fear River basin; at 1001 Springwood Avenue, at Latitude 36.091170 and
Longitude -79.540220; in Gibsonville, Guilford County, North Carolina.
We have determined that the proposed work is authorized by NWP 29 pursuant to
authorities under Section 404 of the Clean Water Act (33 U.S.C § 1344). The proposed
work must be accomplished in strict accordance with the general permit conditions, any
regional conditions, the special conditions listed in this letter, the application materials,
and the enclosed plans. If the extent of the project area and/or nature of the authorized
impacts to waters are modified, a revised PCN must be submitted to this office for
written approval before work is initiated. Any violation of permit conditions or deviation
from your submitted plans may subject the permittee to enforcement action.
This verification is valid until March 15, 2026, unless prior to this date the subject
NWP(s) is suspended, revoked, or is modified such that the activity no longer complies
with the terms and conditions of this NWP. If you commence or are under contract to
commence this activity before the date that the relevant NWP is modified or revoked,
you will have 12 months from the date of the modification or revocation of the NWP to
complete the activity under the present terms and conditions of this NWP.
Project Specific Special Conditions:
1. Suitable habitat for tricolored bat (Perimyotis subflavus) may be present at the
site. On September 14, 2022, the United States Fish and Wildlife Service
(USFWS) published a proposal in the Federal Register to list the tricolored bat as
endangered under the Endangered Species Act (ESA). The permittee
understands and agrees that all work associated with the clearing and removal of
trees and removal or modification of culverts must be completed prior to the
effective date of the final listing of this species in the Federal Register. Work
associated with the aforementioned activities not completed by the time must
cease and the permittee must contact Laura Meyer of the Corps at (919) 634-
1595 or laura.j.meyer@usace.army.mil to determine if additional coordination
with the USFWS is required under Section 7 of the ESA prior to continuing work.
Activities subject to Section 404 (as indicated above) may also require an individual
Section 401 Water Quality Certification. You should contact the NC Division of Water
Resources (telephone 919-807-6300) to determine Section 401 requirements.
This NWP verification does not preclude the necessity to obtain any other Federal,
State, or local permits, licenses, and/or certifications, which may be required.

NOTES
1) EROSION STONE TO BE "CLASS I" RIP-RAP UNLESS DESIGNATED DIFFERENTLY ON
CONSTRUCTION PLAN.
2) PUMP AND LINE SIZE TO BE DETERMINED BY THE CONTRACTOR USING THE BASE FLOW
SHOWN ON THE CONSTRUCTION PLANS.
3) MATERIAL SPECIFICATIONS
SANDBAGS: SANDBAGS SHALL CONSIST OF MATERIALS WHICH ARE RESISTANT TO
ULTRAVIOLET RADIATION, TEARING AND PUNCTURE, AND WOVEN TIGHTLY ENOUGH TO
PREVENT LEAKAGE OF FILL MATERIAL. (i.e. SAND, FINE GRAVEL, ETC.)
CONSTRUCTION SEQUENCE FOR SANITARY SEWER CROSSING-PUMP AROUND
1) INSTALL PUMP AND LINE TO PUMP FLOW FROM AREA UPSTREAM OF TEMPORARY STREAM
CROSSING TO AREA DOWNSTREAM OF CONSTRUCTION AREA. BEGIN PUMPING AND
CONTINUING PUMPING WHILE WORKING WITHIN THE STREAM.
2) INSTALL DOWNSTREAM TEMPORARY STONE DAM AND FILTER FABRIC TO PREVENT
BACKFLOW INTO CONSTRUCTION AREA.
3) INSTALL PROPOSED EARTH BERMS ALONG TOP OF BANK ON EACH SIDE OF THE
CONSTRUCTION AREA.
4) INSTALL DEWATERING BASIN OR SILT BAG AT TOP OF BANK. DEWATER CONSTRCTION
AREA BETWEEN TEMPORARY DAM USING TEMP. SEDIMENT TRAP.
5) UPON CONSTRUCTION COMPLETION, REMOVE TEMPORARY DAMS, FILTER FABRIC.
DEPRESS TEMPORARY DAM BOTTOMS INTO STREAM BED UNTIL TOP OF
RIP RAP IS LEVEL WITH STREAM BOTTOM.
6) UPON STABILIZATION OF CLEARED AREAS, REMOVE TEMPORARY EARTH BERM, SEDIMENT
