This project has been assigned the file number 2024-00200 and is known as the Mouth of Hardin Creek Restoration. This file number should be referenced in all correspondence concerning this project. A review of the information provided indicates that the proposed work would include stream restoration to approximately 2,520 linear feet of Hardin Creek and its unnamed tributaries along with 1.535 acre of wetlands. This activity, as described, complies with all terms and conditions of the. The project area is illustrated on the enclosed site plans/maps and located at Latitude 36.21219 and Longitude -81.64937, near 300 Go Pioneers Drive, in Boone, Watauga County, North Carolina. We have determined that the proposed work is authorized by Nationwide #27 pursuant to authorities under Section 404 of the Clean Water Act (33 U.S.0 § 1344). The proposed work must be accomplished in strict accordance with the general permit conditions, any regional conditions, the application materials, and the enclosed plans. A special condition of this authorization prohibits in -stream work from October 15 to April 15 to avoid/minimize impacts to trout spawning as recommended in the attached letter from the North Carolina Wildlife Resources Commission. To avoid/minimize impacts to federally endangered/threatened bat species, tree clearing is prohibited from April 1- October 15 which is also a special condition of this permit authorization. If the extent of the project area and/or nature of the authorized impacts to waters are modified, a revised PCN must be submitted to this office for written approval before work is initiated. Any violation of permit conditions or deviation from your submitted plans may subject the permittee to enforcement action. This verification is valid until March 14, 2026, unless prior to this date the subject NWP(s) is suspended, revoked, or is modified such that the activity no longer complies with the terms and conditions of this NWP. If you commence or are under contract to commence this activity before the date that the relevant NWP is modified or revoked, you will have 12 months from the date of the modification or revocation of the NWP to complete the activity under the present terms and conditions of this NWP. This NWP verification does not preclude the necessity to obtain any other Federal, State, or local permits, licenses, and/or certifications, which may be required. Our comments on this application are offered for your consideration under provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661- 667d). There are Rainbow Trout and Brown Trout in the vicinity of the project, and in -stream activities should be avoided between October 15 and April 15 in order to minimize impacts to trout reproduction. In addition, the South Fork New River is recognized by the NC Natural Heritage Program as the South Fork New River Aquatic Habitat, rated Exceptional for the richness of rare species it contains. Rare and listed species found in the river in the vicinity of the project include Seep Mudalia [Leptoxis dilatata, NC Special Concem (SC)], Kanawha Minnow (Phenacobius terelutus, NC SQ, Eastern Hellbender (Cryptobranchus alleganiensis, US Federal Species of Concern, NC SQ, Kanawha Darter [Etheostoma kanawhae, NC Significantly Rare (SR)], Tongue-tied Minnow (Exoglossum laurae, NC SR), Kanawha Rosyface Shiner (Notropis sp., NC SR), and Appalachia Darter (Percina gymnocephala, NC SR). These rare species are especially sensitive to sediment, and excellent erosion and sediment control is essential to minimize impacts to these species. The application proposes to stabilize unstable reaches of stream by building a new channel with constructed riffles, log vanes, boulder and log j -hooks, and toewood. Berms will be removed and floodplain benches constructed. A 75-ft wide riparian buffer will be planted. Mud mats will be used to cross wetlands and timber bridges used to cross streams. The channel will mostly be constructed off-line. We offer the following recommendations to minimize impacts to the aquatic community: 1. In -channel work should be accomplished as quickly as possible and vigilance used in sediment and erosion control during site preparation, construction, and clean up. Disturbed areas should be seeded, mulched and/or matted as soon as possible, preferably at the end of each work day. 2. Where work is to be done in live flows, flows should be pumped around work areas due to the ecological importance of the South Fork River just downstream. 3. Any erosion control matting used should be free of nylon or plastic mesh, as this type of mesh netting frequently entangles wildlife and is slow to degrade, resulting in a hazard that may last for years. 4. In -stream activities should be done outside the October 15 to April 15 trout moratorium to minimize impacts to Brown Trout reproduction. 5. A large area of wetland will be impacted, but the plan does not specify any wetland plantings. We recommend using native wetland seed mix for impacted wetland areas. IF THE EXISTING GROUND IS LESS THAN 0.2' HIGHER THAN THE PROPOSED BANKFULL ELEVATION, IT IS NOT NECESSARY TO EXCAVATE TO THE PROPOSED ELEVATIONS AND GRADES IN THE CONSTRUCTION DOCUMENTS. 21. BANK STABILIZATION STRUCTURES SHALL BE INSTALLED AS SHOWN IN THE DRAWINGS AND DETAILS. ALL STRUCTURES SHALL BE FINISHED TO A SMOOTH SURFACE IN ACCORDANCE WITH THE LINES, GRADES AND ELEVATIONS SHOWN IN THE DRAWINGS AND DETAILS. THE FINISHED STRUCTURE SLOPES AND GRADES SHALL BE WITHIN 0.1'OF DESIGN ELEVATIONS. 22. AFTER THE STRUCTURE IS COMPLETE AND NORMAL FLOW IS RESTORED TO THE CHANNEL, SOME ADJUSTMENT TO THE STRUCTURE OR ADDITIONAL STABILIZATION MEASURE MAY BE NECESSARY TO ACHIEVE THE DESIRED FUNCTION. 23. THE GRADED RIVER BANKS SHALL BE STABILIZED AS SOON AS POSSIBLE BY TEMPORARY AND PERMANENT SEEDING, ADDING STRAW MULCH TO BARE SOIL AND INSTALLING EROSION CONTROL MATTING AS SHOWN IN THE DRAWINGS AND DETAILS. PRIOR TO INSTALLING THE EROSION CONTROL MATTING, PREPARE THE SOIL SURFACE BY LOOSENING 3 - 6" OF SOIL OR APPLYING 3 - 6" OF TOPSOIL TO THE DESIGN ELEVATIONS AND APPLY TEMPORARY AND PERMANENT SEED AND THEN STRAW MULCH. SEED SHALL BE BROADCAST EVENLY OVER THE AREA USING A BROADCAST SPREADER PRIOR TO COVERING WITH THE EROSION CONTROL MATTING. THE MATTING SHALL BE ROLLED OUT IN THE DIRECTION OF ANTICIPATED RUNOFF. INSTALL MATTING IN ACCORDANCE WITH THE DETAIL INCLUDED IN THE DRAWINGS. MATTING USED FOR STREAMBANK STABILIZATION MUST BE CERTIFIED WEED -FREE STRAW OR OTHER NATURAL WEED -FREE / NON -PROPAGATING VEGETATIVE MATERIALS. REWORKING OF AREAS THAT DO NOT ESTABLISH VEGETATION OR BECOME UNSTABLE SHALL BE NECESSARY IN THE MATTING SEPARATES FROM THE SOIL. 24. TOPSOIL SHALL BE REMOVED FROM EXCAVATION AND FILL AREAS PRIOR TO EXCAVATION AND GRADING AND RE -APPLIED TO AREAS AFTER ROUGH GRADING IS COMPLETE. 2 - 4" OF TOPSOIL SHALL BE PLACED ON DISTURBED AREAS TO THE ELEVATIONS AND GRADES INCLUDED IN THE DRAWINGS. 25. HYDRIC SOILS FROM THE DISTURBED WETLAND AREA(S) WILL BE STOCKPILED SEPARATE FROM OTHER STOCKPILED SOILS AT THE SITE.
