RE: Stream Classification Deternunation Appeal for Stream Feature E, Lystra Gardens; Chatham County, North Carolina On behalf of the property owner, Lystra Gardens, LLC, we request an appeal of the buffer determination performed by Lia Myott for the Lystra Gardens Site. Ms. Myott met S&EC on site and determined feature E to be an intermittent stream, in sections, beginning at flag 104 (see attached letter and map). However, we believe this feature lacks the necessary indicators of an intermittent stream channel at this point, and that the stream becomes intermittent further down the drainage. Therefore, we request a re- evaluation of Ms. Myott's analysis. Please accept this letter as an official request. We are only appealing the determination of stream "feature E" at this time. Your help in clarifying the status of this feature is greatly appreciated. Please contact meat your earliest convenience to coordinate a site meeting for re-evaluating the feature in question. The Division of Water Quality (DWQ) has determined that the following: • Feature "A" is an intermittent stream at the flag labeled "A1"which corresponds with the S&EC flag "232". The intermittent/perennial point is located at the flag labeled "A2" which corresponds with the S&EC flag "S 15". • Feature "B" is an uncontested perennial stream on the property. • Feature "C" is an intermittent stream at the flag labeled "C1" which corresponds with the S&EC flag "118". This stream rated a "24.5" on the NCDWQ Stream Identification Form. The intermittentlperennial point is located at the flag labeled "C2" which corresponds with the S&EC flag "129". • Feature "D" is an uncontested perennial stream beginning at the S&EC flag labeled "SOS". • Feature "E" is an intermittent stream that sporadically transitions from intermittent to a few times before becoming perennial. The stream is intermittent from the SBcEC flag labeled "104" to "102"and from the S&EC flag labeled "E 13" to "E17" (this portion of the stream rated a "20.75" on the NCDWQ Stream Identification Form.) and from the DWQ flag labeled "E-2" to "E-3" and from the DWQ flag labeled "E- 4" (which corresponds to the S&EC flag labeled "S03") to "E-5". The feature becomes a perennial stream at flag "E-5". • Feature "F" at the flag labeled "F1"which corresponds with the S&EC flag "100 CL 2"'. This stream rated a " 25" on the NCDWQ Stream Identification Form. The intermittent/perennial point is located at the flag labeled "F2" which corresponds with the S&EC flag "SO1". • Feature "G" is an intermittent stream that sporadically transitions from stream to wetland. The stream is intermittent from the S&EC flag labeled "S08" to "S09"and from the S&EC flag labeled "S10" to the DWQ flag labeled "G3" which is located approximately 30ft downstream of the S&EC flag labeled "S 11 ". The feature again transitions to an intermittent stream from the S&EC flag labeled "S 12" to "S 13" (DWQ G2) then becomes an intermittent stream again further downstream at DWQ flag "G1". • Feature "H" is an intermittent stream at the S&EC flag labeled "S07". • Feature "I" is an intermittent stream from S&EC flag "212" (DWQ Il) to its confluence with the perennial stream feature A. • Feature "J" is an intermittent stream beginning at the S&EC flag labeled "223" (DWQ J1).
