On March 20, 2024, Melissa Joyner from the Fayetteville Regional Office of the Division of Energy, Mineral
and Land Resources (DEMLR), conducted a site inspection for the Womble Mine facility located at 1617
McKoy Town Road, Cameron, Fayetteville, in Harnett County, North Carolina. A copy of the Compliance
Inspection Report is enclosed for your review. The site visit andfile review revealed that the subject facility
is covered by NPDES Stormwater General Permit NCG020000 under Certificate of Coverage NCG020739.
Permit coverage authorizes the discharge of storrnwater from the facility to receiving waters designated as
Buffalo Creek, class WS-III waters in the Cape Fear River Basin.
As a result of the site inspection, the following permit conditions violations are noted:
1)Stormwater Pollution Prevention Plan (SWPPP)
Per Part B...A Stormwater Pollution Prevention Plan (SWPPP) has not been properly implemented.
2) Qualitative Monitoring
Per Part E, Section E-1, E-2...Qualitative monitoring has not been conducted and/or recorded in
accordance with permit requirements.
3)Analytical Monitorinq
Per Part F, Section F-1-F-10...Analytical monitoring has not been conducted and/or recorded in accordance
with permit requirements.
Other Observations
Please refer to the enclosed Compliance Inspection Report for additional comments and observations made
during the inspection.
Requested Response
You are asked to respond to this office, in writing,within 30 calendar days from receipt of this notice. Your
written response should include a reasonable explanation as to why the aforementioned violations have
occurred as well as a Plan of Action to prevent these violations from recurring.

Action Items
Immediately review and amend the facility's SWPPP as needed and begin incorporating documentation
pertaining to the annual update requirements of the permit. Conduct and record monitoring per the
conditions of the permit.
Thank you for your attention to this matter. This office requires that the violations, as detailed above,
be properly resolved. These violations and any future violations are subject to a civil penalty
assessment of up to$25,000 per day for each violation.Should you have any questions regarding these

Inspection Summary:
Melissa Joyner met with Mr.James Washburn, Environmental Compliance Manager at the Womble Mine.The Stormwater
Pollution Prevention Plan (SWPPP)was reviewed.The SWPPP has not been annually reviewed and updated(as needed).
The rainfall data was being obtained from the Internet.This information will need to be obtained from an on-site rain gauge or
from a source within a mile of the mine.There was no detailed site map which needs to be included in the SWPPP with the
required information per the conditions of General Permit NCG020000. Employee training was not being conducted.
Information should be included under the Spill Prevention and Response Plan about the location and contents of the spill kit.
The stormwater facility inspection program was not being conducted quarterly. The facility has a single outfall which has not
been inspected in a few years because it is not reportedly accessible. The Inspector was not able to access this outfall
during the inspection. The possible presence of non-stormwater being discharged from the outfall has not been annually
evaluated. Neither Qualitative nor Analytical Monitoring have occurred.This Outfall needs to be made accessible or another
accessible sampling location identified to enable monitoring to occur on a quarterly basis. In order to elecronically upload

If there is no discharge at the outfall this should be noted on the DMR.
S. T.Wooten is also out of compliance with the Mine Permit(43-42) because permanent boundary markers have not been
installed for the affected mine permit boundaries.
