Agreed.
1) Since the total size of wetland WBU is 0.02 acre, while DWR has jurisdiction, no mitigation will be needed due to not
reaching the threshold 1/3 acre.
2) I concur with DWR and the Corps regarding stream SD on Sheet 31. It was Permit Site 31 (drawing attached). The
permit modification request dated June 26 2015 (permit mod issued July 24, 2015) accounted for 477 If of total fill and
211f of bank stabilization to SD, including the 286' of pipe in the same location the ditch was shown on the U-2525C CP4B
plans. So, I suppose (and let me know if I am mistaken) that would mean that this impact is already accounted for, but
in the form of a 48" RCP, not a ditch, and does not need to be included in the C Section permit mods.

The Permit Mod issued by the Corps on July 24, 2015 for U-2525B was for, among other things, placing 286 linear feet of
stream in a culvert (loss of waters) at U-2525B Permit Site 31, due to safety and slope stability concerns related to
widening and adding a travel lane to US 29 (see attached). Hopefully this helps. Please let me know if you have any

To follow-up on the email below with respect to DWR mitigation requirements related to isolated wetlands, the
threshold is 1/3 acre for projects west of I-95. That is, any impacts that exceed 1/3 acre will require mitigation. So if
DOT impacts 1.0 acre, mitigation is required on 2/3 of that acre. I had originally stated anything over 1.0 acre but that
pertains to projects east of I-95.

NCDWR does have jurisdiction over WBU Isolated Wetland (Basin). I'm double checking (because of the Rule change),
but if impacts are over 1.0 acre, mitigation at 1:1 will be required.

Hi Linda. Just a few additions to the minutes:
Sheet 7: The stream shown at wetland WBR is also not jurisdictional within the review area. The culvert outlet at the
head of stream SBT should be revisited at 4C to ensure correct alignment.
Sheet 8: although not covered in the meeting, wetland WBU was determined to be isolated, non-jurisdictional for CWA
404 purposes. Note that DWR may still have jurisdiction.
Sheet 19: wetland WBG was added to sheet 19 rather than sheet 20.
Sheet 29: pipe extensions and resulting stream impacts were discussed as part of U-2525C.
Sheet 31: although not covered in the meeting, it appears that the stream impacts due to pipe extension and stream
relocation may have been authorized (as a pipe rather than relocation) by a permit modification for U-2525B dated
7/24/2015. Please confirm with PDEA and Div. 7.
