Site is developed with buildings gravel parking, man made basin, docks, etc. to support existing ongoing commercial fishing
operations participating in trawl boat fisheries like shrimping and scalloping. trawl boats are deep draft vessels drawing as much as 8'.

4. Proposed Activity
Provide a detailed description of the proposed activity including its purpose and include the type of equipment to be used: *
The purpose of this development proposal is to deepen an existing manmade basin to -10.0' below the normal water level (NWL) and
to construct dock work around the basin to support maintenance and preparation of boats owned by Mr. Williams participating in a
variety of trawl fisheries. His vessels draft 6' to 8'. Maintenance activities will pertain to the superstructure of the vessels like
outriggers, winches, cables, pilot house, nets, etc. This area of the Bay River has served as a harbor of refuge for commercial fishing
trawlers for decades and Mr. Williams has docks and buildings that support this existing use. The channel in the Bay River averages
-10.0' below the NWL in this area. The Bay River in this area is designated as SC;Sw;NSW by the Environmental Commission and is
permanently closed to shellfish harvest by Shellfish Sanitation. This area of the Bay River is not designated as a primary nursery area
(PNA) by the Marine Fisheries Commission.
To facilitate trawlers utilizing the existing basin, the applicant proposes to dig from the 10' contour in Bay River an area 30' wide by
130' long into the head of the basin removing an average of -3.0' of muck and clay. An excavator operating from a barge with a spoil
containment structure will be used to undertake the excavation work. Mr. Williams obtained a CAMA/Dredge and Fill General Permit
(GP) 7H.1500 on October 12, 2022 to dig this area to-6.0'and has completed this work. The spoil material for this project will be
loaded directly into a dump truck and hauled to an upland disposal site.
A bulkhead 40' long will be built at the NWL along the northern edge of the basin. Four fender piles will be driven equally spaced
about 1' off the bulkhead to prevent damage to the bulkhead from vessel strikes. The proposed dock work will be elevated
approximately 5' above the existing ground level to facilitate pedestrian access on and off the vessels.

Site 1 impacts are from the proposed dock construction. Site 2 are from the proposed bulkhead construction. An area 20' wide x 40'
will be disturbed to install the bulkhead tiebacks.

la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project.
This site was chosen for the mooring of trawlers because of the existing infrastructure and the associated impacts from the
development of the infrastructure prior to the development of the Neuse River Buffer (NRB) rule. The site was used as a staging area
for commercial fishing operations that has been an ongoing use that existed prior to implementation of the NRB.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
The bulkhead will be structurally tight prior to backfilling activities to prevent seepage of sediment through the bulkhead into adjacent
surface waters. The pilings for the dock will be driven in place to minimize disturbance. The area under the elevated dock will remain
vegetated. Erosion control measures such as flat slopes, vegetated cover within 7 working days and silt fence will be utilized to
prevent the unintentional discharge of sediment into adjacent surface waters.
