Lang,
This email is a follow up to our site visit yesterday. You have removed the temporary crossing and the dewatering
activities are complete at the site. The stream banks have been stabilized with matting but the site will require continued
inspection and potential future maintenance as the stream restores itself throughout the disturbed area. You propose to
leave the downstream rock check dam in the stream to ensure no movement of sediment beyond the project site and the
Division is in agreement with the proposal. It will be necessary to remove the check dam as soon as the local Erosion
Control Program indicates that it is no longer necessary.
The Division intends to document the violations and the resolution in a Notice of Violation however due to the holidays
we will not be able to send the letter out until early January. The NOV will document the violations that occurred and will
also document that you have taken all appropriate measures to restore the stream channel. It will require monitoring
until the site is stable and removal of the rock check dam as soon as feasible. The Division will need to conduct a close out
site visit once the site is stable and the rock check dam is removed. Until then, the NOV will be considered "open" by this
office.
I will touch base with John Thomas in early January to find out what actions/documentation you may need to take with
the USACE in order to leave the rock check dam in while the site is unstable.

Sue,
Many thanks for your time yesterday in reviewing all of this with me and I appreciate your touching base with John to get
his take.
We are all together on this in doing what we need to do and apologize for our misinterpretation of prior experiences over
on the lake side of the project. I now see the differences.
Let me get with Alex and we will get back to all promptly with which way to go with pulling the temporary crossing or
reinstalling one correctly.
I will also touch base with you tomorrow as discussed.

Lang,
I wanted to let you know that I spoke with John Thomas this morning. He informed me that the NW33 (dewatering or
temporary access) requires written approval in all cases. What we may have been confused about is that NW3, used for
maintenance activities, allows for dewatering and doesn't often require written approval. But any work covered under
NW33 always does. Here's a link to the NW33.
What John and I discussed was that if you want to pull everything out of the stream and completely restore it over the
next few days then there's nothing to be done for permitting paperwork. However, neither of us have any concerns with
you keeping a temporary crossing in place provided it is done correctly. If you want to keep the crossing you need to
submit a PCN to us for approval. Since you already have the plans developed for Erosion Control this shouldn't be too
much of a problem but you'll need to submit asap.
We can talk more tomorrow or next week but I wanted to let you know this information right away. This is separate from
whether/how DWR will document the current situation, I'm still working on that.

Streambed
has some unconsolidated material present but will likely flush down to rock check dam and material will
be removed as necessary. Site needs to continue to be inspected and maintained by contractor and
DWR will need to conduct a final inspection once site is stable.
