(SEGO has been retained by Hoosier Daddy, LLC (herein referred to as "Applicant") to submit the attached Pre -construction Notification and accompanying appendices (see Attachment 1), for the Oyster Landing Subdivision, in Sneads Ferry, Onslow County, North Carolina. In 2011, the US Army Corps of Engineers (USACE) issued Nationwide Permits 29 and 12 and the Division of Water Resources (DWR) issued General Certifications 3821 and 3819. These permits were necessary to complete the development of the subdivision, as previous authorizations had expired prior to all the impacts taking place. These permits authorized the permanent impact of 0.494 -acre of non -riparian wetlands and the conversion of 1.12 -acres of forested to herbaceous non -riparian wetland. Compensatory mitigation, in the form of payment to the Hofmann Forest Wetland Mitigation Bank, for 1.614 -acres of non -riparian wetland restoration credit, as well as recordation of the Declaration of Restrictive Covenants within the subdivisions Restrictive covenants and Deed Restrictions, was a component of these permits. Since that time, 0.19 -acre (i.e. Impact Areas 2, 3A, 313, 3C, 4 and 5) of the originally authorized impacts has taken place and the payment to the Hofmann Forest Wetland mitigation bank was fulfilled (see Attachments 2 and 3 respectively). In 2014, the property was acquired by the Applicant. While the road design has not changed, the Applicant revised the layout of the lots, making it a high density stormwater project, and intends to phase the development. The next two phases (i.e. Phases 11 and 111) will consist of installing infrastructure and utilities to serve 96 single family dwellings. A single, temporary, wetland impact, for the purpose of installing a stormwater pipe, is necessary to complete these two phases. This impact was previously authorized as an access easement, but those authorizations have expired and, due to the fact that the previous property owner(s) failed to record the Declaration of Restrictive Covenants and deed restrictions, the project is in non-compliance. With that being said, the Applicant is seeking the USACE's and DWR's approval to temporarily impact 0.03 -acre (1,251 square feet) of non -riparian wetland and remove the preservation and deed notification requirements as a mitigation condition of past and future authorizations. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Wetland impacts were avoided to the greatest extent possible during the planning process. Wetland fill is only proposed for portions of roadways where no route through upland is possible. In addition, roadways were built not to exceed the minimum DOT standard width. The proposed locations of structures have been designed to minimize impacts to jurisdictional wetlands, while meeting the requirements of local setbacks and DOT standards. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Sediment and erosion control and stormwater measures will be in place, prior to land disturbing activities. This will ensure that the adjacent unnamed tributary will be protected from sediment and pollutant filled stormwater runoff from the site and off the adjacent highway. 2.
