Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9,1994 (or as subsequently amended). As a result of public concern regarding protection of Lake Norman for swimming, the following actions are required upon expansion of flow or renewal of the permit: ❖ Prior to the submitting a request for an Authorization to Construct, the permittee is required to submit a Flow Expansion Report consistent with the requirements of Special Condition A. (3). If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. SPECIAL CONDITION — Flow Expansion Request Concurrent with any application for an Authorization to Construct that results in a flow expansion, the permittee shall submit an updated flow justification and permit compliance review. a) The flow justification shall include at least the following. 1. Provide Basic Identification of the Project ■ Facility name ■ County ■ Facility address ■ Facility telephone number ■ Preparer's name ■ Preparer's mailing address and telephone number 2. Provide a detailed description of the project requiring an expansion of wastewater disposal. The wastewater flows should be calculated according to 15A NCAC 2H .0219. Demonstrate and justify the need for flow volumes, to include any flow reductions realized through flow -restricting devices. The use of flow - restricting or low -flow devices should be investigated. Report findings should include flow reduction projections. Updated plat maps, a time schedule for connection, and documentation of commitments shall be required. 3. If existing facilities will be used as part of an expansion, discuss those existing units including present and past performance, unit capacities, and inadequacies of each. Include a schematic with component sizes. 4. Indicate if the project will be constructed in phases. Provide the estimated wasteflow per phase. Indicate current phase status for existing facilities and provide a schedule for constructing each additional phase. b) The compliance review report shall summarize the performance of the treatment works or collection system and state the extent to which any terms of its permit, federal laws, or any State laws, regulations or rules related to the protection of water quality have been violated. Killian Crossroads W WTP's NPDES permit has expired and they have requested renewal of their permit. The Division of Water Quality's NPDES Unit issues the permits for individually permitted facilities, and determines the conditions that must be achieved prior to discharging wastewater. This face sheet summarizes the rationale used to determine permit limits and conditions. Heater Utilities owns and operates a 0.05 MGD wastewater treatment system in Catawba County. Prior to Heater Utility's management, there were chronic compliance problems associated with the facility. Under Heater Utilities operation, the facility has not been issued any NOVs or civil assessments, indicating that compliance has improved. This is a phased permit with a build out permitted flow of 0.075 MGD. According to the region, this area is fairly undeveloped and the 0.075 MGD flow is justified. Thus far in 2000, the facility has averaged 0.0228 MGD or 45.6% of the currently permitted flow rate. There is one discharger (Cross Country Campground) approximately 0.7 miles upstream of Killian Crossroads that also discharges to Reed Creek. It is recommended that Cross County approach Heater Utilities for possible connection to the Killian Crossroads WWTP. Residuals are removed as needed by Roberts Septic Service for disposal at the City of Newton WWTP. The limits imposed on the discharge are based on the management strategy for Lake Norman dischargers (15-BOD/4-ammonia). Additional limitations include a limit for MBAS, oil & grease, total residual chlorine, TSS, dissolved oxygen, and pH. Aside from the standard boilerplate conditions the permit contained a condition requiring the facility to submit plans and specifications for the expansion upon reaching 80% of the permitted flow. Proposed Changes It is recommended that in -stream fecal coliform monitoring continue to be required on a monthly basis. Division policy for dischargers of 100% domestic wastewater is removal of in - stream monitoring for fecal coliform and conductivity. The in -stream data indicated that the fecal counts in the receiving stream average close to 200/100 MI. The difference between the upstream and the downstream fecal counts is small. The data does not suggest that the discharger is contributing fecal coliforms in the stream. Since fecal counts are averaging close to the state standard it is recommended that the facility be required to continue in -stream fecal monitoring and that the monitoring frequency be modified to monthly. It is recommended that in -stream conductivity monitoring be deleted as a condition for the permit. In -stream conductivity monitoring appeared normal, therefore it is recommended that the conductivity monitoring be removed from the permit according to current division procedure for 100% domestic dischargers. Removal of in -stream TN and TP monitoring. The current permit only required the monitoring through August 1998. Modeling staff indicated that there was no need to require additional TN and TP monitoring in -stream. Therefore, TN and TP in -stream monitoring shall be removed from the permit. The facility shall continue to monitor TN and TP in the effluent from the facility. The special condition requiring the facility submit plans and specifications for expansion upon reaching 80% of the current 0.05MGD flow limit has been removed. The reason for this special condition could not be established. It is the responsibility of the permittee to ensure that they Fact Sheet NPDES Renewal Page 2 do not exceed the permitted flow. In the event that the flow limit is violated, the facility would be subject to enforcement from the Division. There are other mechanisms and controls in place to ensure that the facility has the proper treatment at a particular flow, it is not necessary to place this special condition in the permit. MBAS — the reasonable potential was conducted with available data from July 1999 through September 2000. Data from prior to July 1999 reflects Mid South Utilities operation of the facility, therefore, no data prior to this time was used in the reasonable potential analysis. The reasonable potential analysis results indicated that there is no reasonable potential for the discharge to cause a violation of the stream standard. Therefore, it is recommended that the limit for MBAS be removed from the permit. MBAS monitoring remains as a condition for the facility. The self -monitoring data indicated that MBAS might be present in the effluent. Though there is not reasonable potential that the discharge will cause a violation of the stream standard, the presents of MBAS should be monitored. Current Stream Conditions The receiving stream is Lake Norman (Reed Creek). The discharge is at the mouth of Reed Creek where it empties into Lake Norman. Lake Norman at the point of discharge is a class WS-IV & B water in the Catawba River Basin. Lake Norman (Reed Creek) is not listed on the state's 303(d) list and has been rated as 'supporting' its designated uses. DWQ sampled Lake Norman in 1981, 1982, 1983, 1986, and 1992. In 1982,1986 and 1992 the lake received an oligotrophic rating. According to the information presented in the basin plan and the use support rating, water quality in the receiving water is generally good. Instream Monitoring No instream monitoring is currently required'. No instream monitoring is recommended during this permit cycle. Compliance Summary: (see Appendix B) As noted above, under the ownership of Mid South Utilities Killian Crossroads had chronic compliance problems. Since ownership was transferred to Heater Utilities compliance at the facility is improved. Under Heater Utilities operation there are no documented violations of permit limits.
