Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: * The approximately 0.77-acre project corridor is located generally east of downtown Wake Forest in Wake County, NC. The project corridor currently exists as a maintained roadway corridor with pockets of forested area on both sides. The project vicinity is primarily composed of single-family residential neighborhoods to the west of the Wake Forest Reservoir. 4b. Explain the purpose of the proposed project:* The purpose of the proposed project is to replace two existing, failing culverts carrying Dunn Creek north to south, perpendicular to East Juniper Ave in Wake Forest, Wake County, NC. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: * The project proposes to replace and extend the two failing, corrugated metal pipe (CMP) culverts that currently exists under East Juniper Avenue with two 8' wide by 6' tall reinforced concrete box culverts, embedded one foot into the channel of Dunn Creek (Hatters Branch). The proposed project is necessary to relieve the failing infrastructure of the two existing culverts and to limit the number of overtopping events ultimately to prevent future erosion and improve safety of the roadway crossing. Additionally, the Town is proposing roadway improvements including the addition of curb and gutter, as well as a 5' grass strip and 10' wide multi -use path (MUP) to improve pedestrian safety along the northern and southern sides of East Juniper Avenue. The proposed Multi -Use Path (MUP) will be connected to the existing Dunn Creek Greenway intersecting the project corridor. Construction equipment typical of infrastructure projects will be utilized including bulldozers, excavators, graders, dump trucks, concrete trucks, and pavers. 5. Jurisdictional Determinations 5a. Comments: Impacts to streams and protected riparian buffers have been avoided and minimized to the extent practicable. At Impact Site 1, a total of 36 LF (0.01 acre) of permanent stream impacts and 46 LF (0.008 acre) of permanent -no net loss (P-NNL) stream impacts to Dunn Creek (Hatters Branch) within the project corridor as a result of the replacement and extension of the existing, failing culverts and associated keyed -in rip rap inlet and outlet to the channel and banks. The associated riprap will provide bank stabilization and help prevent future erosion. The new culverts will be buried a minimum of 1 foot and will allow for natural flow and movement of aquatic species. Additionally, a total of 16 LF (0.003 acre) of temporary stream impacts would result from the proposed project to facilitate the construction access necessary to install the proposed culverts and rip rap and for temporary dewatering to allow for work in the dry. 6. Additionally, a total of 411 square feet of temporary impacts to buffer zone 1 and 200 square feet of temporary impacts to buffer zone 2 of Dunn Creek (Hatters Branch) will result from the construction access necessary to install the proposed culverts and riprap, and to construct the proposed Iv1UPs. E. Impact Justification and Mitigation 1. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: The proposed project has been designed to minimize impacts to jurisdictional features to the extent practicable. Dunn Creek (Hatters Branch) will be diverted using a 15 foot temporary drainage pipe outlet into a diversion channel with the aid of impervious dikes to allow for work in the dry. The projects culvert replacement is necessary in order to limit overtopping events due to the failing drainage infrastructure and to spatially accommodate the headwalls and wing walls being installed to enhance slope and channel stability around the culvert outlet and inlets, as well as reduce stream and riparian buffer impacts. Additionally, rip rap stabilization at the proposed culvert inlet and outlet have been sized to avoid erosive flow through the pipe and channelization of the stream. The new culverts would allow full conveyance of the 25-year event without roadway overtopping. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Impacts to streams and riparian buffers within the project corridor will be minimized throughout the construction process by avoiding these features with equipment, materials, and access corridors where practicable. Where feasible, staging and construction access routes will be located in upland areas throughout the project corridor. Silt fencing will be installed as part of the standard BMP and in accordance with the erosion control plan sheets. Temporary sediment control measures will be used to reduce stormwater impacts to receiving waters and minimize runoff from the construction sites. During the construction process, a stream diversion operation sized by ordinary daily flow will be used to allow for in -stream and channel repair work in the dry. O 2. What data sources did you use to determine whether your site would impact Endangered Species or Designated Critical Habitat? As of April 1, 2024, the US Fish and Wildlife Service (USFWS) Information for Planning and Consulting (IPaC) tool lists the red -cockaded woodpecker, Neuse River waterdog, Carolina madtom, Atlantic pigtoe, dwarf wedgemussel, and Michaux's sumac, with potential to occur within the project vicinity. IPaC also lists the tricolored bat (Perimyotis subfiavus), a proposed endangered species, and the bald eagle (Haliaeetus leucocephalus), which is protected under the Bald and Golden Eagle Protection Act, with potential to occur within the project vicinity. A review of the NC Natural Heritage Program (NCNHP) element occurrence database (updated January 2024) identified no known occurrences of any federally listed species in or within 1.0 mile of the project corridor. Red -cockaded Woodpecker (RCW) Suitable habitat for the red -cockaded woodpecker is not present within the project corridor. Forested areas within the study area are mostly composed of hardwoods and immature pines that are dense, overgrown with invasives, and fragmented. In addition, a review of the NCNHP database records (updated January 2024) indicates there are no known occurrences of RCW in or within 1.0 mile of the project corridor. Due to lack of suitable habitat and the lack of known occurrences, it has been determined that the proposed project would have "No Effect" on RCW. Aquatic Species Suitable habitat for the Neuse River waterdog, Carolina madtom, Atlantic pigtoe, and dwarf wedgemussel, is present within Dunn Creek (Hatters Branch) in the project corridor. A review of the NCNHP database records (updated January 2024) indicates there are no known occurrences of any of the federally listed aquatic species listed above in or within 1.0 mile of the project corridor. According to the NCNHP records, the nearest known population of Neuse River waterdog is located approximately 6 river miles downstream from the project corridor in the Neuse River. The nearest known population of Carolina madtom is located approximately 12 river miles downstream from the project corridor in the Neuse River. The nearest known population of Atlantic pigtoe is located approximately 20 river miles downstream from the project corridor in Walnut Creek. The nearest known population of dwarf wedgemussel is located approximately 17 river miles downstream from the project corridor in the Neuse River. Due to the lack of known occurrences and the distance from the project corridor to the nearest known population, no direct impacts to the aquatic species listed above are anticipated. However, due to the presence of suitable habitat in the project corridor, the biological conclusion for Neuse River waterdog, Carolina madtom, Atlantic pigtoe, and dwarf wedgemussel for the proposed project is "May Affect, Not Likely to Adversely Affect". Michaux's Sumac Suitable habitat for Michaux's sumac is present within the project corridor along the roadside corridors within the project corridor. Although potentially suitable habitat is present, the regular mowing maintenance schedule and herbicide application observed within these areas would likely inhibit the plant's success. Kimley-Horn biologists conducted pedestrian surveys for Michaux's sumac within areas of suitable habitat on August 9, 2023, and no individuals were observed. In addition, a review of the NCNHP database records (updated January 2024) indicates there are no known occurrences of Michaux's sumac in or within 1.0 mile of the project corridor. Due to the lack of known occurrences and the lack of observed individuals, it has been determined that the proposed project will have "No Effect" on Michaux's sumac. Tricolored Bat The tricolored bat is currently proposed for listing and is not currently protected under the Endangered Species Act (ESA). A review of the NCNHP database records (updated January 2024) indicates that there are no known occurrences of the tricolored bat in or within 1.0 mile of the project study area. If listed prior to construction of the project, the Town of Wake Forest will coordinate with the USFWS as appropriate to resolve Section 7 for the tricolored bat. Bald Eagle Habitat for the bald eagle primarily consists of mature forest in proximity to large bodies of open water for foraging. Large dominant trees are utilized for nesting sites, typically within 1.0 mile of open water. A desktop-GIS assessment of the project study area, as well as the area within a 1.13-mile radius (1.0 mile plus 660 feet) of the project limits, was performed in January 2024 using 2021 color aerials. Multiple water bodies large enough or sufficiently open to be considered potential feeding sources were identified. Kimley-Horn biologists conducted pedestrian surveys for the bald eagle within the project study area and within the 1.13-mile radius on January 24, 2024, and no individuals were observed. Additionally, a review of the NCNHP database records (updated January 2024) indicates there are no known occurrences of the bald eagle within 1.0 mile of the project corridor. Due to the lack of habitat and the lack of known occurrences, it has been determined that this project will not affect the bald eagle. 6. Essential Fish Habitat (Corps Requirement) 6a. Will this project occur in or near an area designated as an Essential Fish Habitat? * Yes No 6b. What data sources did you use to determine whether your site would impact an Essential Fish Habitat? The NOAA Essential Fish Habitat Mapper was reviewed on April 1, 2024. No essential fish habitat was found within the project corridor or within the project vicinity 7. Historic or Prehistoric Cultural Resources (Corps Requirement) 7a. Will this project occur in or near an area that the state, federal or tribal governments have designated as having historic or cultural preservation status? Yes No 7b. What data sources did you use to determine whether your site would impact historic or archeological resources? * Kimley-Horn conducted a desktop-GIS assessment of the project corridor on April 1, 2024, using the North Carolina State Historic Preservation Office (NCSHPO) HPOWEB GIS Service database. This assessment was undertaken in order to identify any known National Register (NR), National Register Study List (SL), and Determined to be Eligible (DOE) for listing properties or historic districts in or within 1.0 mile of the project corridor. No known historic or cultural resources were identified within the project corridor. However, seven historical and cultural resources were identified within 1.0 mile of the project corridor: Royall Cotton Mill Commissary (NR) - located approximately 0.81 mile northwest of the project corridor W.E.B. DuBois School (NR) - located approximately 0.65 mile northwest of the project corridor Glen Royall Mill Village Historic District (NRHD) - located approximately 0.89 mile northwest of the project corridor Dr. Calvin Jones House (NR) - located approximately 0.96 mile west of the project corridor Raleigh & Gaston Rail Corridor (DOE) - located approximately 0.72 mile northwest of the project corridor Olive Branch Baptist Church (SL) - located approximately 0.84 mile west of the project corridor Wake Forest Historic District (NR) - located approximately 0.92 mile northwest of the project corridor 73 other historical and cultural resources currently listed as "Blockface", "Survey Only", "Surveyed Only, Gone", and "Surveyed Area", were identified within 1.0 mile of the project corridor. Due to the listing status, these resources do not currently receive protection under the National Historic Preservation Act. If the listing status changes to NR, SL, or DOE prior to construction, the potential for impacts to these resources may need to be re- evaluated; however, due to the distance from the project corridor and the existing uses within the vicinity of the project corridor, it is assumed that the proposed project will have no effect on these 'Survey Only' resources. Due to the lack of known historic and cultural resources within the project corridor and the distance from any known historic and cultural resources, as indicated by the NCSHPO HPOWEB GIS Database (accessed April 2024), it is anticipated that the proposed project will not have a direct impact on any known NR, SL, or DOE resources. 8. Flood Zone Designation (Corps Requirement) 8a. Will this project occur in a FEMA-designated 100-year floodplain? * Yes No 8b. If yes, explain how project meets FEMA requirements: Kimley-Horn has completed a HEC-RAS analysis to evaluate the impacts of the proposed culverts under East Juniper Avenue. The FEMA preliminary model and peak flow discharges for Dunn Creek (Hatters Branch) were used as the base model for this analysis. It was determined that the proposed project would not result in any increase water surface elevations during the base flood event.
