Page Two 9. PROJECT DESCRIPTION The project site is located at 25 Backfin Point, adjacent to Banks Channel, in Wilmington, New Hanover County. According to the application, the riparian parcel located at 25 Backfin Point has a maximum elevation of approximately 4' above normal high water (NHW) and is approximately 20,000 sg.ft. (0.46 acres). The lot has an existing single-family home with a private docking facility that can accommodate up to two (2) vessels. The high ground consists primarily of ornamental landscaping and maintained lawn grasses. The adjacent riparian parcel to the southeast is riparian to Banks Channel and has an existing single-family home with a private docking facility and a bulkhead. The adjacent riparian parcel to the southwest is riparian to a canal off Banks Channel and has an existing single-family home with a private docking facility and bulkhead. The project site has approximately 360' of shoreline frontage, currently stabilized by a bulkhead that approximates NHW. There is an approximately 22' wide area of Coastal Wetlands that primarily consists of Smooth Cordgrass (Spartina alfemiflora) located directly waterward of the existing bulkhead. The Coastal Wetlands border the entire length of the existing bulkhead. The applicant currently maintains a private docking facility that has a fixed pier, that measures approximately 42' long x 6' wide, that terminates to an uncovered fixed platform. The fixed platform measures approximately 18' long x 10' wide and has an access ramp that leads to a floating dock. The floating dock measures approximately 30' long x 8' wide and is oriented parallel to the shoreline. On the west side of the 30' x 8' floating dock, there is another floating dock that is oriented perpendicular to the 30' x 8' floating dock. The second floating dock measures approximately 16' long x 8' wide. In the waterward slip of the 16' x 8' floating dock there is a 13' long x 13' wide boat lift, DCM was unable to find previous permitting history for the existing docking facility, however, according to aerial photography, it appears that the facility was constructed sometime prior to 1993. The New Hanover County Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Residential. The adjacent waters of Banks Channel in the project area are classified SA;ORW by the Division of Water Resources and this area is NOT designated as Primary Nursery Area (PNA) by the N,C. Division of Marine Fisheries. They are OPEN to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to construct a new docking facility with a fixed pier and platform, five (5) floating docks, and two (2) boat lifts, for a total of six (6) boat slips, The applicant proposes to construct a fixed pier, measuring approximately 38' long x 6' wide, perpendicular to the existing bulkhead. The fixed pier would cross over approximately 23 linear feet of Coastal Wetlands. The fixed pier would be located approximately 150 linear feet from each riparian line (see Drawing 2 of 3). The fixed pier would terminate to an uncovered, fixed 1-head" platform that would measure approximately 16' long x 12' wide. The "L-head" platform would be oriented parallel to the shoreline facing west (see Drawing 2 of 3). From the "L-head" platform, the applicant proposes an approximately 16' long x 3' wide access ramp that would lead to the proposed floating docks. The access ramp would be located to be in �.,. The main proposed floating dock would measure approximately 48' long x 8' wide and would be oriented parallel to the shoreline. Approximately 17' of the main floating dock would extend to the east of the access ramp and approximately 31' would extend to the west of the access ramp. At the west and east ends of the main floating dock, the applicant is proposing to install smaller floating docks that would measure approximately 16' long x 6' wide. These smaller floating docks would be oriented perpendicular to the main floating dock. Both 16' x 6' floating docks would have an approximately 13' long x 13' wide boat lift installed within the waterward slip, resulting in two (2) boat slips (see Drawing 2 of 3). The applicant is also proposing two (2) 20' long x 6' wide floating docks that would extend perpendicularly into Banks Channel from the main floating dock. The 20' x 6' floating docks would be located approximately 22' apart on the main floating dock and would result in a total of four (4) boat slips (see Drawing 2 of 3). The total number of proposed boat slips for the new docking facility would be six (6) boat slips that would be for the applicant's use only (see Narrative). The proposed docking facility would extend approximately 52' into Banks Channel and would not exceed the %4 width of the waterbody. As proposed, the docking facility shall not encroach into either adjacent 15' riparian setback and the water depths in the proposed footprint range from approximately -3.0' to -6.0' at Normal Low Water (NLW). 10. ANTICIPATED IMPACTS The proposed new docking facility would result in the shading and incorporation of a maximum of 1,436 sq,ft. of Estuarine Waters and Public Trust Area. The proposed docking facility would result in the shading of approximately 138 sq.ft. of Coastal Wetlands, consisting primarily of Smooth Cordgrass (Sparfina alterniflora), The proposed structure would not encroach into either 15' riparian corridor setback, would not exceed the % width of the waterbody, and would meet the 8 sq.ft. platform rule. It was received as complete on March 22, 2024 and appears to be adequate for processing at this time. The projected deadline for making a decision is June 5, 2024. An additional 75- day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. If this agency does not render a permit decision within 70 days from June 5, 2024, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of- way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application.
