A review of the December 2023 and January 2024 monthly reports for the subject facility revealed the
violation(s) indicated below:

Permit conditions violation 1/31/2024 failure to notify of freeboard violations
Per Permit Condition IV.13.d. the Permittee shall report to the Winston Salem Regional Office within 24 hours of
first knowledge of any time self -monitoring indicates the facility has gone out of compliance with its permit
limitations. A review of the December 2023 and January 2024 Non -Discharge Application Report (NDAR) shows
that the storage pond was out of compliance with the required freeboard of two (2) feet during both months. A
review of available records shows that no non-compliance notification was received by this office.

Please be aware that all non-compliance notifications as described in Permit Condition IV.13 noted
above should be reported to this office within 24 hours of first knowledge.
Remedial actions, if not already implemented, should be taken to correct any noted problems. The Division of
Water Resources may pursue enforcement actions for this and any additional violations. If the violations are of a
continuing nature, not related to operation and/or maintenance problems, and/or you anticipate remedial
construction activities, then please submit this information to our office within fifteen (15) days of receipt of this
notice.
