Subject: REQUEST FOR ADDITIONAL INFORMATION
Creeks Landing
Dear Mr. McCall:
On November 6, 2015, the Division of Water Resources (Division) received your application
dated November 3, 2015, requesting a 401 Water Quality Certification from the Division for the
subject project. The Division has determined that your application is incomplete and cannot be
processed. The application is on -hold until all of the following information is received:
1. Storm Water Management Plan per condition #12 of General Certification 3890 must be
submitted and approved by DWR prior to issuance of the 401.
Clarification of impacts. It is stated that 15 If of stream will be lost during the relocation
of 140 If of stream channel. It is also stated that 9 If of rip rap is not included in the
impacts/loss of stream. Is the 9 If not included at all or is it included with the culvert
impact?
3. A stream relocation plan/restoration plan is required indicating the proposed method of
construction. (Condition #11, GC 3890)
Pursuant to Title 15A NCAC 02H .0502(a) 8 / Title 15A NCAC 02H .506, the applicant shall furnish
all of the above requested information for the proper consideration of the application. If all of
the requested information is not received in writing within 30 calendar days of receipt of this
letter, the Division will be unable to approve the application and it will be returned. The return
of this project will necessitate reapplication to the Division for approval, including a complete
application package and the appropriate fee.

Please respond in writing within 30 calendar days of receipt of this letter by submitting
stormwater management plan for review to the 401 & Buffer Permitting Unit, 1617 Mail Service
Center, Raleigh, NC 27699-1617. Please copy the Mooresville Regional Office regarding items #1
and #2.
Please be aware that you have no authorization under the Section 401 of the Clean Water Act
for this activity and any work done within waters of the state may be a violation of North
Carolina General Statutes and Administrative Code.
