Thank you for the follow up information regarding the "ditch feature".
For project #1, since there are no instream activities and no 401 is required, you are not required to file a
30-day pre -file notice, therefore you can apply for the buffer authorization for this project at any time.
In reviewing the project plans and the Neuse Buffer Table of Uses, it appears that the project may fit under
the SCM item in the Table of Uses. The SCM would need to meet the definition provided in 15A NCAC 02H
.1002. We strongly recommend that the impacts be minimized to Zone 2 only and Zone 1 remains
undisturbed, however the buffer rules do allow installation of SCMs in Zone 1 however that would trigger a
requirement for mitigation to be provided for all Zone 1 impacts.
If the wetland proposed would not qualify as an SCM as defined in 02H .1002 then I don't see where the
project would fit in the Table of Uses and it would require a Buffer Authorization with Exception. The
Exception process is more stringent and mitigation would be required for all impacts, Zone 1 and Zone 2
impacts.
