Thank you for getting back to us!
We actually had this discussion with Sue Homewood (Zach was CCed) back in March of last year, and she determined
that the 401 was not necessary. I've attached her email, and the excerpt of interest is "...there are no instream activities
and no 401 is required, you are not required to file a 30-day pre -file notice, therefore you can apply for the buffer
authorization for this project at any time."
The purpose of this email at the time was modifying our project footprint to extend only into Buffer Zone 2 and avoid
Buffer Zone 1 altogether.

I have no problem with the buffer impacts, but since you have a small wetland impact that required a Nationwide 18
Permit from the Corps of Engineers, you will also likely need to get a 401 Water Quality Certification from this
office. It's the same application (Pre -Construction Notification) that you submitted to the Corps of Engineers, and the
buffer impacts can also be included in that one application. Zach will be back in the office tomorrow, so I'd like to see
how he wants to handle authorizing this project. Again, we support the project but just need to make sure we
authorize it appropriately.

Thank you for reviewing our buffer authorization request for our wetland project in Wilson. I understand from Sheri
Montalvo that you have a 60-day window to complete the review.
I know our construction contractor is very anxious after months of prior delays at other points in the project, so I want
to at least ask: Is there any way to know where we are in the queue? Or is there any way to request for an expedited
process?
Our understanding after having already navigated the Army Corps permit, DEQ Erosion & Sediment Control permit
processes and based on a conversation with Sue Homewood of DENR is that this approval should be relatively simple.
I completely understand if there's no way to know, but anything I can communicate to the contractor would be
extremely helpful for logistical and planning purposes.
Please also feel free to reach out to me or Tiffanie directly if you have any questions on what we are proposing to do.
