Dear Mr. Raper:
The subject Special Order by Consent WQ S22-003 (SOC) contains terms and conditions agreed to by the Town of
Siler City and the North Carolina Environmental Management Commission that were established to promote the
Siler City WTP's expedited return to consistent compliance with applicable environmental laws, rules and/or permit
conditions. The SOC includes an enforceable compliance schedule and provision for the assessment of stipulated
penalties when SOC terms and conditions are not met.
Section 2. (a) of the SOC requires the Town of Siler City to have completed the following Scheduled Activity by
February 1, 2024: begin construction of WTP Solids Handling Improvements. The Division of Water Resources
(DWR) did not receive a due date extension request from the permittee for the aforementioned activity. According
to correspondences with the permittee, the begin construction of WTP Solids Handling Improvements
Scheduled Activity was not completed by the due date of February 1, 2024, therefore the Town of
Siler City is in violation of Section 2. (a) of SOC WQ S22-003.
Section 5. (c) of the SOC stipulates the following penalties for failure to complete a Scheduled Activity by the
assigned due date: $1,000 per day for the first seven (7) calendar days and $2,000 per day thereafter.
If you have information that will prove to DWR that any or all of the criteria set forth in Section 2 (a.) were met by
the due date of February 1, 2024, this information must be submitted in writing to the Raleigh Regional Office
within ten (10) days after your receipt of this notice. In the absence of evidence justifying the application of the
provisions within the SOC, DWR may proceed with assessment of stipulated penalties as provided for in Section 5.
(c) of the SOC.
