Dear Mr. Raper:
The subject Special Order by Consent WQ S22-003 (SOC) contains terms and conditions agreed to by the Town of
Siler City and the North Carolina Environmental Management Commission that were established to promote the
Siler City Collection System's expedited return to consistent compliance with applicable environmental laws, rules
and/or permit conditions. The SOC includes an enforceable compliance schedule and provision for the assessment
of stipulated penalties when SOC terms and conditions are not met.
Section 2. (a) of the SOC requires the Town of Siler City to have completed the following Scheduled Activity by
December 30, 2023: Award Construction Contract for Main Interceptor Replacement Project. At the request of the
permittee, the due date for the aforementioned Scheduled Activity was extended to March 29, 2024. Pursuant to
Section 2. (c) of the SOC, an extension will only be granted on a one-time basis per Scheduled Activity. According
to correspondences with the permittee, the Award Construction Contract for Main Interceptor
Replacement Project Scheduled Activity was not completed by the extended due date of March 29,
2023, therefore the Town of Siler City is in violation of Section 2. (a) of SOC WQ S22-003.
Section 5. (c) of the SOC stipulates the following penalties for failure to complete a Scheduled Activity by the
assigned due date: $1,000 per day for the first seven (7) calendar days and $2,000 per day thereafter.
If you have information that will prove to the Division of Water Resources (DWR) that any or all of the criteria set
forth in Section 2 (a.) were met by the extended due date of March 29, 2024, this information must be submitted
in writing to the Raleigh Regional Office within ten (10) days after your receipt of this notice. In the absence of
evidence justifying the application of the provisions within the SOC, DWR may proceed with assessment of stipulated
penalties as provided for in Section 5. (c) of the SOC.
