I have a site in the Estates of Lissara subdivision off of Conrad Rd in Lewisville. The address is 909 Limber Lost Ln (PIN #5876-23-3357.00). They are building a long driveway and a single family home. We do have an erosion control plan and a grading permit for the activity. There is a stream crossing in the driveway. According to our erosion plans, the crossing is to be a no -impact bottomless culvert with segmental block headwalls. At the time I met for the pre -construction meeting last Wednesday (12/9), they had already gotten started on the driveway and stream crossing. They have filled the upstream portion of the stream with dirt to dam up the stream above their work area (see attached pictures). The way there doing the crossing just don't appear to be right and I thought it could be possible water quality violations. Please let me know if you need any more information. He informed me that the NW33 (dewatering or temporary access) requires written approval in all cases. What we may have been confused about is that NW3, used for maintenance activities, allows for dewatering and doesn't often require written approval. But any work covered under NW33 always does. Here's a link to the NW33. What John and I discussed was that if you want to pull everything out of the stream and completely restore it over the next few days then there's nothing to be done for permitting paperwork. However, neither of us have any concerns with you keeping a temporary crossing in place provided it is done correctly. If you want to keep the crossing you need to submit a PCN to us for approval. Since you already have the plans developed for Erosion Control this shouldn't be too much of a problem but you'll need to submit asap. We can talk more tomorrow or next week but I wanted to let you know this information right away. This is separate from whether/how DWR will document the current situation, I'm still working on that.
