NCDOT Division 5 submitted a permit application for this project on August 11, 2014. The NCDENR-DWR issued 401
Water Quality Certification and Jordan Buffer Rules (NCDENR-DWR Project No.: 20140863) on August 21, 2014. The
USACE issued Nationwide Permit 3(USACE Action ID No.: SAW-2014-0204) on November 6, 2014. The Department has
recently determined that there are utility lines that will need to be relocated as part of this project in a two new
Permanent Utility Easements. The utility relocations will result in additional wetland and riparian buffer impacts not
authorized in permits previously issued by your Agency. Note the following:
Wetland impacts:
-There will be an additional 0.01 ac of inechanized clearing in wetland impacts associated with relocation of a guy wire in
the wetland in a PUE.

As noted above, these new additional impacts are associated with relocation of an existing utility line. My review of
Nationwide Permit No. 14 and NCDENR-DWR Water Quality Certification 3886 appear to indicate that these new minor
wetland and riparian buffer impacts can be authorized without additional notification. Please review this information
and let me know if you agree with my assessment.
I am attaching a revised permit drawing package that includes new impacts addressed in this email.
