Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended.) d� A public hearing on the renewal of the NPDES permit for Pace Mobile Home Park and nine tSt`� other dischargers was held on May 29, 2003. Because compliance with permit limits has been poor i at times in the past, Pace MHP must optimize treatment system performance. The Division may 't require a facilities assessment and/or engineering alternatives analysis if the discharge does not a meet�ermit limits more consistently. If it is determined to be necessary, the assessment would: �°poQ ��(•5 Describe deficiencies and operational difficulties in the existing collection system and treatment �g N facility that affect performance or permit compliance, and ypv r� Identify potential improvements to improve performance/ compliance, ll4� Estimate the cost of implementing those improvements, and El Provide a schedule for their implementation. c The alternatives analysis would evaluate, in particular, the feasibility of connecting to one of the publicly owned wastewater utilities in the area. �p1t This permit authorizes Pace Mobile Home Park to discharge up to 15,000 GPD of treated wastewater to the unnamed tributary (UT) to Buffalo Creek, a class C NSW water in the Neuse River Basin. The permit includes discharge requirements for flow, biochemical oxygen demand (BOD), total suspended residue (MR), ammonia, fecal coliform bacteria, total residual chlorine, total nitrogen, total phosphorus and pH. The fmal permit includes the following modifications to your current permit: • Pace MHP must install and maintain a sign identifying the wastewater discharge outfall. Please note Special Condition A (4.) of the permit. Summer and winter daily maximum limits for ammonia nitrogen have been added to reflect the Division's current policy. According to the Code of Federal Regulations [40 CFR 122.45 (d)], continuous discharges "shall unless impracticable be stated as maximum daily and average monthly discharge limitations for all dischargers other than publicly owned treatment works...". The daily maximum limit is established based on a ratio of 5:1 (daily maximum: monthly average) for non -municipal dischargers. The TRC limit shall become effective upon completion of the installation of a disinfection system but no later than January 1, 2006. Note that you are already collecting these data and the permit now specifies that you must report these parameters separately on your Discharge Monitoring Reports (DMRs). This is a requirement for all facilities discharging in the Neuse River Basin. The design flow of the treatment system has been corrected to 0.015 MGD on the supplement to cover page If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. For a given wastewater sample, TN = TKN + NO3-N + NO2-N, where TN is Total Nitrogen, TKN is Total Kjeldahl Nitrogen, and NO3-N and NO2-N are Nitrate and Nitrite Nitrogen, respectively. 6. TN Load is the mass quantity of Total Nitrogen discharged in a given period of time (see A. (3)). There shall be no discharge of floating solids or visible foam in other than trace amounts. A. (2) TOTAL RESIDUAL CHLO ^� t' The limit for total residual chlorine all become effective upon completion of the installation of a disinfection system but no late an 18 months from the issuance of the permit (January 1, 2006). If a method different than ch orination/dechlorination is used, the total residual chlorine limit will not be applicable. Permit Number: NCO064246 A. (3) CALCULATION OF TOTAL NITROGEN (TN) LOADS a. The Permittee shall calculate the monthly and annual TN loads as follows: R) Monthly TN Load (pounds/month) = TN x TMF x 8.34 where: TN = average TN concentration (mg/L) of the grab samples collected during the month TMF = total monthly flow of wastewater discharged during the month (MG/mo) 8.34 = conversion factor, from (mg/L x MG) to pounds (H) Annual TN Load (pounds/year) = Sum of the 12 Monthly TN Loads for the calendar year b. The Permittee shall report monthly total nitrogen results (mg/L and pounds/month) in the discharge monitoring report for that month and shall report each years annual results (pounds/year) in the December report for that year. A. (4.) OUTFALL SIGNAGE Not later than 120 days after the effective date of this permit (February 1, 2005), the Permittee shall install and thereafter maintain permanent signage identifying Outfall 001 as a wastewater discharge point. Unless otherwise approved in writing by the Director, the signage shall conform to the following specifications: 1. It shall be located in reasonable proximity to the outfall. 2. It shall be clearly visible to persons on the adjoining property and in or near the surrounding waters and, toward that end, shall: • be two-sided • be located at least 3 feet above ground level • at least two feet by two feet (2 ft x 2 ft) in size • consist of black letters on a white field; the word "notice" to be at least 3 inches tall and the remaining words to be at least 2 A inches tall 3. The treatment system consists of continuous flow metering system, manual bar screen, equalization basin, dual aeration chamber, dual clarifiers, aerated sludge holding chamber, dual air blowers, and tablet chlorinator. Treated wastewater is discharged through one outfall into an unnamed tributary (UT) to Buffalo Creek, which is a class C-NSW water. The UT Buffalo Creek is considered a zero -flow stream (summer 7Q10 and 30Q2 flows = 0). Permit Summary The permit includes discharge limits for flow, BOD5 (9 mg/L), NH3-N (2 &.4 mg/L, summer & winter), and fecal coliform bacteria. The draft permit also adds daily maximum limits for NH3-N and for TRC (17 ug/L), consistent with current NPDES permitting. policies, and additional monitoring requirements for nutrients. The Division issued Mr. Pace eight penalties totaling $4,560 in 2001-03 for violations of BOD, NH3-N, and fecal coliform limits. He has paid all penalties and the cases are now closed. Public Comments Mr. Joe Milhaus, Neuse River. Foundation: • Has a history of NH3-N, BOD, DO and fecal coliform limits violations. Even though it only serves 45 units, still impacts the receiving stream. Has upgraded the facility, is making an honest attempt to comply, and has shown improvement over the last six months. Suspect compliance is a function of lower flows through the plant. Recommend requiring a wastewater management plan if flow goes over 12,000 gpd '- expect he cannot comply with existing limits at the higher flow rate. DWO Response: and Discussion This is a small, privately owned, facility with limited resources. Compliance may become more problematic at higher flows, even within the current flow limit. One approach (similar to the NRF's suggestion) would be to require a facility assessment when limits violations reach a certain frequency as the result of increased flow. It may also be appropriate to require an updated engineering alternatives analysis. However, placing this burden on the permittee based on antici ap ted violations is not good permitting practice. A better approach would be to notify the permittee that these steps would be necessary if the plant does not meet its permit limits more consistently. The Division can then monitor the facility's compliance and decide what action is appropriate. Staff noted during the pre -hearing site visit that the permittee is aerating his chlorine contact chamber. This undermines the effectiveness of disinfection, and this practice must be stopped. Summary and Recommendations Pace Mobile Home Park W WTP, NC0064246 A line of concrete bags surrounded the ground -level package plant inside the security fence. The bags are supposed to prevent stormwater runoff from flowing into the treatment units. The regional office should confirm that excess water is not running onto the site and flowing into the treatment tanks. We surmised from our site visit that the receiving stream might be a play area for area children. In 2000, we required two permittees to install signage under similar circumstances, and it seems to be warranted in this case as well. Recommended Action(s) The Raleigh Regional Office should verify that: • the practice of aerating the chlorine contact chamber has ceased; and • stormwater runoff is properly diverted around and not flowing into the treatment units. / The NPDES Unit should notify the permittee that it may require a facilities assessment and/or A engineering alternatives analysis if the discharge does not meet permit limits more consistently. The NPDES Unit should coordinate with the Compliance Enforcement Unit to monitor permit compliance and require the assessment if warranted. The assessment should: bIV0V — describe deficiencies and operational difficulties in the existing collection system and -1 / treatment facility that affect performance or permit compliance, and — identify potential improvements to improve performance/ compliance, — estimate the cost of implementing those improvements, and — provide a schedule for their implementation. Pace Mobile Home NCO064246 Pace Mobile has had a history of compliance problems ranging from NH3 (nitrogen) BOD (biological oxygen demand), DO (dissolved oxygen) to fecal violations, which is why we chose to challenge this permit. Pace Mobile only has 45 units, which makes them a relatively small contributor to the overall problems we have historically seen in the Neuse. Nonetheless, these are public trust waters. The Neuse Basin wide plan, in order to be effective, requires buy in from everyone in the basin. We cannot simply ignore the fact that this facility has been out of compliance for years tegardless of its size. With that said, we appreciate the efforts Pace has made in the last year or so. They have upgraded their facility, making improvements to their flow meters. We feel this facility is making an honest attempt to come into compliance. Unfortunately, they still had several violations in 2002, but appeared to show improvement over the last six months. On the surface it would appear that this facility is finally coming into compliance, but after reviewing their permit and the DMR's (Discharge Monitoring Reports), recent improvements in performance can be attributed more to low flows rather than the recent upgrades. Although the upgrades have certainly helped. Pace Mobile has a permitted flow of 15,000 GPD (Gallons per day). In more recent months, their flow has dropped significantly to 8000 GPD. DWQ (Division of Water Quality) should anticipate more parameter violations if this Mobile home park reaches full flow capacity, let a lone decides to expand. As long as Pace continues to operate at the, continued flow, we feel this facility should be able to stay in compliance. What we would like to see is Pace Mobile develop a waste water management plan and be forced to comply with this plan, should their flow begin to exceed 12,000 GPD. This facility operates under very tight limits (9 mg/l for BOD and 2mg/l for Ammonia) on a very small stream. There is simply no way this facility can expand or remain in compliance if their flows were to increase, with out making significant improvements to their wastewater plant. We can accept this facility operating in compliance at the current flow levels, but we will not accept a facility that continuously violates their permit without taking significant steps toward compliance. A review of twenty one months of data shows in the past three years, the UT Buffalo Creek had only three summer months (May 2000, June and July 2002) where there was no flow upstream of the discharge. In April through October 2000 - In May 2000, there was no flow above the MHP and therefore no measurement of upstream temperature or DO. The downstream average DO in May 2000 was 6.38 mg/l. All other average DO levels both upstream and downstream of the facility were above the water quality standard of 5 mg/1. There was a range of 5.2 mg/1 to 8.07 mg/1 upstream, and a range of 6.09 to 7.6 mg/1 downstream. There were some instances of daily instream DO levels below the standard, however the overall monthly average was above 5 mg/ 1. In April through October 2001 - Average DO levels were above the standard in April, May and June. In July through October, nearly all upstream and downstream DO levels averaged below the standard, except for the August downstream DO average of 5.0 mg/l. Upstream DO was in the range of 3.43 mg/1 to 4.78 mg/l while downstream DO levels ranged from 3.94 to 4.74 mg/l. In August and October 2002, average upstream DO levels were 3.48 and 2.48 mg/l, respectively and corresponding downstream DO levels were 4.00 and 3.6 mg/l. PROPOSED CHANGES: • Addition of a total residual chlorine limit of 17 ug/l • Addition of summer and winter daily maximum ammonia limits. The summer daily maximum limit will be 10 mg/l; the winter daily maximum limit will be 20 mg/1 • Monitoring and reporting requirements for total flow, total kjeldahl nitrogen(TKN), nitrate, and nitrite have been added.
