Dear Mr. Becker:
The Division of Water Resources (the Division) hereby issues the attached NPDES permit for the subject
facility. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and
the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency
dated October 15, 2007, or as subsequently amended.
On November 20, 2017, Aqua North Carolina, Inc. requested that a schedule of compliance be inserted into
the permit to allow time to achieve compliance with new limits for Total Copper and Total Chlorine. The
W WTP plant was not meeting limits for Copper and Chlorine with 100% domestic wastewater with no
addition of filter backwash wastewater form the potable water systems. The filter backwash sources were
added in the previous permit modification issued April 24, 2017. The permittee proposes to investigate
possible treatment options, modeling for the lake with the addition of a diffuser, and to gather more data for
these parameters for future analysis of limits. The schedule of compliance found in Part I, Section A. (2.)
modifies both effluent tables in Part 1, Sections A. (L) and A. (3.) as indicated with Footnote 8 (see draft
permit).
Please note the following changes made since the draft modification:
1. Comments on the draft by the permittee requested that additional parameters that were limited in the
previous modification be added to the compliance schedule included in this modification. No data
was submitted to support this request to expand the compliance schedule for other parameters. Such
additional modification may also require further submittal for public notice. Therefore, the Division
has determined that this modification will only include a compliance schedule for Copper and
Chloride limits as originally requested.
2. The permittee requested that the achievement date for compliance with Copper and Chloride limits be
extended to 48 months from the effective date of the modification. Federal guidelines require that
NPDES permit cycle be no greater than 5 years. Therefore, the achievement date for the compliance

schedule will coincide with the expiration of the current permit on June 30, 2020. The compliance
schedule has been modified to only include three (3) schedule items as listed. See Section Part I A. (2.).
3. A technical correction to Strontium-90 has been made to indicate the correct standard of 8 pCi/L
(an annual average) as the permit limit. The narrative standards for radioactive substances are found
at 15A NCAC 02B .0211 (17) and 40 CFR 141.26 (adopted by reference).
If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable,
you have the right to an adjudicatory hearing, upon written request submitted within thirty (30) days after
receiving this letter. Your request must take the form of a written petition conforming to Chapter 150B of
North Carolina General Statutes, and you must file it with the Office of Administrative Hearings, 6714 Mail
Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this permit shall remain
final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to
obtain other permits which may be required by the Division of Water Resources or any other Federal, State,

Harbor Estates WWTP

Mecklenburg County
to receiving waters designated as the Catawba River (Lake Wylie) in the Catawba River Basin
in accordance with effluent limits, monitoring requirements, and other conditions set forth in Parts I, II,
III and IV hereof.
This permit shall become effective April 1, 2018.
This permit and authorization to discharge shall expire at midnight on June 30, 2020.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.
Aqua North Carolina, Inc.
is hereby authorized to:
1. Continue to operate an existing 0.0416 MGD extended aeration wastewater treatment system with
the following components:
• bar screen
• flow equalization basin
• flow Splitter
• dual aeration basins
• secondary Clarifier
• chlorine contact basin
• tablet chlorination
• tablet dechlorination chamber with aeration
• sludge holding tank
• effluent pump station
• effluent Flow Recording Meter
• standby Power Generator
• filter backwash from ion exchange technology water supply well treatment systems
introduced into the equalization basin by tanker truck from the following water treatment
systems:
o Fleetwood Acres
o Old South Lane
located in Pine Harbor at Harbor Estates on the southside of Pine Harbor Rd (NCSR 1113) in
Mecklenburg County,
2. after receiving an Authorization to Construct from the Division of Water Resources, construct and
after submittal of an Engineers Certification, to operate a wastewater treatment system not to
exceed 0.075 MGD, and
3. discharge from said treatment works at the location specified on the attached map into the Catawba
River (Lake Wylie) [11-(123.5)], a waterbody currently classified WS-V; B located within
Subbasin 03-08-34 [HUC: 03050101] of the Catawba River Basin.

During the period beginning on the permit effective date, and lasting until expansion above 0.0416
MGD or until Expiration, the permittee is authorized to discharge treated wastewater from Outfall 001.

2. Fecal Coliform shall be calculated using the geometric mean, according to the procedure detailed in Part H.
Section A.
3. The Division shall consider all effluent TRC values reported below 50 µg/L to be in compliance with the
permit. However, the Permittee shall continue to record and submit all values reported by a North Carolina
certified laboratory (including field certified), even if these values fall below 50 µg/L.
4. Effluent hardness sampling should be performed in conjunction with testing for hardness dependent metals
(copper and zinc).
5. All quarterly samples shall be taken 72 to 80 hours after the introduction of offsite wastewater into the
equalization tank.
6. After securing a minimum of 12 sample analyses (sampling no more frequently than 2/month), the
Permittee may submit a written request for the Division to reevaluate monitoring conditions and effluent
limitations.
7. The Permittee shall sample instream hardness, upstream of the facility's discharge. The sample shall be
representative of the hardness in the receiving stream.
8. Compliance with this limit shall commence on June 30, 2020, the permit expiration date. See Compliance
Schedule Condition A. (2.).
9. For a given wastewater sample, TN = TKN + (NO2-N + NO3-N), where TN is Total Nitrogen and TKN is
Total Kjeldahl Nitrogen, and (NO2-N + NO3-N) is Nitrite/Nitrate Nitrogen.
10. If the quarterly value exceeds 4 times the annual average limit, then (a) the sampling frequency shall
increase to monthly and (b) a written notification shall be sent to the Water Quality Permitting Section and
the Mooresville Regional Office.
11. A quarterly value can be determined from one quarterly sample or it can be determined from the average of
multiple samples taken in a period not to exceed 7 consecutive days during the quarter.
12. Chronic Toxicity (Ceriodaphnia dubia) 7-day pass/fail test, monitoring only, at 90% in January, April, July
and October [See A. (7.)].
Conditions:
• All samples collected should be from a representative discharge event.
• There shall be no discharge of floating solids or visible foam in other than trace amounts.
A. (2.) SCHEDULE OF COMPLIANCE (OUTFALL 001)
[G.S. 143-215.1(b)]
1. Within one year from the effective day of the permit the Permittee shall submit to the Division of Water
Resources a Corrective Action Plan summarizing the actions to be taken to achieve compliance with the
Total Copper and Total Chloride limits at Outfall 001 and a schedule of activities to implement the Plan.
2. Within two years from the effective date of the permit submit a report to the Division summarizing actions
taken in accordance with the Corrective Action Plan.
3. Achieve compliance with Total Copper and Total Chloride limits specified in Section A. (L) and A. (3.) by
June 30, 2020.
Upon approval of the Corrective Action Plan by the Division, the report and actions become an enforceable part
of this permit. Any modifications to the schedule shall be requested to the Division at least ninety (90) days
before the deadline. Modifications to the schedule in excess of four months will be subject to public notice.

A. (4.) PHASED CONSTRUCTION CONDITION [G.S. 143-215. 1 (b)]
If this facility is built in phases, plans and specifications for the next phase shall be submitted when the flow to
the existing units reaches 80% of the design capacity of the facilities on line. At no time may the flow tributary
to the facility exceed the design capacity of the existing units.
A. (5.) ENGINEERING ALTERNATIVES ANALYSIS [15A NCAC 02H .0105]
The permittee is required to submit an engineering analysis showing no other alternative than to discharge
wastewater, prior to expansion above 0.0416 MGD, in accordance with the Lake Wylie Management Plan.
A. (6.) PERMIT RE -OPENER [G.S. 143-215. 1 (b)]
The Division of Water Resources may reopen this permit to increase monitoring, add additional parameters of
concern, and/or implement additional limits should effluent data or surface water data indicate potential
impacts, or should further information on radiological components become available.

A. (7.) CHRONIC TOXICITY PASS/FAIL MONITORING ONLY (QUARTERLY)
[I 5A NCAC 02B .0500 et seq.]
The permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in the "North
Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December 2010, or subsequent
versions.
The effluent concentration defused as.treatment two in the procedure document is 90%. The testing shall be
performed as a Ceriodaphnia dubia 7-day pass/fail test. The tests will be performed during the months of
January, April, July and October. These months signify the first month of each three month toxicity testing
quarter assigned to the facility. Effluent sampling for this testing must be obtained during representative
effluent discharge and shall be performed at the NPDES permitted final effluent discharge below all treatment
processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B.

Completed Aquatic Toxicity Test Forms shall be filed with the Water Sciences Section no later than 30 days
after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements performed
in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent
toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required,
the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating
the facility name, permit number, pipe number, county, and the month/year of the report with the notation of
"No Flow" in the comment area of the form. The report shall be submitted to the Water Sciences Section at the
address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly
monitoring will begin immediately. Upon submission of a valid test, this monthly test requirement will revert to
quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of
Water Resources indicate potential impacts to the receiving stream, this permit may be re -opened and modified
to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an
invalid test and will require immediate follow-up testing to be completed no later than the last day of the month
following the month of the initial monitoring.

A. (8.) ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS
[G.S. 143-215.1(b)]
Federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and
program reports. The final NPDES Electronic Reporting Rule was adopted and became effective on
December 21, 2015.

Monitoring Reports
1. Reporting Requirements [Supersedes Section D. (2.) and Section E. (5.) (a)1
The permittee shall report discharge monitoring data electronically using the NC DWR's Electronic
Discharge Monitoring Report (eDMR) internet application.
Monitoring results obtained during the previous month(s) shall be summarized for each month and
submitted electronically using eDMR. The eDMR system allows permitted facilities to enter
monitoring data and submit DMRs electronically using the internet. Until such time that the state's
eDMR application is compliant with EPA's Cross -Media Electronic Reporting Regulation
(CROMERR), permittees will be required to submit all discharge monitoring data to the state
electronically using eDMR and will be required to complete the eDMR submission by printing,
signing, and submitting one signed original and a copy of the computer printed eDMR to the
following address:

If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the
facility being physically located in an area where less than 10 percent of the households have
broadband access, then a temporary waiver from the NPDES electronic reporting requirements may
be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1. 1, 2, 3)
or alternative forms approved by the Director. Duplicate signed copies shall be submitted to the
mailing address above. See "How to Request a Waiver from Electronic Reporting" section below.
Regardless of the submission method, the first DMR is due on the last day of the month following
the issuance of the permit or in the case of a new facility, on the last day of the month following the
commencement of discharge.
Starting on December 21, 2020, the permittee must electronically report the following compliance
monitoring data and reports, when applicable:
• Sewer Overflow/Bypass Event Reports;

• Pretreatment Program Annual Reports; and
• Clean Water Act (CWA) Section 316(b) Annual Reports.
The permittee may seek an electronic reporting waiver from the Division (see "How to Request a
Waiver from Electronic Reporting" section below).
2. Electronic Submissions
In accordance with 40 CFR 122.41(1)(9), the permittee must identify the initial recipient at the time
of each electronic submission. The permittee should use the EPA's website resources to identify the
initial recipient for the electronic submission.
Initial recipient of electronic NPDES information from NPDES-regulated facilities means the entity
(EPA or the state authorized by EPA to implement the NPDES program) that is the designated
entity for receiving electronic NPDES data [see 40 CFR 127.2(b)].
EPA plans to establish a website that will also link to the appropriate electronic reporting tool for
each type of electronic submission and for each state. Instructions on how to access and use the
appropriate electronic reporting tool will be available as well. Information on EPA's NPDES

Electronic submissions must start by the dates listed in the "Reporting Requirements" section
above.
3. How to Request a Waiver from Electronic Reporting
The permittee may seek a temporary electronic reporting waiver from the Division. To obtain an
electronic reporting waiver, a permittee must first submit an electronic reporting waiver request to
the Division. Requests for temporary electronic reporting waivers must be submitted in writing to
the Division for written approval at least sixty (60) days prior to the date the facility would be
required under this permit to begin submitting monitoring data and reports. The duration of a
temporary waiver shall not exceed 5 years and shall thereupon expire. At such time, monitoring
data and reports shall be submitted electronically to the Division unless the permittee re -applies for
and is granted a new temporary electronic reporting waiver by the Division. Approved electronic
reporting waivers are not transferrable. Only permittees with an approved reporting waiver request
may submit monitoring data and reports on paper to the Division for the period that the approved
reporting waiver request is effective.

4. Signatory Requirements (Supplements Section B. (11.) (b) and Supersedes Section B. (11.) (d)1
All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part
U, Section B. (I 1.)(a) or by a duly authorized representative of that person as described in Part H,
Section B. (11.)(b). A person, and not a position, must be delegated signatory authority for eDMR
reporting purposes.
For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user
account and login credentials to access the eDMR system. For more information on North
Carolina's eDMR system, registering for eDMR and obtaining an eDMR user account, please visit

Certification. Any person submitting an electronic DMR using the state's eDMR system shall make
the following certification [40 CFR 122.22]. NO OTHER STATEMENTS OF CERTIFICATION
WILL BE ACCEPTED:
7 certify, under penalty of law, that this document and all attachments were prepared under my
direction or supervision in accordance with a system designed to assure that qualified personnel
properly gather and evaluate the information submitted. Based on my inquiry of the person or
persons who manage the system, or those persons directly responsible for gathering the
information, the information submitted is, to the best of my knowledge and belief, true, accurate,
and complete. I am aware that there are significant penalties for submitting false information,
including the possibility of fines and imprisonment for knowing violations. "
5. Records Retention [Supplements Section D. (6.)1
The permittee shall retain records of all Discharge Monitoring Reports, including eDMR submissions.
These records or copies shall be maintained for a period of at least 3 years from the date of the report. This
period may be extended by request of the Director at any time [40 CFR 122.41 ].

I apologize for the delayed comment. I know we are outside of the 30 day response time but
Amanda Owens who just joined Aqua as our new Regional Compliance Manger was reviewing
the Draft Permit modification and raised some concerns that I did not capture. We discussed
the following issues that need to be incorporated into the permit.
First is what appears to be a typographical error in the limits for Chronic WET testing. The
original Modified Permit dated April 24, 2017 and the Technical Correction issued November
2, 2017 had the limit on this Parameter blank with a reference to Footnote 12. The draft
permit issued December 13, 2017 has "Monitor & Report". Since Chronic Toxicity is identified
in Footnote 12 as pass/fail at 90%, we believe the Monitor & Report in the limit is incorrect.
Secondly, the draft permit only calls out Total Copper and Total Chlorine identified under the
proposed monitoring period. It is our request that all of the new limits imposed at the time
the Modified Permit was issued would be covered under the requested compliance
period. We feel that it is in everyone's best interest to correct these items in the existing
modification request rather than to prolong the process with another modification request.

modification received by our office December 19, 2017, and has summarized our comments
below.
Section A.(1.) Effluent Limitations and Monitoring Requirements
Footnote 8 — We would like a period of forty-eight months from the effective date of the revised
permit to achieve compliance with the Total Copper and Total Chloride limits specified within
this section. We believe that the data collection efforts, studies, evaluations, design, permitting,
and modifications could require up to forty-eight months to complete.
Section A.(2.) Schedule of Compliance (Outfall 001)
5. We would like a period of four years to achieve compliance with Total Copper and Total
Chloride limits specified in Section A.(1.) and A.(3.). Note that the reference to A.(5.) in the
draft permit appears to be incorrect and should read A.(3.).

This letter and attached processing fee are being submitted with our request to modify the subject
permit to allow for a compliance period to meet the new limits which were added in the recent
modification allowing for the introduction of backwash from Aqua's potable water systems.
This request would allow Aqua to investigate possible treatment, modeling, testing and possibly
adjusting permit limits for Total Chloride and Total Copper to account for the domestic
discharge currently being discharged into the WWTP.
During the investigation and subsequent modification to the permit it has become evident that the
domestic wastewater currently being treated at the WWTP exceed the minimum level of Total
Chloride and Total Copper as no backwash has yet to be introduced into the facility under the
new permit.
