Nadia,
By informing us that the project is still active,we will renew coverage under the reissued NCGO10000 Construction
General Permit,which is the appropriate permit for construction projects that are subject to the Sedimentation
Pollution Control Act and the Clean Water Act.This includes projects that disturb less than one acre of land, but
are part of a common plan of development that exceeds one acre such as a residential subdivision.You will not
need to submit any paperwork or forms for this renewal of permit coverage.
Once the project has been completed and a final inspection conducted that releases/closes out the project from
the approved Erosion&Sedimentation Control Plan,a Notice of Termination request will need to be submitted in
order to rescind coverage under the Construction Stormwater Permit.

I'm assuming this project triggered an Erosion and Sediment Control Plan because it was part of a larger plan of
development and therefore the NCG01 NPDES construction permit requirement as well. You all submitted an
E&SC approval from Mecklenburg County with the application (attached). In cases like this,the project comes
under the standard NCG010000 general permit and not NCG250000.
I will let others on our NCG01 Team provide additional information.

Also how does this affect our build process?Are there more turns we have to complete?

Itjust means that when someone applied for the construction stormwater permit,they chose the option for
coverage under the permit that is specifically for projects exempted from the Sediment Pollution Control Act
and not needing an Erosion Control Plan (E&SC Plan). Those kind of projects get covered under a different
permit, NCG250000.
If you all got a standard E&SC Plan for this project,the NCG250000 coverage was the wrong option, and it
should have been the standard permit coverage(under NCG010000). Based on the name of the project,this
seems the most likely, but we wanted to make sure.

What does this mean?Can you explain it in terms that would be understandable to me? How does this
affect our build process?Yes we are still actively under construction.
Also we have disturbed under an acre of land.

In preparation for renewal of both the NCG010000 and NCG250000 Construction General Permits,
and upon review of the listing of active COCs under the NCG250000, it appears that your project
should have been covered under the NCG010000 instead. If you believe your coverage should be
under the NCG250000, please provide an explanation why.
As a reminder, NCG250000 applies to Owners/Operators of construction activities that meet all the
following criteria:
• result in the disturbance of a land area greater than or equal to one acre, or that are part of a common plan of
development of that size or greater;
• are not subject to the North Carolina Sedimentation Pollution Control Act of 1973(SPCA); and
• are subject to the Clean Water Act(i.e., activities that are not excluded under 40 CFR 122.3 and that meet
the definition of a point source under 40 CFR 122.2).
Please confirm if your project is still active (has not been released from the approved erosion &
sedimentation control plan). If so,your permit coverage will be renewed under the reissued
NCG010000 effective April 1, 2024.
