area, and the requester of this PJD is hereby advised of his or her option to request and ubtain an
approved JD (AJD) for that review area based on an informed decision after having discussed the
various types of JDs and their characteristics and circumstances when they, may be appropriate.
2) In any CirUUn7s1311ce where a permit applicant obtains an individual permit, or a Nationwide General
Permit (P+1WP) or other general permit verification requiring "pre- construction notification" (PCN), or
requests verification for a non -reporting NWP or other general permit_ and the permit applicant has
not requested an AJD for the activity, the permit applicant is hereby made aware than (1) the permit
applicant has elected to seek a permit authorization based on a PJ D. which does not matte an official
determination of jurisdictional aquatic resources; (2) the applicant has the option to request an AJD
before accepting the terms and conditions of the permit authorization, and that basing a permit
authorization on an AJD could possibly result in less compensatory mitigation bednk required or
different special conditions; (3) the applicant has the right to request an individual permit rather 111an
accepting the terms and conditions of the NW? or other general permit authorization-, (4) the applicant
can accept a permit authorization and thereby agree to comply with all the terms and conditions of that
permit, including whatever mitigation requirements the Corps has determined to be necessary; (5)
undertaking any activity in reliance upon the subject permit authorization without requesting an AJD
constitutes the applicant's acceptance of the use of the PJD; (6) accepting a permit authorization (e.g,,
signing a proffered individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a PJD constitutes agreement that all aquatic resources in the review area
affected in any way by that activity will be treated as jurisdictional, and waives any challenge to such
jurisdiction in any administrative or judicial compliance or enforcement action, or in any
administrative appeal or in any Federal court; and (7) Whether the applicant elects to use either an AJD
or a PJD, the JD will be processed as soon as practicable. Further, an AJD, a proffered individual
permit (and all terms and conditions contained therein), or individual permit denial can be
administratively appealed pursuant to 33 C.FR Part 331. If., during an administrative appeal, it
becomes appropriate to make an official determination whether geographic jurisdiction exists over
aquatic resources in the review area, or to provide an official delineation nfjurisdictional aquatic
resources in the review area, the Corps will provide an AJD to accomplish that result, as soon as is

Heglar Tract; New Hanover County
1. This permit does not authorize any additional fill material in waters of the U.S., including
jurisdictional wetlands, than what is stated in the permit. This permit authorizes permanent
impacts to 350 linear feet (1,280 square feet) of jurisdictional tributaries for three road crossings.
2. All waters of the U.S., including jurisdictional wetlands, subject to temporary impact must be
restored to pre -construction conditions, including grade and vegetation, immediately after
construction activities are complete.
3. All Till material used within waters of the U.S., including jurisdictional wetlands, must be clean
and free of toxins and must come from an upland source. Dredging for fill material within waters
of the U.S., in eluding jurisdictional wetlands, is not permitted by this authorization.

plan. We find the plan to be acceptable.

The land disturbing fee of $16,650 is due to be paid to New Hanover
County, to my attention, prior to issuance any Plat Recordation.
A preconstruction meeting is required prior to any land disturbing activity on

Please be advised that a copy of the approved soil erosion plan, a copy of the
grading permit, a rain gauge and the Combined Inspection Reports must be available
at all times at the site.
New Hanover County's Erosion and Sedimentation Control Program is
performance oriented requiring protection of the natural resources and adjoining
properties. If following the commencement of the project, it is determined that the
plan is inadequate to meet the requirements of the New Hanover County's Erosion and

As authorized by the New Hanover County Erosion and Sedimentation Control Ordinance
This permit issued to Hoosier Daddy LLC authorizes the development of 50.54 acres of land at 5831
Carolina Beach Road for Tarin Woods 11 in New Hanover County. This permit issued on March I0, 2016 is
subject to compliance with the application and site drawings, all applicable regulations and special conditions and
notes set forth below. Any plan modifications must be approved by this office prior to field changes
It is understood by the applicant that a representative of New Hanover County's Engineering Department
may inspect the site at any time following the issuance of this Permit. A copy of the approved Soil Erosion
Control Plan, this permit, a rain gauge and copies of the Combined Self -Monitoring and Self Inspection Reports
must be available at all times at the site.
Failure to execute the provisions of this permit and the approved Soil Erosion Plan, or any other
provisions of the New Hanover County Soil Erosion and Sedimentation Control Ordinance, shall result in
immediate legal action by the County to the limits prescribed by the Ordinance. If the measures outlined on the
approved Soil Erosion Control Plan and this Permit prove insufficient, additional Erosion Control measures can
and will be required which in hum will be considered provisions of this Permit. This Permit does not preclude
any other permits or approvals necessary for beginning or completing this development. Approval of an erosion
control plan is conditioned on the applicant's compliance with Federal and State laws, regulations and rules. It is
the Permittee's responsibility to obtain all necessary permits and approvals.
SPECIAL CONDITIONS
(THESE CONDITIONS MUST BE FOLLOWED IN ADDITION TO THE PLANS AND SPECIFICATIONS)
"All the soil erosion control measures will be installed as the site is cleared and maintained throughout
construction. These include 3 construction entrances, silt fences, inlet and outlet protection, 2lined temporary
diversion swales, 10 3:1 lined swales and immediate construction and stabilization of 4 sediment basins with
custom skimmers and coir baffles. The skimmer in Basin #1 will be installed to the outlet structure and will be an
8 inch Custom Skimmer with a 2.6 inch orifice, Basin #2, #3 & #4 will have Custom Skimmers installed thru the
earthen embankments. Basin #2 will have an 8 inch skimmer with a 3 inch orifice, Basin #3 will have a 8 inch
skimmer with a 2.4 inch orifice and Basin #4 will have a 8 inch skimmer with a 2 inch orifice. Lots 52 - 95 and the
Commercial property will be rough graded only and stabilized at this time. Revised plans will be submitted later
for these Iots. If Berms exist adjacent to streams silt fences may not be required. No activity is allowed in the flow
line of these jurisdictional streams.
*Tree Removal Permits must be acquired from the City of Wilrnington and/or New Hanover County prior to
issuance of this permit and clearing the site.
*Silt fence stakes must be metal and will be placed six feet apart without wire reinforcement or eight feet apart
with wire reinforcement. Silt fence is not allowed as inlet protection.
`This permit does not preclude any permits or approvals which may be necessary such as City of Wilmington or
New Hanover County Stormwater, NCDENR Water Quality, C.A.M.A., and the US Army Corps. of Engineers,
DEM Solid Waste or any other agencies.
*No sediment shall leave the site.

*If plan revisions are necessary you must submit a copy to this office for approval prior to any field changes.
*If soil is removed from the site, it must be taken to an approved or permitted site to he identified to this office
prior to removal from the site.
*All City and/or County and State drainage and Stormwater requirements will be adhered to.
*If these measures fail to adequately control erosion, more restrictive measures will be required.
*If any phase of grading ceases for more than 15 working days, the site will be temporarily stabilized.
*All slopes must be stabilized within 21 calendar days of any phase of activity.
The approval of an erosion control plan is conditioned on the applicant's compliance with Federal and State
Water Quality laws, regulations and rules.
*Note the required rates for seed, lime, fertilizer and mulch in your seeding specifications.
*Note the NPDES information from the State for sites disturbing 1 acre or more and the reporting
requirements. All NEW projects permitted after August 3, 2011 must include the following surface water
withdrawal locations and stabilization requirement designations on the plan in order to qualify for coverage
under the most recent NPDES Construction General Permit. All settling basins must have outlet structures that
withdraw water from the surface, with the exception of basins or traps that have a drainage area of less than 1
acre. The NPDES permit requires ground cover within 14 calendar days on disturbed flat areas and ground cover
within 7 calendar days on all areas within HQW Zones, perimeter dikes, swales, ditches, perimeter slopes and all
slopes steeper than 3:1. Exceptions include slopes that are 10 feet or less in length and not steeper than 2:1 which
must be stabilized within 14 calendar days and slopes greater than 50 feet which must be stabilized within 7
calendar days. Thfs permit also includes other new requirements which are listed in the text of the NPDES
Stormwater Discharge Permit for Construction Activities. Inspections of all erosion control measures and reports
are required every 7 days and within 24 hours of every 1/2 inch rain event in a 24 hour period.
*Note the Land Resources Self Inspection Program Requirements. This program is separate from the NPDES
reporting and requires inspection and documentation after each phase of construction. These phases include:
Installation of perimeter erosion control measures, Clearing and Grubbing of existing ground cover,
Completion of any phase of grading of slopes or fills, Installation of storm drainage facilities, Completion of
construction or development, Establishment of permanent ground cover sufficient to restrain erosion and any
Deviation from the approved plan.
Enclosed is a Combined Self -Monitoring and Self -Inspection Form that meets the requirements of both the
NPDES Stormwater Permit for Construction Activities, NCG 0100M reporting and the Land Resources Self
Inspection Program that satisfies the requirements of the Sedimentation Pollution Control Act.
This report is the responsibility of the property owner. It requires a rain gauge onsite and inspections and
reporting every 7 calendar days and within 24 hours of every l/z inch rain per 24 hour period and at specific
phases of construction. Additional copies of this Combined Construction Inspection Report can be found at

Dear Mr. Yopp:
The Division of Energy, Mineral and Land Resources received a complete Post -Construction Stormwater
Management Permit Application for the subject project on June 1 u, 2023. Staff review of the plans and
ssppeeccifications has determined that the project, as proposed, complies with the Stomtwater Regulations set forth in
Title 15A NCAC 2H.1000 amended on January 1, 2017 (2017 Rules). We are hereby forwarding Permit No.
SW8 230410 dated June 814, 2023, for the construction, operation and maintenance of the built -upon areas (DUA)
and stormwater control measures (SCMs) associated with the subject project.
This permit shall be effective from the date of issuance until June 86, 2031 and does not supersede any other
agency permit that may be required. The project shall be subject to the conditions and limitations as specked
therein. Failure to comply with these requirements will result in future compliance problems. Please note that
this permit is not transferable except after notice to and approval by the Division.
Please be aware that it is the responsibility of the permit holders, River Road Construction Company, LLC
("Developer") and Hoosier Daddy, LLC, a.k.a HD, LLC ("Property Owner"), to notify the Division of any
changes in ownership and request an ownership/name change for the stormwater permit However, if the
development agreement between the Developer and the Property Owner is dissolved, cancelled or defaults, and
the Division is not notified by the Developer to transfer the permit, then the responsibility for permit compliance
reverts back to the Property Owner. A complete transfer request must be submitted to the Division within 90 days
as described below otherwise the Developer and Property Owner will be operating a stormwater treatment facility
without a valid permit which is a violation of NC General Statue 143-215.1. Failure to transfer the permit may
result in appropriate enforcement action in accordance with North Carolina General Statute § 143-215.6A through
§ 143-215.6C being taken against the Property Owner.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request
an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAK). The
written petition must conform to Chapter 150E of the North Carolina General Statutes and must be filed with the
OAH within thirty (30) days of receipt of this perm it. You should contact the OAH with all questions regarding

POST -CONSTRUCTION STORMWATER MANAGEMENT PERMIT
HIGH DENSITY DEVELOPMENT
In compliance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as
amended, and other applicable Laws, Rules, and Regulations promulgated and adopted by the North
Carolina Environmental Management Commission, including 15A NCAC 02H.1000 amended on
January 1, 2017 (2017 Rules) (the "stormwater rules"),
PERMISSION IS HEREBY GRANTED TO
River Road Construction Company, LLC and Hoosier Daddy, LLC, a.k.a HD, LLC

FOR THE
construction, management, operation and maintenance of built-upan area (BUA) draining to three (3)
wet detention ponds ("stormwater control measures" or 'SCMs') as outlined in the application,
approved stormwater management plans, supplement, calculations, operation and maintenance
agreement, recorded documents, specifications, and other supporting data (the "approved plans and
specifications') as attached and/or on file with and approved by the Division of Energy, Mineral and
Land Resources (the "Division" or "DEMLR" )_ The project shall be constructed, operated and
maintained in accordance with these approved plans and specifications. The approved plans and
specifications are incorporated by reference and are enforceable part of this permit.
This permit shall be effective from the date of issuance until June 81', 2031 and shall be subject to the
following specified conditions and limitations. The permit issued shall continue in force and effect until
the permittee, files a request with the Division for a permit modification, transfer, renewal, or
rescission; however, these actions do not stay any condition. The issuance of this permit does not
prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or
terminating the permit for cause as allowed by the laws, rules, and regulations contained in Title 15A
NCAC 2H.1000 and NCGS 143-215.1 et. al.
1. BUA REQUIREMENTS. The maximum amount of BUA allowed for the entire project is 170,074
square feet. The runoff from all BUA within the permitted high density drainage areas of this
project must be directed into the permitted SCMi The BUA requirements and allocations for this
project are as follows:
a. SCM BUA LIMITS. The SCMs labeled DA 1, DA 2, and DA 3 have been designed to handle
the runoff from 54,339, 53,735, and 62,000 square feet of BUA, respectively, within the
delineated drainage areas. The BIJA for future development within the drainage areas to the
SCMs labeled DA 1, DA 2, and DA 3 is limited to 27,000, 35,000, and 62,000 square feet,
respectively.
2. PERVIOUS AREA IMPROVEMENTS. At this time, none of the pervious area improvements
listed in G.S. 143-214.7(b2) or the Stormwater Design Manual have been proposed for this
project. Pervious area improvements will be allowed in this project if documentation is provided
demonstrating those improvements meet the requirements of the stormwater rule.

3. SCM REQUIREMENTS. The SCM requirements for this project are as follows:
a. SCM DESIGN. The SCMs are permitted based on the design criteria presented in the
seated, signed and dated supplement and as shown in the approved plans and
specifications. These SCMs must be provided and maintained at the design condition.
b. PLANTING PLAN. The SCM landscape planting plan shown in the approved plans shall be
followed in its entirety during construction. After the plants are established, the operation
and maintenance agreement must be followed,
c. FOUNTAINS. At this time, a decorative spray fountain has not been proposed within the wet
pond- Decorative spray fountains will be allowed in the wet pond if documentation is
provided demonstrating that the proposed fountain will not cause resuspension of sediment
within the pond or cause erosion of the pond side slopes.
d. IRRIGATION, If the wet pond is to be used for irrigation, it is recommended that some water
be maintained in the permanent pool, the vegetated shelf is planted with appropriate species
that can handle fluctuating conditions, and human health issues are addressed.
4. STORMWATER OUTLETS, The peak flow from the 10-year storm event shall not cause
erosion downslope of the discharge point.
5. VEGETATED SETBACKS. A 50•foot wide vegetative setback must be provided and maintained
in grass or other vegetation adjacent to all surface waters as shown on the approved plans. The
setback is measured horizontally from the normal pool elevation of impounded structures, from
the top of bank of each side of streams or rivers, and from the mean high waterline of tidal
waters, perpendicular to the shoreline.
a. BUA IN THE VEGETATED SETBACK. BUA may not be added to the vegetated setback
except as shown on the approved plans.
b. RELEASE OF STORMWATER NOT TREATED IN AN SCM, Stormwater that is not treated
in an SCM must be released at the edge of the vegetated setback and allowed to flow
through the setback as dispersed flow.
6. RECORDED DOCUMENT REQUIREMENTS. The stormwater rules require the following
documents to be recorded with the Office of the Register of Deeds:
a. EASEMENTS. All SCMs, stormwater collection systems, vegetated conveyances, and
maintenance access located on property owned by other persons or entities must be located
in permanent recorded easements or drainage easements as shown on the approved plans,
b. OPERATION AND MAINTENANCE AGREEMENT. The operation and maintenance
agreement must be recorded with the Office of the Register of Deeds.
c. FINAL PLATS. If a final plat is recorded, it must reference the operation and maintenance
agreement and must also show all public rights -of -way, dedicated common areas, and/or
permanent drainage easements, in accordance with the approved plans.
d. DEED RESTRICTIONS AND PROTECTIVE COVENANTS. The permittee shall record deed
restrictions and protective covenants prior to the issuance of a certificate of occupancy to
ensure the permit conditions and the approved plans and specifications are maintained in
perpetuity.
T CONSTRUCTION. During construction, erosion shall be kept to a minimum and any eroded
areas of the on -site stormwater system will be repaired immediately.
a. PROJECT CONSTRUCTION, OPERATION AND MAINTENANCE. During construction, all
operation and maintenance for the project shall follow the Erosion Control Plan requirements
until the Sediment -Erosion Control devices are converted to SCMs or no longer needed.
Once the device is converted to a SCM, the permittee shall provide and perform the
operation and maintenance as outlined in the applicable section below.

b. SCM RESTORATION. If one or more of the SCI are used as an Erosion Control device
and/or removed or destroyed during construction, it must be restored to the approved design
condition poor to close-out of the erosion control plan and/or project completion and/or
transfer of the permit. Upon restoration, a new or updated certification will be required for the
SCM(s) and a copy must be submitted to the appropriate DEQ regional office.
8, MODIFICATIONS. No person or entity, including the permittee, shall alter any component
shown in the approved plans and specifications. Prior to the construction of any modification to
the approved plans, the permittee shall submit to the Director, and shall have received approval
for modified plans, specifications, and calculations including, but not limited to, those listed
below. For changes to the project or SCM that impact the certifications, a new or updated
certification(s), as applicable, will be required and a copy must be submitted to the appropriate
DEQ regional office upon completion of the modification.
a. Any modification to the approved plans and specifications, regardless of size including the
SCM(s), BUA, details, etc.
b. Redesign or addition to the approved amount of BUA or to the drainage area.
c. Further development, subdivision, acquisition, lease or sale of any, all or part of the project
and/or property area as reported in the approved plans and specifications.
d. Altering, modifying, removing, relocating, redirecting, regrading, or resizing of any
component of the approved SCM(s), stormwater collection system and/or vegetative
conveyance shown on the approved plan.
e. The construction of any allocated future BUA.
f. The construction of any infiltrating permeable pavement, #57 stone area, public trails, or
landscaping material to be considered a pervious surface that were not included in the
approved plans and specifications.
g. Other modifications as determined by the Director.
9. DESIGNER'S CERTIFICATION. Upon completion of the project, the permittee shall determine if
the project is in compliance with the approved plans and take the necessary following actions:
a. If the permittee determines that the project is in compliance with the approved plans, then
within 45 days of completion, the permittee shall submit to the Division one hard copy and
one electronic copy of the following:
i. The completed and signed Designer's Certification provided in Attachment A
noting any deviations from the approved plans and specifications. Deviations
may require approval from the Division,
ii. A copy of the recorded operation and maintenance agreement;
iiL Unless already provided, a copy of the recorded deed restrictions and
protective covenants; and
iv. A copy of the recorded plat delineating the public tights -of -way, dedicated
common areas and/or permanent recorded easements, when applicable.
b. If the permittee determines that the project is not in compliance with the approved plans, the
permittee shall submit an application to modifyr the permit within 30 days of completion of the
project or provide a plan of action, with a timeline, to bring the site into compliance,
10, OPERATION AND MAINTENANCE. The permittee shall provide and perform the operation and
maintenance necessary, as listed in the signed operation and maintenance agreement, to
assure that all components of the permitted on -site stormwater system are maintained at the
approved design condition. The approved operation and maintenance agreement must be
followed in its entirety and maintenance must occur at the scheduled intervals.
a. CORRECTIVE ACTIONS REQUIRED. If the facilities fail to perform satisfactorily, the
permittee shall take immediate corrective actions. This includes actions required by the
Division and the stormwater rules such as the construction of additional or replacement on -
site stormwater systems. These additional or replacement measures shall receive a permit
from the Division prior to construction.
b. MAINTENANCE RECORDS. Records of maintenance activities must be kept and made
available upon request to authorized personnel of the Division The records will indicate the
date, activity, name of person performing the work and what actions were taken
11. PERMIT RENEWAL. A permit renewal request must be submitted at least 180 days prior to the
expiration date of this permit. The renewal request must include the appropriate application,
documentation and the processing fee as outlined in 15A NCAC 02H 1045(3).

12. CHANGES TO THE PROJECT NAME, PERMITTFF NAME OR CONTACT INFORMATION.
The permittee shall submit a completed Permit Information Update Application Form to the
Division within 30 days to making any one of these changes.
13. TRANSFER. This permit is not transferable to any person or entity except after notice to and
approval by the director. Neither the sale of the project and/or property, in whole or in part, nor
the conveyance of common area to a third party constitutes an approved transfer of the permit.
a. DEVELOPER AGREEMENT. It is the responsibility of the permit holders, River Road
Construction Company, LLC ("Developer) and Hoosier Daddy, LLC, a.k.a HD, LLC
("Property Owner"), to notify the Division of any changes in ownership and request an
ownership/name change for the stormwater permit. However, if the development agreement
between the Developer and Property Owner is dissolved, cancelled or defaults, and the
Division is not notified by the Developer to transfer the permit, then the responsibility for
permit compliance reverts back to the Property Owner. A complete transfer request must be
submitted to the Division within 90 days as described below otherwise the Developer and
Property Owner will be operating a stormwater treatment facility without a valid permit which
is a violation of NC General Statue 143-215.1. Failure to transfer the permit may result in
appropriate enforcement action in accordance with North Carolina General Statute §143-
215.6A through §143-215,6C being taken against the Property Owner
b. TRANSFER REQUEST. The transfer request must include the appropriate application,
documentation and the processing fee as outlined in 15A NCAC 02H.1045(2). This request
must be submitted within 90 days of the permit holder meeting one or more of the following:
i. A natural person who is deceased;
ii. A partnership, limited liability corporation, corporation, or any other business
association that has been dissolved;
iii. A person or entity who has been lawfully and finally divested of title to the property
on which the permitted activity is occurring or will occur through foreclosure,
bankruptcy, or other legal proceeding.
iv. A person or entity who has sold the property, in whole or in part, on which the
permitted activity is occurring or will occur,
V. The assignment of declarant rights to another individual or entity;
vi. The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of NCGS 143-214.7(c2);
b. TRANSFER INSPECTION. Prior to transfer of the permit, a file review and site inspection

compliance with the permit will not be transferred until all permit and/or general statute

14. COMPLIANCE. The permittee is responsible for complying with the terms and conditions of this
permit and the approved plans and specifications until the Division approves the transfer
request.
a. REVIEWING AND MONITORING FOR COMPLIANCE. The permittee is responsible for
verifying that the proposed SUA within each drainage area and for the entire project does
not exceed the maximum amount allowed by this permit. The permittee shall review and
routinely monitor the project to ensure continued compliance with the conditions of the
permit, the approved plans and specifications.
b. APPROVED PLANS AND SPECIFICATIONS. A copy of this permit, approved plans,
application, supplement, operation and maintenance agreement, all applicable recorded
documents, and specifications shall be maintained on file by the permittee at all times.
c. MAINTENANCE ACCESS. SCMs, stormwater collection systems, and vegetated
conveyances must be accessible for inspection, operation, maintenance and repair as
shown on the approved plans.
d. DIVISION ACCESS- The permittee grants Division Staff permission to enter the property
during normal business hours to inspect all components of the permitted project.

enforcement procedures as set forth in NCGS 143 Article 21.

The applicable state stormwater management permit supplement and operation and maintenance (O&M) forms
must be submitted for each BMP specified for this project The latest versions of the forms can be downloaded

VI. SUBMITTAL REQUIREMENTS
Only complete application packages will be accepted and reviewed by the Division of Energy, Mineral and
Land Resources (DEMI.R). A complete package includes all of the items listed below. A detailed application
instruction sheet and BMP checklists are available from

submitted to the appropriate DFMLR Office. (The appropriate office may be found by locating project on the

receiving stream drains to class SA waters within t/r mile of the site boundary, include the 'A
mile radius on the map.
7. Sealed, signed and dated calculations (one copy).
8. Two sets of plans folded to 8.5" x 14" (sealed, signed, & dated), including:
a. Development/Project name.
b. Engineer and firm.
c. Location map with named streets and NCSR numbers.
d. Legend.
e. North arrow.
f. Scale.
g. Revision number and dates.
h. Identify all surface waters on the plans by delineating the normal pool elevation of
impounded structures, the banks of streams and rivers, the MHW or NHW line of tidal
waters, and any coastal wetlands landward of the MEW or NHW lines.
• Delineate the vegetated buffer landward from the normal pool elevation of impounded
structures, the banks of streams or rivers, and the MHW (or NEW) of tidal waters.
i. Dimensioned property/project boundary with bearings & distances.
j. Site Layout with all BUA identified and dimensioned.
k. Existing contours, proposed contours, spot elevations, finished floor elevations.

VII. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective
covenants are required to be recorded prior to the sale of any lot. If lot sizes vary significantly or the proposed
BUA allocations vary, a table fisting each lot number, lot size, and the allowable built -upon area must be
provided as an attachment to the completed and notarized deed restriction form. The appropriate deed

In the instances where the applicant is different than the property owner, it is the responsibility of the property

wet Pond Maintenar;ce Requirements
Important operation and maintenance procedures:
Immediately after the wet detention basin is established, the plants on the vegetated shelf and
perimeter of the basin should be watered twice weekly if needed, until the plants become
estabfshed (commonly six weeks).
No portion of the wet pond should be fertilized after the initial fertilization that is required to
establish the plants on the vegetated shelf.
Stable groundcover will be maintained in the drainage area to reduce the sediment load to the wet
pond.
If the pond must be drained for an emergency or to perform maintenance, the flushing of sediment
through the emergency drain will be minimized as much as possible_
At least once annually, a dam safety expert will inspect the embankment. Any problems that are
found will be repaired immediately.
The measuring device used to determine the sediment elevation shall be such that it will give an
accurate depth reading and not readily penetrate into accumulated sediments.
After the wet pond is established, it will be inspected quarterly and within 24 hours after every storm event
greater than 1.0 inches for 1.5 inches if in a Coastal County) . Records of operation and maintenance shall be
kept in a known set location and shall be available upon request.

Ensouring Accurate Determinations When Using IPaC
The Service developed the IPaC system and associated species' determination keys in accordance
with the Endangered Species Act of 1973 (ESA; 87 Stat. 884, as amended; 16 U.S.C. 1531 et
seq.) and based on a standing analysis. All information submitted by the Project proponent into
IPaC must accurately represent the full scope and details of the Project.
Failure to accurately represent or implement the Project as detailed in IPaC or the Northern
Long-eared Bat Ran gewide Determination Key (Dkey), invalidates this I etter. Answers to certain
questions in the D Key commit the project proponent to Implementation of conservation
measures that must be followed for the ESA determination to remain valid.
Determination for the North ern Long -Eared Bat
Based upon your IPaC submission and a standing analysis, your project is not reasonably certain
to cause incidental take of the northern long-eared bat. Unless the Service advises you within 15
days of the date of this letter that your IPaC-assisted determination was 'incorrect, this letter
verifies that the Action is not likely to result in unauthorised take of the northern long-eared bat.

We are uncertain where the northern long-eared bat occur~ on the landscape outside of known
locations. Because of the steep declines in the species and vast amount of available and suitable
forest habitat, the presence of suitable forest habitat alone is a far less reliable predictor of their
presence. Based on the best available information, most suitable habitat is now expected to be
unoccupied. Du. in the interim period, while we are working on potential methods to address
this uncert€ 11i) %cc conclude take is not reasonably certain to occur in areas of suitable habitat
where pjc.wnue has not been documented.
If no changes occur with the Project or there are no updates on listed species, no further
consulWtian coordination for this project is required for the northern long-eared bat. However,
the Service recommends that project proponents re-evaluate the Project in IPaC if: 1) the scope,
timing, duration, or location of the Project changes (includes any project changes or
amendments), 2) new information reveals the Project may impact (positively or negatively)

Appendix C — Conservation Recommendations
These recommendations are optional and, if Implemented, would support the agency's goals toward
recovery. These recommendations are to be used at the discretion of the permittee, but any measures that
avoid and minimize effects to the species are highly encouraged by the USFWS.
1. Minimize project impacts within clusters and foraging habitat whenever possible (i.e., conduct large
pine removal outside of nesting season [April 1 to July 311, trim branches instead of complete tree
removal, switch building plans to retain large pines).
2. The USFWS strongly recorri that occupied habitats be avoided and preserved, The first Measure
is to modify the project footprint to avoid direct impacts to RCW habitat. This habitat could be
designated a, on sensitive area and set aside by deed restriction, easement, or
anoth, protective caper ant. If the occupied habitat on the property exceeds S acres (2 hectares),
then a habitat management plan is also recommended. Incorporating these recommendations into
the proinct design and documenting them in the habitat management plan might result in the project
being net li,tiely ;e adversely affect the RCW.
on -site habitat enhancements are recommended by the USFWS in situations where a project
proposes to impact occupied RCW habitat. If the site has been physically altered by exotic species
invasion, lack of fire, or other anthropcgenic actions, these alterations have produced on -site habitat
Conditions that have resulted in marginally suitable habitats for RCW's survival and propagation. The
planned action, through project redesign, has avoided impacting a substantial portion of the habitat;
however, some habitat loss will still occur. The project proposes on -site habitat enhancements and
management actions that provide habitat quality improvements that balance losses of small amounts
of marginally suitable habitats. Incorporating these recommendations into the project and
documenting them in a habitat management plan can result in the project being not likely to adversely
affect the RCW,

Revised engineering plans prepared by Howard S. Resnik, P.E., call for the installation of an additional
approximately 330 feet of 12-inch water main (total of 1,360 feet), 450 feet of 8-inch water main (total of 2,810
feet), valves, and associated appurtenances along Ironwood Drive, Rosa Parks Extension, Road D Extension, and
Nixon Connection to serve proposed 141-unit townhome complex within Phase 4 of Tarin Woods II located off
Ironwood Drive in New Hanover County. The proposed 12-inch water main will connect to an existing 8-inch
water main along Ironwood Drive.
Please note that in accordance with 15A NCAC 18C .0309(a), no construction, alteration, or expansion of
a water system shall be placed into service or trade available for human consumption until the Public Water
Supply Section has issued Final Approval. Final Approval will be issued and mailed to the applicant upon receipt
of both an Engineer's Certification and an Applicant's Certification submitted in accordance with I5A NCAC
18C .0303 (a) and (c).

In accordance with your application received September 23, 2022, and revised application received on
November 2, 2022, we are forwarding herewith Permit No. WQ0038376 dated November 9, 2022 to the
CFPUA (Permittee) for the construction and operation upon certification of the subject wastewater
collection system extension. This permit shall be effective from the date of issuance until rescinded, shall
void Permit No. WQ0038376 issued December 9, 2019, and shall be subject to the conditions and
limitations as specified therein. This cover letter shall be considered a part of this permit and is therefore
incorporated therein by reference.
The purpose of this modification is to install approximately 3,562 LF of 8-inch gravity sewer to serve
141 three -bedroom townhome residences (50,760 gallons per day).
Please pay particular attention to the following conditions contained within this permit:
Special Conditions:
Condition U: A variance is hereby granted to allow Manhole A10 in Phase 2 to be located within the
50-foot wetland setback provided it meets the conditions below. Please note that anti -

Standard Conditions:
Condition 11.1: This permit shall not be automatically transferable; a request must be made and
approved.
Condition 11.4: Requires that the wastewater collection facilities be properly operated and maintained
in accordance with 15A NCAC 2T .0403 or any individual system -wide collection system
permit issued to the Permittee.
Condition II.7: Upon completion of construction and prior to operation of these permitted facilities, the
completed Engineering Certification form with checklist attached to this permit shall be
submitted with the required supporting documents to the address provided on the form.
Permit modifications are required for any changes resulting in non-compliance with
this permit, regulations, or the Minimum Design Criteria. (15A NCAC 02T.0116]
Condition 11.13: If the Permittee/Applicant holds a system -side collection system operation,
maintenance and management permit (WQCS-prefix) from the Division, then the
following applies: For all newly constructed, modified and rehabilitated pump stations,
all equipment and components shall be sealed within a corrosion -resistant coating or
encasement to the extent practicable and equivalent to the minimum design criteria
unless the permittee can demonstrate it is not practicable or another farm of corrosion
resistance is employed. (15A NCAC 02T .0108 (b)]
It shall be responsibility of the Permittee to ensure that the as -constructed project meets the appropriate
design criteria and rules. Failure to comply may result in penalties in accordance with North Carolina
General Statute §143-215.6A through §143-215.6C, construction of additional or replacement
wastewater collection facilities, and/or referral of the North Carolina -licensed Professional Engineer to
the licensing board.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This
request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General

SUPPLEMENT TO PERMIT COVER SHEET
CFPUA is hereby authorized to:
Construct, and then operate upon certification the aforementioned wastewater collection extension. The
sewage and wastewater collected by this system shall be treated in the Wilmington Southside Wastewater
Treatment Facility in accordance with Permit Number NC0023973.
Permitting of this project does not constitute an acceptance of any part of the project that does not meet
15A NCAC 2T; the Division of Water Resources' (Division) Gravity5ewer Minimum Design Criteria adopted
February 12, 1996 as applicable; and the Division's Minimum Design Criteria for the Fast -Track Permitting
of Pump Stations and Force Mains adopted June 1, 2000 as applicable, unless specifically mentioned
herein. Division approval is based on acceptance of the certification provided by a North Carolina -licensed
Professional Engineer in the application. It shall be the Permittee's responsibility to ensure that the as -
constructed project meets the appropriate design criteria and rules.
Construction and operation is contingent upon compliance with the Standard Conditions and any Special
Conditions identified below.
I. SPECIAL CONDITIONS
1. Per 15A NCAC 02T.0305(g), segments where the gravity sewer does not meet separation
requirements, materials, testing methods, and acceptability standards meeting water main standards
(15A NCAC 18C) shall be specified.
A variance is herebygranted to allow Manhole 410 in Phase 2 to be located within the 50-foot wetland
setback provided it meets the conditions below. Please note that anti -seep collars maybe necessary
on the line based on a review of the location. [15A NCAC 02T .0105(n)]
i) Seams shall be externallytaped/sealed
ii) Structures shall be provided with a full waterproof interior coating/lining
ill) Watertight pipe connections shall be provided consisting of a flexible watertight
rubber boot or compression type connector
iv) Structures shall be tested in accordance with ASTM C1244
v) All structures not included as part of a tlSACCE 404 Permit or Division 401
Certification shall maintain a separation of no less than 10 feet from wetlands
vi) Testing results (per the project specifications) shah be provided with the project
certification and record drawings. This includes gravity main testing results and
manhole vacuum testing results for the identified concrete structures.
2. Each pump station shall be clearly and conspicuously posted using a weatherproof sign with the
address, a pump station identifying name/number, 24-Hour Emergency telephone number, and name
of the owner/operator of the sewer system/pump station and instructions to call the number in the
event of alarm activation or other emergency. Simplex pump stations or vacuum sewer pits serving a
single-family residence may have a placard or sticker without the address placed on the control panel
in lieu of a sign. [15A NCAC 02T .0305(h)(2)j

II. STANDARD CONDITIONS
1. This permit shall not be transferable. In the event there is a desire for the wastewater collection
facilities to change ownership, or there is a name change of the Permittee, a formal permit request
shall be submitted to the Division accompanied by documentation from the parties involved, and
other supporting materials as may be appropriate. The approval of this request shall be considered
on its merits and may or may not be approved. [15A NCAC 02T.0104; G.5143-215.1(d3)]
2. This permit shall become voidable unless the wastewater collection facilities are constructed in
accordance with the conditions of this permit; 15A NCAC 2T; the Division's Gravity Sewer Minimum
Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design Criteria for
the Fast -Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable; and
other supporting materials unless specifically mentioned herein. [15A NCAC 02T.0110]
3. This permit shall be effective only with respect to the nature and volume of wastes described in the
application and other supporting data. [15A NCAC 02T .0110]
4. The wastewater collection facilities shall be properly maintained and operated at all times. The
Permittee shall maintain compliance with an individual system -wide collection system permit for the
operation and maintenance of these facilities as required by 15A NCAC 2T .0403. If an individual
permit is not required, the following performance criteria shall be met: [15A NCAC 02T .0108(b)]
a. The sewer system shall be effectively maintained and operated at all times to prevent discharge
to land or surface waters, and to prevent any contravention of groundwater standards or surface
water standards.
b. A map of the sewer system shall be developed and shall be actively maintained.
c. An operation and maintenance plan including pump station inspection frequency, preventative
maintenance schedule, spare parts inventory and overflow response has been developed and
implemented.
d. Pump stations that are not connected t0 a telemetry system shall be inspected every day (i.e. 365
days per year). Pump stations that are connected to a telemetry system shall be inspected at
least once per week.
e. High -priority sewer lines shall be inspected at least once per every six -months and inspections are
documented.
f. A general observation of the entire sewer system shall be conducted at least once per year.
g. overflows and bypasses shall be reported to the appropriate Division regional office in accordance
with 15A NCAC 20 .0506(a), and public notice shall be provided as required by North Carolina
General Statute §143-215.1C.
h. A Grease Control Program is in place as follows:
1. For public owned collection systems, the Grease Control Program shall include at least
biannual distribution of educational materials for both commercial and residential users and
the legal means to require grease interceptors at existing establishments. The plan shall also
include legal means for inspections of the grease interceptors, enforcement for violators and
the legal means to control grease entering the system from other public and private satellite
sewer systems.

2. For privately owned collection systems, the Grease Control Program shall include at least bi-
annual distribution of grease education materials to users of the collection system by the
permittee or its representative.
3. Grease education materials shall be distributed more often than required in Parts (1) and (2)
of this Subparagraph if necessary to prevent grease -related sanitary sewer overflows.
T. Right-of-ways and easements shall be maintained in the full easement width for personnel and
equipment accessibility.
j. Documentation shall be kept far Subparagraphs (a) through (i) of this Rule for a minimum of three
years with exception of the map, which shall be maintained for the life of the system.
5. Noncompliance Notification:
The Permittee shall report by telephone to a water resources staff member at the Wilmington
Regional Office, telephone number [phone], as soon as possible, but in no case more than 24
hours or on the next working day, following the occurrence or first knowledge of the occurrence of
either of the following:
a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable
of adequate wastewater transport, such as mechanical or electrical failures of pumps, line
blockage or breakage, etc.; or
b. Any SSO and/or spillover 1,000 gallons; or
c. Any SSO and/or spill, regardless of volume, that reaches surface water
Voice mail messages or faxed information is permissible, but this shall not be considered as the initial
verbal report. Overflows and spills occurring outside normal business hours may also be reported to
the Division of Emergency Management at telephone number [phone] or [phone].
Persons reporting any of the above occurrences shall file a spill report by completing and submitting
Part I of Form CS-SSO (or the most current Division approved form) within five days following first
knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to
ensure that the problem does not recur. Part 11 of Form CS-5SO (or the most current Division approved
form) can also be completed to show that the S50 was beyond control. ]G.5. 143-215.1C(al)]
6. Construction of the gravity sewers, pump stations, and force mains shall be scheduled so as not to
interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater
to the surface waters of the State. 115A NCAC 02T.0108(b)]
7. Upon completion of construction and prior to operation of these permitted facilities, the completed
Engineering Certification form with checklist attached to this permit shall be submitted with the
required supporting documents to the address provided on the form. A complete certification is one
where the form is fully executed and the supporting documents are provided as applicable. Any
wastewater flow made tributary to the wastewater collection system extension prior to completion
of this Engineer's Certification shall be considered a violation of the permit and shall subject the
Perm ittee to appropriate enforcement actions.
If the permit is issued to a private entity with an Operational Agreement, then a copy of the Articles
of Incorporation, Declarations/Covenants/Restrictions, and Bylaws that have been appropriately
filed with the applicable County's Register of Deeds office shall be submitted with the certification.

A complete certification is one where the form is fully executed and the supporting documents are
provided as applicable. Supporting documentation shall include the following:
a. One copy of the project construction record drawings (plan & profile views of sewer lines & force
mains) of the wastewater collection system extension. Final record drawings should be clear on
the plans or In accepted electronic format and are defined as the design drawings that are marked
up or annotated with after construction information and show required buffers, separation
distances, material changes, etc.
b. One copy of the supporting applicable design calculations including pipe and pump sizing, velocity,
pump cycle times, and level control settings, pump station buoyancy, wet well storage, surge
protection, detention time in the wet well, and force main, ability to flush low points in force
mains with a pump cycle, and downstream sewer capacity analysis. If a portable power source or
pump is dedicated to multiple stations, an evaluation of all the pump stations' storage capacities
and the rotation schedule of the portable powersource or pump, include travel timeframes, shall
be provided.
c. Changes to the project that do not result in non-compliance with this permit, regulations, or the
Minimum Design Criteria should be clearly identified on the record drawings, on the certification
in the space provided, or in written summary form.
Priorto Certification (Final or Partial): Permit modifications are required for any changes resulting in
non-compliance with this permit (Including pipe length changes of 10% or greater by type & size,
Increased flow, pump station design capacity- design increases of 5% or greater, and increases in the
number/type of connections), regulations, or the Minimum Design Criteria. Requested modifications
or variances to the Minimum Design Criteria will be reviewed on a case -by -case basis and each on its
own merit. Please note that variances to the Minimum Design Criteria should be requested and
approved during the permitting process prior to construction. After -construction requests are
discouraged by the Division and may not be approved, thus requiring replacement or repair prior to
certification & activation. [15A NCAC 02T .01161
8. Gravity sewers installed greater than ten percent below the minimum required slope perthe Division's
Gravity Sewer Minimum Design Criteria shall not be acceptable and shall not be certified until
corrected. If there is an unforeseen obstacle in the field where all viable solutions have been
examined, a slope variance can be requested from the Division with firm supporting documentation.
This shall be done through a permit modification with fee. Such variance requests will be evaluated
on a case by -case basis. Resolution of such request shall be evident priorto completing and submitting
the construction certification. [ 15A NCAC 02T.0105(n)]
9. A copy of the construction record drawings shall be maintained on file by the Permittee for the life of
the wastewater collection facilities. [15A NCAC 02T .0116]
10. Failure to abide by the conditions and limitations contained in this permit; 15A NCAC 2T; the Division's
Gravity Sewer Design Criteria adopted February 12,1996 as applicable; the Division's Minimum Design
Criteria for the Fast -Track Permitting of Pump Station and Force Mains adopted June 1, 2000 as
applicable; and other supporting materials may subject the Permittee to an enforcement action by
the Division, in accordance with North Carolina General Statutes §143-215.6A through §143-215.6C,
construction of additional or replacement wastewater collection facilities, and/or referral of the North
Carolina -licensed Professional Engineer to the licensing board. 115A NCAC 02T .0104; 15A NCAC 02T

11. In the event that the wastewater collection facilities fail to perform satisfactorily, including the
creation cf nuisance conditions, the Permittee shall take immediate corrective action, including those

as may be required by this Division, such as the construction of additional or replacement facilities.

12. The issuance of this permit shall not exempt the Permittee from complying with any and all statutes,
rules, regulations, or ordinances that maybe imposed by the Division any other Federal, State, or Local
government agencies which have jurisdiction or obtaining other permits which may be required by
the Division or any other Federal, State, of Local government agencies. [G.S. 143-215.1(b)]
13. If the Permittee/Applicant holds a system -side collection system operation, maintenance and
management permit (WQCS-prefix) from the Division, then the following applies: For all newly
constructed, modified and rehabilitated pump stations, all equipment and components shall be sealed
within a corrosion -resistant coating or encasement to the extent practicable and equivalent to the
minimum design criteria unless the permittee can demonstrate it is not practicable or another form
