JAY ZIMMERMAN ])7 re, ror DWR Project# 06-1804 V5 Johnston County Subject Property: The Village at Flowers Plantation — POD 10 Phase One UT to Mill Creek [030402,27-39, WS -IV, NSW] APPROVAL OF STORMWATER MANAGEMENT PLAN Dear Ms. Flowers: On February 22, 2013, the Division of Water Resources (DWR) issued a 401 Water Quality Certification and Authorization Certificate per the Neuse River Buffer Protection Rules (I 5A NCAC 2B .0233) to place fill within or otherwise impact the following: Type of Impact Amount Approved units 404/Wetlands 0.122 acre — permanent 404/Wetlands .005 acre — temporary Stream — permanent 1,242 (If) Stream — temporary 200 I Buffer —Zone 1 76,644 s Buffer— Zone 2 1 38,891(so The 401 certification requires that a stormwater management plan (SMP) be developed and approved for each phase of this project prior to any land disturbance and that no buildings shall be occupied until the stormwater management plan is constructed and operational for that phase. It further requires that all SMP's be designed in compliance with the NC DENR Stormwater BMP Manual in effect at the time of submittal. According to these requirements, a stormwater management plan for POD 10 Phase One was received by this Division on October 30, 2015 and reviewed for compliance. The DWR approves the SMP for POD One as meeting the 401 Water Quality Certification conditions. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new SMP. This approval requires that you follow the conditions listed in the Water Quality Certification for the project and the following additional conditions listed below: 1. The SMP approved by the DWQ consists of one (1) grassed bioretention cell and all associated stormwater conveyances, inlet and outlet strictures, and the grading and drainage patterns depicted on plan sheets dated April 15, 2015. The plans and specifications for POD 10 Phase One approved by DWR are incorporated by reference into this approval and are enforceable by State of North Carolina I Environmental Quality I Water Resources 1401 & Buffer Permitting 1617 Mail Service. Center ( Raleigh, North Carolina 27649-1617 919 707 9000 Johnston County DWR # 2006-1804 Page 2 of 2 DWR, provided however that any modification of the design for the bioretention cell that is accepted by DWR shall take precedence over the original plans and specifications. 2. The maximum allowable drainage area for the approved bioretention cell shall be 222,987 square feet and the maximum allowable built -upon area within that drainage area shall be 77,540 square feet. 3. The footprint of the bioretention cell as well as an additional 10 -foot wide area on all sides of the device shall be located in public rights-of-way, dedicated common areas or recorded easement areas. The final plats for the project showing all such rights-of-way, common areas and easement areas shall be in accordance with the approved plans. 4. Maintenance activities for the bioretention cell shall be performed in accordance with the notarized O&M agreements signed by you on July 29, 2015. The O&M agreement must transfer with the sale of the land or transfer of ownership/responsibility for the BMP facility. DWR must be notified promptly of every transfer. 5. The applicant and/or authorized agent shall provide a completed Certificate of Completion form to the DWR within thirty (30) days of project completion (available at http:44por-tal.nedenr.org/web/wq/swp/ws/40 I /certsandperiiiits/apply/forms).
